Where Travelers Companies (The) does well
- Renewals 2 of 20. Few problems found.
- The consumer privacy notice commits to not giving or selling personal information to nonaffiliated third parties for their own marketing purposes without prior consent, and the Online Privacy Statement only lets third parties market to you 'if you have given us permission.' The arbitration clause is narrow in scope — it covers only disputes arising 'exclusively' out of the website/app terms, not disputes over your actual insurance policy, which are governed by the policy and state insurance law.
- The site offers a cookie-preference management tool and a 'Do Not Sell or Share My Personal Information' footer link, plus industry opt-outs (NAI, DAA).
- Consumers can request access to and correction of their personal information in writing, with a 30-business-day response commitment.
Just by using Travelers' website or app, you give up your right to sue them in court or join a class action over anything about the website or app itself. Disputes go to private binding arbitration with JAMS instead, on an individual basis only. The clause is bolded as a banner at the top of the terms, and no opt-out procedure is offered.
The fine print
7 clauses and findings from the draft archive, dated 1 October 2026. The plain English comes first; the small print is the company's own words. None of these has been checked yet.

EXCEPT FOR DISPUTES THAT QUALIFY FOR AND ARE FILED IN SMALL CLAIMS COURT, ALL DISPUTES ARISING EXCLUSIVELY OUT OF THESE TERMS OF SERVICE ... WILL BE RESOLVED THROUGH FINAL AND BINDING ARBITRATION BEFORE A NEUTRAL ARBITRATOR INSTEAD OF IN A COURT BY A JUDGE OR JURY, AND YOU AGREE THAT TRAVELERS AND YOU ARE EACH WAIVING THE RIGHT TO TRIAL BY A JURY. YOU AGREE THAT ANY ARBITRATION UNDER THESE TERMS OF SERVICE WILL TAKE PLACE ON AN INDIVIDUAL BASIS; CLASS ARBITRATIONS AND CLASS ACTIONS ARE NOT PERMITTED AND YOU ARE AGREEING TO GIVE UP THE ABILITY TO PARTICIPATE IN A CLASS ACTION.

Simply visiting the site is treated as consent to being watched: Travelers logs your clicks, scrolls, pages viewed, time spent, and videos watched, keeps those records, and can hand them to any third party it chooses.
Travelers may monitor any use of the Online Properties and may capture and retain information and records reflecting your activity on any of the Online Properties for our business purposes. This may include records indicating clicks on pages or links, items that you view including videos, page views, time spent on pages, scrolling, and other actions taken while using the Online Properties... Travelers may disclose any of the information we capture by monitoring activity on Online Properties to one or more third parties.

What you type into a form can be captured and kept by Travelers and its third-party partners — even things you typed but never submitted, like a half-finished quote request.
Also, if you type information into forms or other fields on the Online Properties, what you enter may be captured and retained by us and our third-party partners for our business purposes.

Travelers openly admits it 'sells and shares' your identifiers, browsing activity, geolocation, and audio/visual information with marketing and advertising partners through website cookies and tracking pixels, even though the privacy statements say it doesn't sell data to 'nonaffiliated third parties' for marketing without consent — under CCPA rules, ad-tech data flows count as a sale even without money changing hands.
Under the CCPA, these disclosures constitute a 'sale' when the personal information is exchanged for non-monetary consideration (anything of value), or 'sharing' when the personal information is disclosed for cross context behavioral advertising purposes. We sell and share, including in the 12 months preceding the date this Disclosure was last updated, the following categories of Personal Information: Identifiers; Commercial information; Internet or network activity information; Geolocation Data; Audio, electronic, visual, and similar information.

If the website or app causes you any harm — even through Travelers' own negligence — the most you can ever recover under these terms is $50, and your only real remedy for being unhappy with the site is to stop using it.
THE MAXIMUM AGGREGATE LIABILITY OF TRAVELERS FOR ALL DAMAGES, LOSSES AND CAUSES OF ACTION, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, SHALL BE FIFTY U.S. DOLLARS ($50.00).
-
Travelers keeps your personal information indefinitely — there is no stated retention limit or deletion timeline, only that they can keep it as long as the law permits and their own purposes require.
We retain Personal Information for as long as permitted or required by applicable law, including to fulfill our purposes for the Personal Information.

Travelers can rewrite the terms whenever it wants; simply continuing to use the site after the changes are posted counts as accepting them. No notice period and no re-consent are promised (the privacy statement has an identical clause).
Travelers may change these Terms of Service at any time. Any changes will become effective when the revised Terms of Service are posted on the Online Properties or you are otherwise notified of such changes. Your use of the Online Properties following these changes means that you accept the revised Terms of Service.
How these were found
Documents read directly from travelers.com on Oct 1, 2026 (no mirror needed): 'Terms of Service — Legal' (Revised June 19, 2023) at travelers.com/about-travelers/legal; 'Online Privacy Statement' (Revised April 9, 2025) at travelers.com/about-travelers/privacy-statements; 'Privacy Statement for Individual U.S. Personal Insurance Consumers' (Revised August 13, 2017) at travelers.com/privacy-statements/privacy-for-consumers.aspx. The CCPA 'we sell and share' admission comes from a search-result snippet of the official 'California Consumer Privacy Act Disclosure' page (travelers.com/about-travelers/privacy-statements/privacy-for-ca-consumers); that page was not fully opened. Consumer-privacy notice is from 2017 and may not be the current version. The arbitration clause's scope is limited to disputes 'arising exclusively out of these Terms of Service' (website/app use), not insurance policy disputes themselves, which are governed by the policy and state insurance law.
