Where CMS Energy does well
- Arbitration 0 of 20. Nothing found.
- Renewals 3 of 20. Few problems found.
- No forced arbitration or class-action waiver appears anywhere in the documents read — the 'Disputes' section of the Account Terms contains none of the binding-arbitration language common in tech and telecom terms, which is rare and genuinely customer-friendly.
- The chatbot terms are unusually candid: they warn that AI translations 'may not be perfect or complete' and that chat answers 'may be incomplete or accurate for a limited time.' Card-payment restrictions explicitly 'do not apply to customers in shut off status,' protecting the most vulnerable customers.
- The $2.99/$9.99 payment fees are disclosed plainly in the terms along with the statement that 'Consumers Energy does not benefit from this fee.'
The company can change its website/app terms whenever it wants, with zero advance warning.
The fine print
10 clauses and findings from the draft archive, dated 1 October 2026. The plain English comes first; the small print is the company's own words. None of these has been checked yet.

The company can change its website/app terms whenever it wants, with zero advance warning. Your continued use counts as acceptance — you are expected to check back for changes yourself.
Consumers Energy reserves the right to update or modify the Terms at any time without prior notice to you. For this reason, we recommend that you review the Terms whenever you use the Site or App.
-
CMS Energy's corporate site terms can be supplemented unilaterally at any time; keeping up with the changes is your job, not theirs.

Simply handing over your phone number counts as consent to be robocalled — including telemarketing calls and texts — by autodialer. This is an exceptionally broad permission granted for nothing more than having a phone number on file.
When you provide a phone number that is a landline, a cell/wireless phone or a landline that is later converted to a cell/wireless phone to Consumers Energy and/or elect to participate in voice alerts and notifications and/or text message alerts and notifications, you agree that we may contact you by automatic telephone dialing systems and by automated, prerecorded or live calls. Your agreement includes telemarketing as well as non-telemarking calls and text messages.

They will not help you dispute a bad or fraudulent card charge — that's your problem with your bank. But they reserve the right to pull your financial information from that same bank on their own say-so (e.g., to 'resolve payment problems').
Disputes involving a credit card payment, including but not limited to chargebacks and fraud, must be resolved by your credit card company. Consumers Energy is not responsible for research or resolution of credit card payment disputes. Notwithstanding the foregoing, you agree that Consumers Energy may obtain financial information regarding your payment account from your financial institution for certain purposes (for example, to resolve payment problems or to verify that you are the owner of the account).
-
Your card and bank-account details are collected, stored, and processed by outside companies — and the vendor list can change at any time without you necessarily being told, so your payment data ends up wherever their current processor is.
Consumers Energy uses third-party vendors such as Paymentus Corporation in the collection, storage and processing of financial information (including credit or debit card data, and checking/savings account data) and the processing of financial transactions. Such third-party vendors may change from time to time.
-
Data the site collects about you automatically can be shared with government agencies (including the U.S. government) under network-security partnerships — a broad, opaque carve-out.
In order to strengthen our network security, Consumers Energy may participate in partnership agreements with private or public entities, including the U.S. Government, that involve the sharing of certain information collected automatically as described in the Privacy Policy.
-
If you use their data-sharing service (Green Button), your energy data can never be clawed back: revoking permission doesn't delete what third parties already received, and the utility disclaims all control over what they do with it.
You recognize, however, that once your personal information and data is shared with a third party at your request, Consumers Energy has no control over the third party's use of that information and data. Similarly, any revocation of your consent will not result in any third parties returning or destroying the information and data you shared.

Every conversation with their AI chatbot 'Watts' can be recorded, monitored, and retained — while the same section also warns you not to type sensitive data like your full SSN into that very chat.

How these were found
CMS Energy Terms of Use shows 'Revised December 2014' with no fresher version; General Digital T&Cs and Account T&Cs carry no visible revision dates. The CMS Energy Privacy Statement page (https://www.cmsenergy.com/privacy-statement/default.aspx) is fully readable only after dismissing a 'Machine-Readable File' transparency-plan modal, so its body text could not be read; only its opening line ('Privacy is a high priority at CMS Energy...') was visible via search snippets. No OpenTermsArchive/PrivacyTracker/Difficode mirrors exist for these domains. All findings below are from documents actually read in full via browser_open.
These notes come from the original draft and are not independent verification.
