United Rentals

out of 100. Number 305 of 512, counting from the worst.
Where United Rentals does well
- Renewals 2 of 20. Few problems found.
- No forced arbitration clause appears in any of the three documents — individual lawsuits are expressly preserved ('Nothing in this paragraph, however, limits Customer's right to bring a lawsuit as an individual plaintiff').
- The privacy notice honors Global Privacy Control signals as an opt-out of personal-information 'sale'/sharing, and Section 10 openly acknowledges that targeted-advertising sharing 'may be considered a sale' under state laws — more transparent than most. Clear rights-request channels: privacy@ur.com, 203.618.7342, and a named Privacy Officer mailing address.
- The indemnity clause carves out losses 'caused solely by the intentional misconduct or sole negligence of United' — a fairer limit than many B2B contracts.
- The 2% Environmental Service Charge is capped ($99 max) and explicitly disclosed as 'not a government-mandated charge' and 'not designated for any particular use,' rather than being dressed up as a tax.
If many customers are harmed the same way, you cannot join together in a class action — you must each sue United Rentals alone, individually.
The fine print
7 clauses and findings from the draft archive, dated 1 October 2026. The plain English comes first; the small print is the company's own words. None of these has been checked yet.
-
If many customers are harmed the same way, you cannot join together in a class action — you must each sue United Rentals alone, individually.
Customer agrees that any claims or proceedings brought by Customer relating to this Agreement will be conducted on an individual basis, and not on a class-wide, collective, or representative basis, and that any one person's claims or proceedings may not be consolidated with any other claims or proceedings. Customer will not sue United as a class plaintiff or class representative, join as a class member, or participate as an adverse party in any way in a class-action lawsuit against United.
-
You give up the right to a jury trial, and you can only sue in the courts of the county where the rental store is located — wherever that happens to be, no matter where you are.
The federal and state courts in the county in which the Store Location is located shall have exclusive jurisdiction over all matters relating to this Agreement. TRIAL BY JURY IS WAIVED.

United Rentals can rewrite the rental contract terms at any time, and the new terms take effect immediately when posted online — just by continuing to hold the equipment, you 'agree' to changes you may never have seen.
United reserves the right to modify or make changes to these Rental and Service Terms at any time. Any such modification will be reflected in these terms as of the 'Last update' date below and will be effective immediately upon public posting on United's website. Customer's continued use of the Equipment following any such modification constitutes the Customer's acceptance of these modified Rental and Service Terms.
-
United Rentals declares itself the owner of all GPS/telematics data generated while you operate their rented equipment — where it went, when, how it was used — and pushes onto you the job of getting your own employees' legal consent to that tracking.
Customer agrees that United owns the data described in this paragraph and may use such data, including GPS data, in accordance with United's Privacy Policy located at https://www.unitedrentals.com/legal/privacy-policy. Customer shall obtain all required consents as may be required under any applicable laws from its employees, contractors or other Qualified Operators to permit United's collection and use of data under this Section.
-
Location and usage data collected from equipment during your rental may later be handed to the next customer who rents the same machine — your job-site movements can be shared with whoever rents the equipment after you.
As noted in our Rental and Service Terms, telematics data may be available to subsequent users of equipment.
-
United Rentals collects facial-geometry scans (biometric data) in the US and Canada, plus Social Security numbers, driver's license numbers, and passport numbers — an unusually sensitive haul for renting construction equipment.
Biometric data*, including a scan of your facial geometry based on photos you provide to United Rentals' vendor(s), as applicable (in the United States and Canada only)
-
United Rentals can charge your card on file for practically anything — late returns, extended rentals, delivery fees, taxes — and overdue balances rack up interest at 2% per month (24% per year).
Customer agrees that United reserves the right to charge the Credit Card and/or Customer's account for any amount owed by Customer pursuant to this section due to late or past due payment(s), pickup or delivery charge(s), extended rental(s), rental or Service charges or Taxes. ... there shall be added to all past due charges a late payment fee equal to the lesser of two percent (2%) per month (24% per annum) on any such payments outstanding after 30 days.
