Where U.S. Bancorp does well

  • Small claims court carve-out: either party may take a qualifying claim to small claims court instead of arbitration at any time, even after arbitration is filed.
  • Military Lending Act: the cardmember arbitration provision explicitly does not apply to covered borrowers.
  • Opt-outs exist for three sharing categories (nonaffiliate marketing, joint marketing, affiliate creditworthiness sharing) via 800-370-8580 or usbank.com/privacy, and new customers get a 30-day delay before sharing begins.
  • California, North Dakota, and Vermont residents get enhanced sharing restrictions under state law.
  • Arbitration hearings are held in the federal judicial district including the customer's home address, and either party may request a reasoned written decision.
  • Error resolution includes provisional credit within 10 business days for longer investigations.

You can never join a class-action lawsuit against U.S.

The fine print

7 clauses and findings from the draft archive, dated 1 October 2026. The plain English comes first; the small print is the company's own words. None of these has been checked yet.

  1. You can never join a class-action lawsuit against U.S. Bank, and the bank can force any dispute — even one about advertising that happened before you opened your account, or about claims arising after you closed it — into private arbitration unilaterally, with no opt-out offered anywhere in the agreement.

Agreement to Arbitrate: Either you or we may elect in writing, and without the consent of the other, to arbitrate all Claims covered by this provision... Claims include Claims that arose before we entered into this account Agreement (such as Claims related to advertising) and after termination of this account Agreement... You and we agree that any Claim brought in arbitration will be brought on an individual basis only. You and we agree that no class action, private attorney general, or other representative claims may be pursued in arbitration, nor may such action be pursued in court if either you or we elect arbitration.

  2. The forced arbitration and class-action waiver reaches beyond your bank account: just using online banking or the mobile app extends the same no-lawsuit terms to your digital activity.

You agree that any arbitration/class action waiver provision described within your underlying account/relationship agreement also applies to any controversies or disputes arising out of or relating to your use of Digital Services and this TOU.

Digital Services Agreement (Terms of Use)

  3. U.S. Bank shares your personal information with outside companies so they can market to you — and if you hold a store/partner credit card, they share your info with that retail partner for marketing with no way for you to stop it.

For nonaffiliates to market to you — Yes / Yes [we share, and you can limit]. *Please keep in mind that, as permitted by applicable law, if you have a private label credit card account with us, we share information about you with our financial or retail partners in connection with maintaining and servicing your account, including for that financial or retail partner to market to you. Federal law does not give you the right to limit this sharing.

  4. Closing your accounts doesn't stop the sharing: U.S. Bank keeps sharing your personal data with affiliates, marketers, and others exactly as before, forever.

When you are no longer our customer, we continue to share your information as described in this notice.

  5. The bank can rewrite any rule — fees, terms, anything — and your only choice is to accept it: simply keeping your account open after the change takes effect counts as agreeing to it.

We may change any term of this Agreement or add a new one as long as it does not violate applicable law... If we notify you that the terms of your account have changed, and you continue to have your account after the effective date of the change, you have agreed to the new terms.

  6. If you owe any U.S. Bank affiliate anything, the bank can seize money from any of your accounts — even accounts with other U.S. Bancorp companies — without asking you or giving advance notice.

You grant to us and our affiliates, a security interest in all your accounts with us, and all property in your accounts (including money, certificates of deposit, securities and other investment property, financial assets, etc.), to secure any amount you owe us or our divisions, department, and affiliates, now or in the future... You agree that we shall comply with any and all orders, notices, requests and instructions originated by us or any of our affiliates directing disposition of the funds in your account without any further consent from you.

Your Deposit Account Agreement & Dual Disclosure (Effective Aug 10, 2026)

  7. You can't close your account just by emptying it — the account stays open and fees can keep piling up until you formally notify the bank.

If you intend to close your account with us, you should tell us; simply transferring all the money in your account and reducing your account balance to $0.00 is insufficient notice and may result in additional fees charged to your account.
