Where Rollins, Inc. does well

  • AutoPay is explicitly optional ('entirely optional and is not required to obtain or maintain your account'), with a defined cancellation path (call 1-800-800-ORKIN one day before the due date).
  • The Privacy Policy is unusually candid — it names the 'sale'/'sharing' of data to ad-tech firms rather than hiding it, honors Global Privacy Control opt-out signals, and expressly excludes your mobile opt-in data and phone number from affiliate marketing sharing.
  • The Terms include a small-claims carve-out (you can still bring qualifying claims in small claims court).
  • Text-message and automated-call marketing opt-ins are explicitly 'not a condition of purchasing' goods or services, and data known to belong to children under 13 is removed.

Just visiting orkin.com binds you to arbitration for any dispute, past or future.

The fine print

12 clauses and findings from the draft archive, dated 1 October 2026. The plain English comes first; the small print is the company's own words.

  1. Just visiting orkin.com binds you to arbitration for any dispute, past or future. You give up your jury trial, and the proceedings themselves must be kept secret — you can't publicly discuss your case against them.

You and we agree that, except as set forth below, we will resolve any controversies, claims, counterclaims or other disputes between you and us or you and our agent ('Claim') through final and binding arbitration, instead of through court proceedings... You and we hereby waive any right to a jury trial of any Claim... You and we agree that the arbitration proceedings will be kept confidential and that the existence of the proceeding and any element of it will not be disclosed beyond the arbitration proceedings.

    Orkin Terms of Use §20

  2. No class actions, no consolidated claims. Before you can even file, you must send a written notice to web-term@rollins.com and take a phone call with Orkin yourself, then wait 60 days — skipping this step lets a court block your arbitration.

Neither you nor we may act as a class representative or private attorney general, nor participate as a member of a class of claimants, with respect to any Claim... Compliance with and completing this informal dispute resolution process is a condition precedent to filing an arbitration.

    Orkin Terms of Use §§19–20

  3. An anti-mass-arbitration mechanism: if many customers file together, their claims get slow-walked through staged 'bellwether' rounds (10, then 40, then 100 at a time) — your case waits until it's selected, deliberately throttling collective action.

If 25 or more similar claims are asserted against us by the same or coordinated counsel or are otherwise coordinated... you understand and agree that the resolution of your dispute might be delayed... Counsel for the claimants and our counsel shall each select 10 cases (per side) to proceed first in individual arbitration proceedings as part of a bellwether process.

Orkin Terms of Use §20, 'Mass Arbitration Process Requirements'

  4. Orkin hands your data to ad/analytics companies that may pass it on further and use it for their own marketing or to build profiles — and this is stated as a normal feature, not a restriction.

To Social Networks and Platforms as well as Ad, Analytics, and Data Providers so that they may provide services to us. They may also disclose your information to other third parties and use your information for their own business and commercial purposes such as for marketing or advertising or to create datasets, analyses and inferences.

Orkin Privacy Policy ('How We Disclose Personal Information')

  5. Orkin admits it 'sells' or 'shares' your identifiers, location data, browsing history and behavioral inferences to ad-tech firms — candid, but the pipeline itself is expansive.

We do not sell personal information in exchange for money. However, we do use cookies, pixels, and similar online tracking technologies which may be a 'sale' of personal information or a 'sharing' of personal information for targeted or cross-context behavioral advertising... In the 12 months preceding the last updated date above, we have 'sold' to or 'shared' with Ad, Analytics, and Data Providers the following categories of personal information: identifiers, commercial information, geolocation data, internet or electronic usage data, and inferences.

  6. Your contact and service details flow across the whole Rollins brand empire (dozens of pest brands) so each affiliate can market to you directly — an opt-out is never mentioned.

We may also share certain categories of personal information, such as contact information and service information, with Orkin Affiliates so they may contact you directly regarding their products and services... 'Orkin Affiliates' means the corporate parent, subsidiaries, and affiliated companies under common ownership or control with Orkin, LLC, including but not limited to other pest control brands within the Rollins, Inc. family of companies.

  7. Orkin can rewrite the terms whenever it wants, for any reason, without telling you — and simply visiting the site again counts as agreeing.

We, may, at any time, for any reason and without notice, make changes to (i) this Website, including its look, feel, format, and content, as well as (ii) the products and/or services as described in this Website... By your continuing use of the Website after changes are posted, you will be deemed to have accepted such changes.

    Orkin Terms of Use §2

  8. After 3 years, Orkin can raise your annual termite-service renewal by 10%+ per year (whichever is higher vs CPI) — and 'bank' skipped increases to stack them all onto you later in one big cumulative jump.

Thereafter, Orkin shall have the right to increase the annual renewal fee each year by an amount not to exceed the consumer price index or by an amount not to exceed ten percent (10%), whichever is greater. If Orkin does not increase the Annual Renewal Payment in any one or more years, at any subsequent increase Orkin may cumulatively include any amount it would have been permitted to increase in that prior year or period of years.

  9. Orkin can kill your service contract without any notice, while your own obligations are narrowly pinned down (a 3-business-day cancellation window after signing).

TERMINATION BY ORKIN: Orkin may terminate this Agreement, without notice, if the obligations set forth in this Agreement are not met by Customer, or in the event of a change in state or federal law or regulation that materially affects Orkin's obligations under this Agreement.

  10. Enrolled in AutoPay? If your card is replaced or expires, Orkin pulls your new card details from the card network itself and keeps charging — late bills trigger late fees on top.

You agree that we may obtain updated information from card networks, issuers or other third-party sources... IF YOU PAY YOUR BILL AFTER IT IS DUE, YOUR ACCOUNT MAY INCUR LATE FEES AS SET FORTH IN YOUR CONTRACT AND/OR IN THESE TERMS AND CONDITIONS.

Orkin Terms of Use §8 (AutoPay)

  11. Any content you upload, submit, or store through orkin.com can be used, modified, and distributed by Orkin forever — the license survives you leaving.

This license is ... perpetual, meaning that our rights under this license continue even after you stop using the Website.

Orkin Terms of Use §5 (User Content)

  12. No fixed deletion timeline — your data (including sensitive data like SSN, which they collect) is kept on an open-ended 'as long as we need it' basis.

We will retain and use your information for as long as we need it to provide you services or products, or as long as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

How these were found

Terms of Use fetched live from orkin.com on Oct 1, 2026 — shows 'EFFECTIVE DATE: APRIL 2024 / TERMS LAST UPDATED: APRIL 2024'. Privacy Policy fetched live same day — 'Effective Date: January 1, 2020 / Last Updated: March 31, 2026'. The termite service agreement clauses (renewal increases, termination without notice, mediation/arbitration) come from a 2018 Orkin Drywood Termite Retreatment Fumigation Agreement mirrored on scribd.com — it was the only publicly readable service-agreement form; the current general pest-control plan form is not published online, so pricing/auto-renew of monthly plans could not be verified directly. rollins.com corporate terms were not separately reviewed; independently owned Orkin franchise locations operate under their own privacy practices (noted in the Privacy Policy). The arbitration pre-dispute steps (written notice + personal phone call + 60-day wait) were confirmed in the live Terms §§19–20.

These notes come from the original draft and are not independent verification.
