Where TKO Group Holdings does well

  • WWE's Terms of Use open with a bold upfront warning that they contain 'a binding arbitration clause and class action waiver' — rare plain disclosure.
  • Small claims are carved out of arbitration, WWE reimburses arbitration filing fees for claims under US$10,000 and won't seek attorney's fees unless claims are frivolous.
  • For material changes to WWE's terms that would disadvantage users, WWE promises email notice at least one month before the change takes effect, with the right to cancel first — far better than UFC's change-without-notice language.
  • The new Club WWE loyalty program terms (July
  • guarantee cancellation parity ('no more steps than the process used to sign up'), require separate express consent for paid tiers, and give 90 days' notice before program discontinuation — a clean model following the Fight Pass settlement.
  • TKO honors the Global Privacy Control browser signal as a valid opt-out of sale/sharing for cookie data and provides a 'Do Not Sell or Share My Information' link plus a dedicated privacy phone line (1-866-983-0571).

If you have any dispute with WWE — about subscriptions, purchases, privacy, anything — you cannot sue them in court.

The fine print

6 clauses and findings from the draft archive, dated 1 October 2026. The plain English comes first; the small print is the company's own words. None of these has been checked yet.

  1. If you have any dispute with WWE — about subscriptions, purchases, privacy, anything — you cannot sue them in court. You must go through binding arbitration (a private process with a single arbitrator instead of a judge or jury). There is no opt-out: just using WWE's sites and apps binds you to this.

If you and WWE do not resolve any dispute by informal negotiation, any other effort to resolve the dispute will be conducted by binding arbitration under the U.S. Federal Arbitration Act and federal arbitration laws, except as provided in this section.

  2. You also give up the right to join or start a class action against WWE, and you give up your right to a jury trial — all disputes must be fought alone, one fan at a time, in private arbitration.

You and WWE also agree that any proceedings to resolve or litigate any dispute will be conducted solely on an individual basis. Neither you nor the WWE will seek to have any dispute heard as a class action or in any other proceeding in which either party acts or proposes to act in a representative capacity... We both also expressly waive the right to a trial by jury.

  3. UFC Fight Pass subscriptions auto-renew and charge your card repeatedly by default, and the terms tell you to cancel by sending an email rather than offering a one-click in-account cancel. This practice already cost UFC real money: in 2025 Zuffa agreed to a $1.2 million class-action settlement over allegations it auto-renewed Fight Pass subscriptions without the required disclosures and consent (claims period Oct 2018–Jan 2025).

By utilizing a credit or debit card for purchase of any of the Subscription Products or any other services/products offered for purchase through the Site, you authorize us to charge such card on a periodic basis as specified in the amount described on the applicable Subscription Product or other services/products purchase path(s). Billing and Automatic Renewal Policies... To cancel your monthly subscription or the annual automatic renewal feature, send an e-mail to UFCTVSupport@UFC.com; cancellation will become effective as of the next monthly billing cycle following receipt.

  4. TKO can hand your personal information to third-party businesses so they can market to you — and it can also buy your contact info from lead-generation companies to send you marketing emails. Opt-outs exist but are split across separate forms and links (one for cookies, another for contact info), and they depend on your jurisdiction.

We may disclose your information to reputable third parties so that they may contact you to offer products, services, and promotions, such as sweepstakes and contests that you may find valuable. We may also disclose your information to third-party advertising networks or other parties with whom we have a contractual relationship... These third parties may include lead generation companies that provide us with contact information used for sales and marketing purposes.

  5. UFC can change these terms, change what you paid for, or raise subscription prices at any time without telling you in advance — just by posting it on the site. Your continued use of the site counts as accepting the new terms.

UFC reserves the right to change the terms of this Agreement or to change, modify or otherwise alter any features of this website at any time and for any purpose without notice and you agree to be bound by such modifications or revisions... UFC may make changes to any products or services offered on the Site, or to the applicable prices for any such products or services, at any time, without notice.

    UFC Terms of Use

  6. Even after you delete your account, TKO keeps your personal data for an undefined 'reasonable period thereafter' — no specific number of days or years is given. Separately, anything you submit to WWE (photos, videos, ideas, comments) becomes WWE's property outright: 'All Submissions, whether solicited or unsolicited, shall become and remain the property of WWE.'

We will retain your personal information for as long as needed or permitted in light of the purpose(s) for which it was obtained and consistent with applicable law. The criteria used to determine our retention periods include: (i) the length of time we have an ongoing relationship with you and provide the Services to you (typically for the duration of your account plus a reasonable period thereafter)...

How these were found

WWE Terms of Use read directly from wwe.com (marked 'Updated as of July 16, 2026'); TKO Group Holdings Privacy Policy read directly from tkogrp.com (Effective Date: August 13, 2026). UFC.com Terms of Use read directly from ufc.com — the page header still shows a 2017 copyright notice and its 'Last Updated' metadata is unclear, so it may reflect an older version of the Fight Pass terms; UFC may have published newer subscription terms elsewhere that were not located. The UFC Fight Pass auto-renewal settlement figures come from third-party reporting (topclassactions.com, openclassactions.medium.com, March 2025), not from company documents. No mirrors were needed; no access blocks encountered.
