Where Block, Inc. does well

  • Renewals 3 of 20. Few problems found.
  • The arbitration clause includes a 30-day mail-in opt-out (better than peers like Coinbase that offer no opt-out at all), and small-claims court remains available.
  • Fee transparency is unusually good for fintech: a full CFPB-style prepaid fee table is published up front, with $0 monthly fee, $0 inactivity fee, no overdraft fee, and ATM/foreign-transaction fee waivers for customers with $300+/month direct deposits or $500+/month card spend.
  • Eligible direct-deposit customers get free overdraft coverage that can be turned off (autopay of overdraft balances can be disabled via support), rather than a fee-bearing overdraft product.
  • The privacy notice has plain-English annotations, an account-settings opt-out for the commerce media ad network, and a commitment not to knowingly sell or share children's data for targeted advertising; text-message marketing opt-outs are honored via reply-STOP.
  • FDIC pass-through insurance status is disclosed plainly (eligible for card/sponsored accounts via Wells Fargo/Sutton Bank up to $250k; not insured otherwise) with an explicit 'Cash App is a financial services platform, and not an FDIC-insured bank' — after regulators barred misleading FDIC claims under the 2026 multi-state consent order.
  • The 2026 multi-state consent order legally requires Block to provide live customer support 24/7 (human by phone 13.5h/day, chat 18h/day) and investigate unauthorized-transaction complaints within 3 business days — enforceable consumer protections few peers have.

If you have a legal dispute with Cash App, you cannot sue in court or join a class action — everything goes to private individual arbitration, and you give up your right to a jury trial.

The fine print

9 clauses and findings from the draft archive, dated 1 October 2026. The plain English comes first; the small print is the company's own words. None of these has been checked yet.

  1. If you have a legal dispute with Cash App, you cannot sue in court or join a class action — everything goes to private individual arbitration, and you give up your right to a jury trial.

ANY ARBITRATION UNDER THESE CASH APP TERMS WILL ONLY BE ON AN INDIVIDUAL BASIS; CLASS ARBITRATIONS, CLASS ACTIONS, REPRESENTATIVE ACTIONS, MASS ACTIONS, AND CONSOLIDATION WITH OTHER ARBITRATIONS ARE NOT PERMITTED. YOU WAIVE ANY RIGHT TO HAVE YOUR CASE DECIDED BY A JURY AND YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION AGAINST THE COMPANY.

Cash App Terms of Service, Section XXIII.20 Binding Arbitration

  2. If many customers bring similar complaints, only 12 test cases move forward and everyone else's claim is frozen while those play out — a mechanism designed to slow mass claims. There IS a 30-day mail-in opt-out (mailed to Block, 1955 Broadway, Suite 600, Oakland, CA 94612), so it's slightly less harsh than peers with no opt-out at all.

You and the Company agree that if twenty-five (25) or more similar individual arbitration demands are brought against you or us by or with the assistance of the same or coordinated counsel or entities ("Mass Proceeding"), the parties shall select twelve (12) individual arbitration demands (six (6) per side) for arbitration to proceed ("Bellwether Arbitrations")... all other demands for arbitration that are part of the Mass Proceeding shall be held in abeyance and stayed.

  3. Your transactions and account data can be fed into training AI/ML models, and Cash App builds a profile of your credit risk, shopping habits, and preferences from your data.

Improving, personalizing and facilitating your use of our Services, content and applications, including by training artificial intelligence (AI) and other machine learning models; Drawing inferences from any of the information we collect to create a profile about you that may reflect, for example, your credit risk profile, your preferences, characteristics, shopping habits, and other behavior.

  4. Cash App runs an ad network that uses your shopping history, card transactions, and location to serve personalized ads for other brands — this is opt-out (not opt-in) in most states, so it's on by default.

Starting on or after February 9, 2026: In connection with our commerce media network, we may use data about your activity, such as your shopping history, app browsing behavior, card transactions, and general location information to show you personalized advertisements for other brands outside of Cash App. You can opt out of (or where required by applicable law, opt into) this activity by visiting Account & Settings in your account and clicking Privacy.

  5. Cash App can rewrite the terms whenever it wants, decides for itself what counts as reasonable notice, and simply using the app afterwards counts as you agreeing to the new terms.

We may amend these Cash App Terms at any time with notice that we deem to be reasonable under the circumstances... Your continued use of the Services after the posting of a Revised Version constitutes your acceptance of such Revised Version.

Cash App Terms of Service, Section II Revisions, Disclosures and Notices

  6. Closing your account does not delete your data — Cash App keeps it indefinitely under broad justifications like fraud prevention and 'any other actions consistent with applicable law.'

Even after you close your account, we can retain information about you and any transactions or Services in which you may have participated for a period of time that is consistent with certain criteria, such as applicable law, applicable statute of limitations, or as we believe is reasonably necessary to comply with applicable laws... to detect or prevent fraud, to collect fees owed, to resolve disputes... or to take any other actions consistent with applicable law.

  7. Anything you upload (photos, payment notes, AI-generated content) gets Cash App a permanent, irrevocable, sub-licensable license — and this license survives even after you terminate your account.

You grant us and our subsidiaries, affiliates, and successors a worldwide, non-exclusive, royalty-free, fully-paid, transferable, irrevocable, perpetual, and sub-licensable right to use, reproduce, modify, adapt, publish, prepare derivative works of, distribute, publicly perform, and publicly display your Content throughout the world in any media for any reason... The following Sections of these Cash App Terms survive and remain in effect in accordance with their terms upon termination: V.1 (Your Content)...

Cash App Terms of Service, Sections V.1 Your Content and XXIII.10 Effect of Termination

  8. Even if Cash App's error loses your money, the most you can ever recover is $500 or 3 months of the fees they collected from you — and since Cash App's core service is free, the cap is effectively $500.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL LIABILITY OF THE COMPANY IS LIMITED TO THE GREATER OF (A) THE AMOUNT OF FEES EARNED BY US IN CONNECTION WITH YOUR USE OF THE SERVICES DURING THE THREE (3) MONTH PERIOD IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM FOR LIABILITY, OR (B) $500.

Cash App Terms of Service, Section XXIII.17 Limitations of Liability and Damages

  9. Cash App can shut down your account at any time for any reason, and in some cases your money can be held for an indefinite period — with no fixed timeline for getting it back.

We may terminate these Cash App Terms or any Terms, or suspend or terminate your Account or your access to any Service, and the same for any associated Account or Sponsored Account, at any time for any reason... If found to be in apparent violation of [sanctions] restrictions, your account could be terminated and your funds could be held for an indefinite period of time.

Cash App Privacy Notice (https://cash.app/us/en/legal/privacy): Effective June 8, 2026. Block, Inc. is the fintech behind Cash App (cash.app) and Square (squareup.com); research focused on Cash App's consumer documents as the largest consumer surface. 2026 regulatory context: Block is operating under a multi-state consent order (Illinois AG filing July 8, 2026) requiring live 24/7 customer support, and settled a $12.5M Washington spam-text class action (Bottoms v. Block, 2025) over referral texts; these are real events from search-result sources, not terms clauses, and were not scored but noted as context. Some Cash App features (e.g., Cash App Mobile phone plans via Gigs Wireless, Cash App Green overdraft) have additional product terms not fully examined.
