Where Vivmark Residential does well

  • Renewals 0 of 20. Nothing found.
  • Technology Disputes — i.e., privacy claims about cookies and pixels on their sites — are expressly carved OUT of mandatory arbitration and can be litigated in court (Terms §21.2), a rare consumer-friendly exclusion; an opt-out of arbitration exists at all (short as it is), plus a small-claims-court carve-out.
  • The Privacy Notice grants real consumer rights (know/access/delete/correct, opt out of sales and targeted ads, appeal, no retaliation) to residents of seven states and honors Global Privacy Control signals.
  • Biometric data (facial scans for ID verification, e.g. self-guided tours) is consent-based with a hard 24-month retention cap and a breach-notification commitment.
  • Vivmark states it does not sell personal information to train large language models, and SMS opt-in data is not shared with third parties for their own marketing.
  • Lease disputes are explicitly governed by the written lease, not these website terms.

You give up your right to sue in court over anything related to the site or app — unless you figure out how to send an opt-out notice within five business days of your very first visit, an extremely short window most people will miss.

The fine print

6 clauses and findings from the draft archive, dated 1 October 2026. The plain English comes first; the small print is the company's own words. None of these has been checked yet.

  1. You give up your right to sue in court over anything related to the site or app — unless you figure out how to send an opt-out notice within five business days of your very first visit, an extremely short window most people will miss. Related clauses also strip your right to join a class action and your right to a jury trial.

unless you provide us notice of opt-out within five (5) business days of your first use of the Service... then ANY AND ALL DISPUTES ARISING BETWEEN YOU AND US (WHETHER BASED IN CONTRACT, STATUTE, REGULATION, ORDINANCE, TORT... OR ANY OTHER LEGAL OR EQUITABLE THEORY), WHETHER ARISING BEFORE OR AFTER THE EFFECTIVE DATE OF THESE TERMS, MUST BE RESOLVED BY FINAL AND BINDING ARBITRATION.

Terms of Use (§21.3 Binding Arbitration; Opt-Out)

  2. Vivmark can change the deal whenever it wants, with no notice to you beyond posting new text on the site — and simply using the site again means you agreed to the new version. The Privacy Notice has identical language, so your data terms can shift the same way.

Vivmark may revise and update these Terms from time to time in its sole discretion by posting updated Terms on the Service and identifying the effective date of the updated version. Changes are effective when posted unless a different effective date is stated. Your continued use of the Service after the updated Terms are posted constitutes your acceptance of the revised Terms. You are responsible for reviewing these Terms periodically.

Terms of Use (§2 Changes to these Terms)

  3. Your name, contact details, browsing history, location data, and profiles inferred about you are shared with ad vendors, analytics firms, and social networks in ways that legally count as 'sales' of your data under several state privacy laws. The notice also names Google Analytics and the Meta Pixel as trackers on the site, and Do Not Track browser signals are ignored (only Global Privacy Control is honored). Cookie opt-outs must be set separately on each of Vivmark's websites.

Although we do not sell Personal Information in exchange for money, some of the ways in which we share Personal Information for Targeted Advertising may be considered 'sales' under the U.S. Privacy Laws. We share for purposes of Targeted Advertising the following categories of Personal Information: Contact Information and Other Identifiers; Personal Records; Customer Account Details and Other Commercial Information; Internet, Device, or Other Electronic Network Activity; Geolocation Data (where permitted); and Inferences.

Privacy Notice (§8(a) Personal Information Sales and Sharing for Targeted Advertising)

  4. Anything you post — reviews, photos, feedback — becomes theirs forever: they can sell it, use it in ads, attach your name and likeness to it, and pay you nothing. And 'you may not have the right to access, archive, change, or remove UGC after submission' — so you can't reliably take it back.

You hereby grant Vivmark a non-exclusive, unrestricted, unconditional, unlimited, worldwide, irrevocable, perpetual, transferable, sublicensable, and cost-free right and license to use, copy, record, distribute, reproduce, disclose, sell, resell, sublicense, display, publicly perform, transmit, publish, broadcast, translate, make derivative works of, modify, reformat, edit, adapt... all or any portion of your UGC... for any purpose, in any format, medium, technology, or device now known or later developed, including for advertising, marketing, promotion... You understand that you will not receive compensation for rights granted in this Section.

Terms of Use (§8 User-Generated Content and Submissions)

  5. No matter what goes wrong — a data breach, faulty info on the site, hacked account — the most you can ever recover from them is $100 (or what you paid them in a year, if more). They also declare their own data security can't be guaranteed while capping their responsibility if it's breached.

In no event will Vivmark's aggregate liability for any and all claims related to the Service exceed $100 US or the amount you paid to Vivmark, if any, in the last 12 months, whichever is greater.

Terms of Use (§18 Limitation of Liability)

  6. You have only one year to start any dispute or it's gone forever — shorter than most statutes of limitations. And the playing field tilts: Vivmark reserves the right to run to court for an injunction, while a separate clause bars you from seeking any injunction or equitable relief that could interfere with their site, content, or IP.

if you or we want to assert a Dispute against the other, then you or we must commence it (by delivery of a NOTICE OF DISPUTE as set forth in Section 21(a)) within one (1) year after the Dispute arises – or it will be forever barred. The foregoing provisions of this Section will not apply to any legal action taken by us to seek an injunction or other equitable relief...

Terms of Use (§21.6 Limited Time to File Claims; §21.4 Injunctive Relief)

How these were found

Both documents (Terms of Use and Privacy Notice) are effective August 17, 2026 and were read in full directly from the official domain (vivmarkresidential.com) via browser_open on October 1, 2026 — no mirror was needed. Official domain confirmed via news coverage of the August 2026 AvalonBay Communities + Equity Residential merger of equals (ticker VMRK); no separate 'Live On' branding exists — Vivmark is the post-merger name. The page fetcher redacted all contact email addresses (rendered as [email protected] placeholders), so the arbitration opt-out email addresses could not be verified. The incorporated 'Text Program Terms and Conditions' were not separately reviewed. The Section 10 body (Online Applications/Transactions) appears merged under Section 9 on the rendered page. Legacy Equity Residential and legacy AvalonBay privacy-request systems still run in parallel (separate forms, portals, and phone numbers), so rights-request paths are fragmented. These website terms explicitly do not govern lease disputes — written lease agreements control those. Company is only ~6 weeks old, so terms are brand-new and untested.

These notes come from the original draft and are not independent verification.
