Where Waste Management does well

  • 30-day opt-out of arbitration/class waiver via a simple email to arbitrationoptout@wm.com, and opting out does not affect your ability to get service — a real escape hatch many peers lack.
  • WM covers arbitration costs above a $250 filing fee for customer-initiated arbitration, and you never owe WM's fees if you lose — so arbitration isn't priced to deter claims.
  • Annual prepaid plans do get refunded for unused days on cancellation, and billing-period-by-period termination is 'without penalty.'
  • The privacy policy states 'We do not sell, lease, or license your personal data to third parties for monetary compensation,' honors Global Privacy Control signals, and publishes opt-out phone/web-form paths for state-law sale/sharing opt-outs.

Every dispute with WM — billing, service, marketing, even how they handle your personal data — must go to a private arbitrator instead of a judge, and WM defines 'claim' as broadly as possible to keep disputes out of court.

The fine print

6 clauses and findings from the draft archive, dated 1 October 2026. The plain English comes first; the small print is the company's own words. None of these has been checked yet.

  1. Every dispute with WM — billing, service, marketing, even how they handle your personal data — must go to a private arbitrator instead of a judge, and WM defines 'claim' as broadly as possible to keep disputes out of court.

If the parties do not reach an agreed upon resolution pursuant to the process outlined in Section 10(B), above, all the parties agree that any and all Claims will be resolved via binding arbitration, as set forth herein. ... 'Claim' has the broadest possible meaning, and includes initial claims, counterclaims, cross-claims and third-party claims.

  2. You cannot join or lead a class action against WM, individually or through arbitration, and you can't bring a representative suit on behalf of other customers.

Customer and WM each further agree that: any arbitration shall be conducted in their respective individual capacities only and not as a class action or other representative action; each expressly waive their rights to file a class action or seek relief on a class basis; neither Customer nor WM may act as a private attorney general in court or in arbitration.

  3. WM can raise your price every billing period, and simply paying a bill that contains a change counts as agreeing to that change — silence or continued use is consent.

WM may increase the price for subscription residential collection services from billing period to billing period, and Customers may terminate or choose to not renew services after each billing period without penalty. ... Changes in the frequency of collection, collection schedule, number, capacity and/or type of Equipment, and any changes to the Charges payable under these terms may be agreed to orally, in writing, by payment of the invoice reflecting such changes, or by the actions and practices of the parties.

  4. You pay in advance, and if you cancel mid-quarter you get no refund — only annual prepay gets unused days back. Paying the invoice is what locks you into the whole billing period.

By accepting Service, Customer agrees to these Terms and Conditions and to continue the Service for the billing period. ... If Services are suspended or terminated by WM due to Customer's breach of these terms or if Customer terminates the Services, Customer understands and agrees that WM will not refund, or pro-rate or return any amounts previously paid by Customer to WM in advance for monthly or quarterly pre-paid services, unless such refund is required by law or regulation.

  5. WM's website can replay your browsing session — every mouse movement and text you type on their site can be recorded by third-party tracking vendors.

We and our service providers may use any number of tools to collect information about you ... including some that may provide 'session replay' services ... These Cookies record your interactions with our Site, including mouse movements, text, and other information, associated with your visit to our Site.

    Privacy Policy

  6. By signing up you pre-consent to robocalls and auto-dialed messages to your cell about your account — buried in the residential service terms rather than presented as a separate opt-in.

Customer understands and agrees that by providing Customer's phone number(s), email, and home address in connection with these terms, Customer authorizes WM and its agents to contact Customer regarding this account with an artificial or prerecorded message or using auto-dialing equipment at the provided phone number(s), including cell phone numbers if provided, or email, and home address.

How these were found

Documents read in full on Oct 1, 2026: (1) WM Terms of Use at wm.com/us/en/terms, last updated January 1, 2023; (2) Terms and Conditions for Residential Subscription Services at wm.com/OMR (no version date shown on page; read in full, 286 lines); (3) WM Privacy Policy at wm.com/us/en/privacy (no last-updated date shown; read in full, 448 lines). Commercial-agreement arbitration asymmetry (Excluded Claims carve-out) was verified only via search snippets from wm.com/ca/en/disputes and mirrored customer DocuSign agreements (SparkPlatform/Diligent mirrors), not from a wm.com-hosted US commercial agreement page, so it is cited as a secondary point. The up-to-$75 cart removal charge figure comes from WM invoice text reproduced in a customer complaint, not from the OMR page itself (OMR confirms a removal charge 'will apply upon cancellation' without naming the amount).
