Where Everest Group does well

  • Arbitration 3 of 20. Few problems found.
  • Renewals 0 of 20. Nothing found.
  • No forced arbitration and no class-action waiver anywhere in the Terms — disputes go to ordinary New Jersey courts, rare generosity in financial services.
  • The Privacy Portal offers a working Individual Rights request form covering Right to Know, Right to Delete, Right to Correct, and a Right to Opt out of Sale, with CCPA cited explicitly.
  • The content-grab in Section III explicitly carves out personal data handled under the Privacy Notices, so private data is not subject to the ownership grab.
  • The liability section includes a consumer-protection carve-out: "Certain state laws do not allow limitations on implied warranties or the exclusion or limitation of certain damages. If these laws apply to you, some or all of the above disclaimers, exclusions, or limitations may not apply to you, and you might have additional rights."

Anything you type, upload, email, or submit on the site stops being yours — it becomes Everest's property, and they can publish, share, or use it for marketing ("solicitations") with no further permission.

The fine print

6 clauses and findings from the draft archive, dated 1 October 2026. The plain English comes first; the small print is the company's own words. None of these has been checked yet.

  1. Anything you type, upload, email, or submit on the site stops being yours — it becomes Everest's property, and they can publish, share, or use it for marketing ("solicitations") with no further permission. Only formally submitted personal data covered by Privacy Notices is carved out.

With the exception of any personal data or information you submit which is maintained in accordance with our Privacy Notices, any information you transmit to the Everest via this website, whether by direct entry, submission, electronic mail or otherwise, including data, questions, comments, or suggestions, will be treated as non-confidential and non-proprietary and will become the property of Everest. Such information may be used for any purpose, including but not limited to reproduction, solicitations, disclosure, transmission, publication, broadcast, and posting.

Terms of Use (Section III. Website Privacy Policy)

  2. Everest can rewrite the terms at any time just by posting a new version, and you are legally treated as having agreed to changes you never saw. The Chile site says the same thing even more bluntly: terms "may be modified or updated at any time and without prior notice" and "will take effect from their publication on this site."

These Terms and Conditions, the Privacy Policy and the Company's other policies posted on this website constitute the entire agreement between you and the Company with respect to your use of this website and may be amended only: (i) by an authorized officer of the Company "executing a writing" amending these Terms and Conditions; or (ii) the Company posting a revised statement of these Terms and Conditions, the Privacy Policy and any other user policies and agreements. Users are deemed to be aware of and bound by any such changes.

Terms of Use (Section XVI. Miscellaneous)

  3. They can kill your account and delete your content at any time, for any reason, with no warning — including simply because you haven't logged in recently. Combined with Section III, anything of yours on the site can be claimed as their property or discarded.

We, in our sole discretion, and without prior notice, may terminate your password, account (or any part thereof), access or use of this website, and remove and discard any content within the website, for any reason, including, without limitation, for lack of use or if we believe that you have violated or acted inconsistently with these Terms and Conditions or the purpose of this website.

Terms of Use (Section XIII. Termination)

  4. On a mere suspicion (not proof) of a violation, they can bill you their administrative costs plus a reactivation fee on top of cutting off your access. You pay for the punishment apparatus.

We may take any one or more of the following actions in response to actual or suspected violations above: issue warnings: written or verbal; suspend access or posting privileges; suspend or terminate the user's account; charge the user for administrative costs and/or reactivation charges; or bring legal action to enjoin violations and/or to collect damages, if any, caused by violations.

Terms of Use (Section XI. Acceptable Use Policy)

  5. You agree to cover Everest's legal bills for any losses arising from your mere use of the website — not just from violating the terms. That is an unusually broad indemnity trigger, and it survives termination.

You agree to indemnify, defend, and hold harmless Everest, its affiliates and their officers, directors, employees, contractors, agents, licensors, service providers, subcontractors, and suppliers from and against any and all losses, liabilities, expenses, damages, and costs, including reasonable attorneys' fees and court costs, arising or resulting from your use of the website or any violation of these Terms of Use.

Terms of Use (Section XVI. Miscellaneous)

  6. Whatever you submit can be handed to governments or legal authorities whenever Everest decides it is necessary — no notice to you required. The published Cookies Policy, meanwhile, is a 10-line shell that names zero cookies, lists no trackers, and gives no opt-out instructions.

Except as may be expressly limited by our Privacy Notices Everest reserves the right at all times to disclose any information it deems necessary to satisfy any applicable law, regulation, legal process, or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part, in Everest's sole discretion.

How these were found

Everest Group is a B2B reinsurer: no consumer product/service terms exist publicly, so only the corporate website Terms of Use and privacy materials were scored. The full text of the US Privacy Notice did not render (page returned only its intro and contact block; effective Jan 1, 2020, last revised Dec 17, 2025), and the US Cookies Policy is a 10-line shell with no cookie details. The Terms of Use show no 'last updated' date and are identical across locale pages (us-en, it-en, bm-en, de-en), last crawled ~35 days ago. The Chile T&C snippet comes from the LATAM regional site. No mirrors were needed; everestglobal.com fetched directly.
