Where Copart does well

  • Arbitration 3 of 20. Few problems found.
  • Renewals 3 of 20. Few problems found.
  • No forced arbitration and no class-action waiver anywhere in the Terms of Service or Member Terms — disputes go to court (Texas/Dallas venue), which is better than the arbitration clauses most consumer platforms impose.
  • The Privacy Policy states Copart does not rent, sell, or share personal information except in narrowly defined cases, promises to notify you before an acquisition transfers your data to a different privacy policy, and 'will attempt to obtain your consent' before loosening data protections.
  • Biometric data (facial geometry from signup photos) is capped at a 3-year retention maximum and is never disclosed to third parties except identity-verification/fraud-prevention service providers.
  • If Copart cancels a sale after you've paid, the payment is returned to the original form of payment (or credited to your account).

Copart can rewrite the rules and change any fee whenever it wants, with no warning.

The fine print

6 clauses and findings from the draft archive, dated 1 October 2026. The plain English comes first; the small print is the company's own words. None of these has been checked yet.

  1. Copart can rewrite the rules and change any fee whenever it wants, with no warning. It's entirely on you to check the fee schedule before you bid — you might pay more than you expected with no recourse.

Copart reserves the right to amend these Terms and Conditions at any time without prior notice to you. ... All fees are subject to change without prior notice. The Member is solely responsible for ascertaining applicable fees prior to bidding on a vehicle.

  2. Even after you delete your account, Copart can keep your personal information in its live databases forever — limited only by what the law forbids.

Copart may store your account information active in our databases indefinitely following the termination of your account with Copart to the maximum extent permitted by law.

  3. If your purchased vehicle racks up a government fine (parking ticket, toll, impound), Copart can pay it for you and then charge your card or bank account up to 1.5x the fine plus $75 per item — a markup on someone else's ticket, auto-debited.

Copart further reserves the right to pay, and each Member hereby consents that, upon receipt all Vehicle Fines on the Member's behalf and to charge the Member a fee of up to 150% of the Vehicle Fine amount plus the $75 processing fee, either by deducting such amount from funds held in the Member's Copart account or by charge to the Member's credit card or debit to the Member's checking account on file with Copart.

  4. A mistaken click is a binding commitment — no take-backs. And if you dispute how Copart handled your bid, Copart itself is the sole judge, and you have to cover Copart's costs for its own decision.

Once a bid has been submitted, it cannot be retracted, deleted, or cancelled. ... Should a dispute arise regarding a bid, Copart is the exclusive deciding authority with sole discretion in resolving disputes. Members agree to indemnify, defend, and hold Copart harmless from any and all liability arising out of decisions made in resolving disputes.

  5. You give up the California protection that normally stops a release from covering claims you didn't even know about — Copart's liability waiver reaches claims you couldn't have foreseen.

Members and visitors who are California residents waive California Civil Code §1542, which reads: 'A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.'

  6. Signing up automatically opts you into marketing across every channel including texts, and turning on your browser's Do Not Track signal changes nothing about their tracking.

Members hereby agree and consent to receive marketing and promotional materials via mail, email, push email, facsimile, app, social media, text message or other then-current methods of communication from Copart. ... Like many websites and online services, Copart currently does not alter its practices when it receives a 'Do Not Track' signal from a visitor's browser.

How these were found

Documents relied on: (1) Copart U.S. Privacy Policy at cds.copart.com — effective Oct 29, 2004, last updated June 10, 2015 (it still references the EU–US Safe Harbor framework, which was invalidated by the EU in 2015, so the policy appears not to have been meaningfully refreshed in over a decade); (2) Copart Member Terms & Conditions (U.S. section) — last revised Nov 22, 2024, read via the official mirror at crashedtoys.com, a Copart-owned website hosting the same Member Terms incorporated by reference into Copart.com membership; the direct copart.com member-terms URL redirected to the homepage for the text fetcher (JS-heavy site), so the Copart-owned CrashedToys copy was used as a verbatim mirror; (3) Copart Website Terms of Service — last updated Nov 3, 2014. Quotes below are verbatim except where noted as close paraphrase; scoring is editorial. Fee amounts were not re-verified against the live member-only fee schedule, which Copart only shows to logged-in members.

These notes come from the original draft and are not independent verification.
