Where Workday, Inc. does well

  • Renewals 1 of 20. Few problems found.
  • Workday's business model is subscription software, and it states plainly 'we do not sell user data or monetize it by selling advertising. Instead, we sell subscriptions to our services.' Unlike many forced-arbitration clauses, consumers can opt out of binding arbitration within 30 days via legal@workday.com and can even reject future changes to the arbitration section.
  • The privacy statement grants access, correction, deletion, and portability rights, says data is deleted or anonymized when there is no ongoing legitimate business need, and explicitly notes mobile-app data is not used for targeted advertising.
  • It also commits to informing merger buyers that acquired personal data must be used only for the purposes disclosed in the statement.

Just by using workday.com you give up your right to sue Workday in court, have a jury, or join a class action — every dispute goes to private individual arbitration before the AAA instead.

The fine print

6 clauses and findings from the draft archive, dated 1 October 2026. The plain English comes first; the small print is the company's own words. None of these has been checked yet.

  1. Just by using workday.com you give up your right to sue Workday in court, have a jury, or join a class action — every dispute goes to private individual arbitration before the AAA instead.

ARBITRATION PRECLUDES YOU AND WORKDAY FROM SUING IN COURT OR HAVING A JURY TRIAL. YOU AND WORKDAY AGREE THAT ARBITRATION WILL BE SOLELY ON AN INDIVIDUAL BASIS AND NOT AS A CLASS ARBITRATION, CLASS (GROUP) ACTION, OR ANY OTHER KIND OF REPRESENTATIVE PROCEEDING. WORKDAY AND YOU ARE EACH WAIVING THE RIGHT TO TRIAL BY A JURY.

    Terms of Service, Section 16

  2. Workday can rewrite the terms unilaterally at any time, effective immediately, with no email or pop-up warning — a changed date at the top counts as notice, and your continued browsing counts as agreement.

We may also make changes to these Terms from time to time. The "Last Updated" legend above indicates when these Terms were last changed. If we make future changes, the updating of the date at the top of these Terms will serve as notice to you of the changes. It is your responsibility to check these Terms periodically for changes. Unless we say otherwise, the amended Terms will be effective immediately, and your continued use of our Sites will confirm your acceptance of the changes.

  3. Anything you post on the Workday Community — text, photos, even your name and face — becomes theirs to use, modify, and re-license forever, for free, with no way to take it back.

You grant Workday and its subsidiaries and affiliates a perpetual, irrevocable, non-exclusive, royalty-free, worldwide, fully paid, and sublicensable (through multiple tiers) licence to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, publicly or otherwise perform and display, and exploit your User Content and any name, username or likeness provided in connection with your User Content in all media formats and channels now known or later developed without compensation to you or any third party.

Terms of Service, Supplemental Terms — Workday Community Terms

  4. You have only one year to bring any claim under these terms — shorter than the multi-year windows many laws allow — and after that your claim is permanently dead.

To the extent permitted by law, any Claim or dispute by you or Workday arising out of or related to these Terms or the Sites, or any aspect of the relationship between you and Workday as relates to your use of the Sites, in each case other than IP Claims, must be filed within one year after such Claim or dispute arose; otherwise, the claim is permanently barred, which means that you and Workday will not have the right to assert the claim.

    Terms of Service, Section 16(e)

  5. On the marketing site, Workday lets ad companies track you across the web for targeted ads — a practice it admits some privacy laws call a 'sale' of your data — and you have to hunt down a footer link to opt out.

When you visit our website, we may enable third parties to use cookies and other trackers to show you ads on third-party websites that are more relevant to you. Under some data protection laws, our disclosure of this information with third parties through cookies and other trackers for targeted advertising may be considered a "sale" or "share" of personal information. ... click "Cookie Preferences" (link located in the footer of our Website) to set your preferences and opt-out of the sale or sharing (for targeted advertising) of your data.

    Privacy Statement (current web edition)

  6. No matter what goes wrong on workday.com, the most you can recover from Workday under these terms is one hundred dollars.

The total liability of the Workday Parties for any claim arising out of or relating to these Terms or our Sites, regardless of the form of the action, is limited to $100.

How these were found

Documents read via browser_open from the official workday.com domain on Oct 1, 2026: (1) 'Terms of Service' page (en-se edition), Last Updated 13/08/2026 — these Terms cover the workday.com websites/Community/APIs only, NOT the enterprise SaaS customer contracts which are negotiated separately; (2) 'Workday Privacy Statement' PDF, Effective 03/23/2023 (en-us). The targeted-advertising 'sale/share' clause was read in the current web Privacy Statement via workday.com search-result snippets (privacy.html editions) rather than the 2023 PDF. Cookie Notice advertising-cookie details came from workday.com search snippets only. The site's age-16 minimum, Paid Offering Terms, and Global Addendum were reviewed briefly. No mirrors used; all sources are official Workday pages. Score is editorial judgment and was kept modest per the B2B SaaS context.
