Erie Indemnity

Financials

60

out of 100. Number 119 of 512, counting from the worst.

  • Arbitration 17 of 20, bad
  • Renewals 2 of 20, good
  • Data sharing 13 of 20
  • Price & terms 13 of 15, bad
  • Data retention 8 of 15
  • Other findings 7 of 10, bad

Where Erie Indemnity does well

  • Renewals 2 of 20. Few problems found.
  • Cancellation, nonrenewal, conditional renewal, renewal with altered terms, and premium increase notices are explicitly NOT subject to paperless electronic delivery — Erie can't bury a cancellation notice in your inbox.
  • Its driving-data telematics programs (Your Turn/EnRoute via Cambridge Mobile Telematics) are described as based on your explicit consent at registration, and embedded YouTube videos run in privacy-enhanced mode to block tracking cookies.
  • The reCAPTCHA section is unusually transparent: Google processes that data only as a processor under the Google Cloud DPA, and Erie states it does not use reCAPTCHA data for advertising or marketing.
  • The arbitration clause preserves the right to seek provisional remedies from a court.

Simply browsing Erie's website or using its app means you give up your right to sue in court or join a class action over any dispute about the site, the app, or how your data is handled.

The fine print

6 clauses and findings from the draft archive, dated 1 October 2026. The plain English comes first; the small print is the company's own words. None of these has been checked yet.

  1. Simply browsing Erie's website or using its app means you give up your right to sue in court or join a class action over any dispute about the site, the app, or how your data is handled. Disputes go to a single arbitrator in Erie, Pennsylvania under JAMS rules — and the arbitrator even decides whether the arbitration clause itself applies to your dispute. There is no opt-out.

Any dispute, claim or controversy arising out of or relating to these Terms of Use or our Privacy Policy, or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by arbitration in Erie, Pennsylvania before one arbitrator... ERIE and you waive any right to join or consolidate disputes by or against others as a representative or member of a class, to obtain relief in any arbitration in the interests of the general public, or to act as a private attorney general.

    Terms of Use

  2. Erie can rewrite its terms at any time with no notice to you — just visiting the site again after a change counts as you agreeing to it. The Privacy Policy uses the same trick: 'Your continued use of this Site or App after any changes are posted will be considered acceptance of those changes.' You are expected to re-read the legalese on your own.

ERIE reserves the right to modify these Terms of Use at any time, and will post the changes on this page. Continued use of the Site by you will constitute your acceptance of any revisions to the Terms of Use. Please check this page regularly.

    Terms of Use

  3. Erie openly allows analytics and marketing partners to track you across other websites and services, not just erieinsurance.com. Separately, the policy admits Erie shares site/app data 'with our affiliates or companies that perform marketing services on our behalf' and sends 'non-personally identifiable information to third party service and marketing providers' to target ads at you 'during your visits to this and other websites.' No general opt-out is described — the only tool offered is Google's own Analytics opt-out add-on.

These third parties may set and access their own tracking technologies on your device (including cookies and other tracking technologies) and may otherwise collect or have access to your personal information over time, including your visits to and activity on the Site as well as other websites and online services.

    Privacy Policy

  4. Even when you delete your app account, Erie can keep your personal information — and the 'business purposes' exception is vague enough to cover almost any commercial reason. Deleting the account is not the same as deleting the data.

App users may request deletion of accounts created within the App by contacting us as indicated in the Questions section below. If you request deletion of your account created in the App, we may retain your information for legal, auditing, regulatory and/or business purposes.

    Privacy Policy

  5. Anything you submit through the site — suggestions, feedback, uploaded material — is handed to Erie on a permanent, worldwide, royalty-free license that lets them use and even sublicense it. The Customer Care page doubles down: 'You transfer all right, title and interest in such material to ERIE upon your submission.' Only regulated 'nonpublic personal information' is carved out.

To the extent you provide any materials or information to ERIE other than nonpublic personal information, you grant to ERIE an unrestricted, perpetual, irrevocable, worldwide, royalty-free license to use, reproduce, display, publicly perform, sublicense, transmit and distribute such materials and information, in any medium and in any form, and you further agree that ERIE is free to use any ideas, concepts or know-how that you or individuals acting on your behalf provide to ERIE through or by means of the Site.

    Terms of Use

  6. If someone hacks your Erie online account, Erie disclaims any responsibility for what it costs you — but you are on the hook for any losses Erie or third parties suffer from the same breach. On top of that, 'ERIE may use the information you provide on the Site... including your username account information, for any purpose, commercial or non-commercial, including without limitation for marketing purposes.'

Although ERIE will not be liable for your losses caused by any unauthorized use of your username account, you will be liable for the losses of ERIE or others due to such unauthorized use.

How these were found

Terms of Use page is marked Rev. September, 2025; Online Privacy Policy is marked 'Updated and Effective as of: 4/9/2026'. Both were read in full directly from erieinsurance.com on Oct 1, 2026 via text fetch (no mirror used). I did NOT review the separate Erie Insurance Group Privacy Notice for policyholders (the insurance-contract privacy notice under state insurance privacy laws), nor any actual insurance policy contracts or app-store-only agreements, so policy-side clauses are not scored. Telematics (Your Turn/EnRoute) details come only from the Privacy Policy's summary paragraph. The agency-posted privacy-notice mirror (wrins.com) was found in search results but was not used as a source for any finding.

These notes come from the original draft and are not independent verification.
