Xcel Energy
Utilities
40
out of 100. Number 306 of 512, counting from the worst.
Where Xcel Energy does well
- Arbitration 2 of 20. Few problems found.
- Renewals 2 of 20. Few problems found.
- No forced arbitration: disputes are resolved 'pursuant to the laws of such state' in court or before the state utility commission (§18) — a real and better alternative than private arbitration.
- Explicit 'We do not sell this information' pledge for personal information and Energy Usage Data.
- Full SSN is deleted after ~60 days, keeping only the last four digits for ongoing verification, and Minnesota residents cannot be denied service for refusing to provide an SSN.
- Third-party data-sharing consent can be revoked any time (datarequest@xcelenergy.com), and declining a third party's data request does not affect utility service.
- The utility service itself is regulated by public utilities commissions, so core billing and shutoff protections sit in tariffs and law, not just these terms.
Xcel Energy can rewrite the terms whenever it wants, on its own say-so.
The fine print
8 clauses and findings from the draft archive, dated 1 October 2026. The plain English comes first; the small print is the company's own words. None of these has been checked yet.

Xcel Energy can rewrite the terms whenever it wants, on its own say-so. Just logging in or using My Account afterward counts as you agreeing to the new terms — you don't have to click anything.
XCEL ENERGY MAY MODIFY THESE TERMS AT ANY TIME IN ITS SOLE DISCRETION. WHILE XCEL ENERGY WILL MAKE REASONABLE EFFORTS TO NOTIFY YOU OF MATERIAL CHANGES TO THESE TERMS OF USE, YOU ARE RESPONSIBLE FOR REVIEWING THESE TERMS OF USE ON A REGULAR BASIS. BY ACCESSING OR USING THE SERVICE FOLLOWING SUCH MODIFICATION, YOU AGREE TO BE BOUND BY SUCH CHANGES TO THE TERMS.

If Xcel Energy's website/app causes you harm — say a billing error or lost data — the most you can recover from them is $250 total, no matter what happened.
IN NO EVENT WILL THE LIABILITY OF XCEL ENERGY, ITS AFFILIATES OR SUBSIDIARIES, OR THEIR OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUCCESSORS OR ASSIGNS, IN CONNECTION WITH THIS AGREEMENT OR THE CONTENT UNDER ANY THEORY OF LIABILITY, WHETHER IN CONTRACT, TORT, STRICT LIABILITY OR OTHERWISE, EXCEED $250.00 IN THE AGGREGATE.

Without asking you, Xcel Energy can share your info inside the company, with its vendors, and — notably — refer your past-due account to a collection agency or for sale to debt collectors. If you don't consent to the rest, you don't get your utility service affected, but debt-collection sharing doesn't need your permission.
There are situations in which we may share/disclose information about you without obtaining your consent, including these: Within our enterprise to those with a business need / When required or permitted by law or regulation / With service providers that assist us in providing products and services / Aggregated or de-identified energy usage data to third parties / Referral of past due account for collection/sale / Transfer of service rights to another utility provider.

Xcel Energy buys data about you from outside data brokers to enrich your profile, and uses it for marketing analytics — so the marketing you get from them can be powered by data you never gave them.
We may also supplement the information we have about you with additional data we obtain from third parties to perform analytics (such as market research and trend analysis), which are intended to make our communications and the products and services we offer to you more relevant.

Your smart meter doesn't just track kilowatt-hours — its readings can reveal your daily routine: when you wake up, leave, come home, and sleep. Xcel Energy openly says so.
Depending on the type of metering equipment installed at your home or business, it may be possible to get insight into your daily activities through analysis of your Energy Usage Data.
-
If you join Xcel's EV home-charger program, they declare that they own the data from your charger — your charging times, patterns, electricity use — and can use it for any lawful purpose, not just running the program.
You consent and acknowledge that Xcel Energy owns and may use the data recorded through the Charging Equipment for any purpose consistent with Colorado law, including Commission rules.
Public Service Company of Colorado EV Home Charging Customer Service Agreement, §12

Even if you ask Xcel Energy to delete your information, anything already copied into their backup systems stays there until their own internal schedule wipes it — deletion requests can't reach the backups.
Note that any information stored on backup information systems, including SSNs, cannot be removed upon request. This information is deleted on a set schedule in the ordinary course of business.

Simply agreeing to the website terms hands Xcel Energy blanket permission to call and text you with robocalls and automated messages. You can opt out by replying STOP, but the consent is granted upfront.
You authorize Xcel Energy to contact you at the phone or mobile number provided in your account/s, via phone, text (SMS or MMS), or other similar method using automated dialing technology, artificial messages, or prerecorded messages. Consent is not a condition of buying any property, goods, or services. To opt-out at any time, reply "STOP".
How these were found
Terms of Use read in full from Xcel Energy's official My Account site (my.xcelenergy.com, BuildingRemodeling page) on Oct 1, 2026; no effective date shown on that page. A mirrored copy ('Digital Terms And Conditions 7.2021') on a workers.dev archive domain matches the text and is dated July 2021, so this version has been stable for years. Privacy data points came from the official MN Data Privacy bill insert PDF (© 2022 Xcel Energy Inc., #22-08-201) hosted on xcelenergy.com. The current Privacy Notice's expandable sections on my.xcelenergy.com/s/privacy did not render for automated fetch, so the current notice's Retention section could not be verified; quotes from the 2022 bill insert may differ slightly from the 2026 notice. EV-charger data quote from the official CO EV Accelerate At Home Customer Service Agreement on tx.my.xcelenergy.com. All URLs cited are on official xcelenergy.com domains (no third-party mirrors used).
