Where EchoStar does well

  • Real arbitration opt-out: RCA §12(H) lets you reject mandatory arbitration by mailing written notice within 30 days of activation (downloadable opt-out form on dish.com/service-agreements), and the agreement states opting out 'will have no adverse effect on your relationship with DISH or DISH's delivery of Service(s) to you.'
  • DISH pays arbitration costs for smaller claims: if you initiate arbitration seeking under $75,000, DISH reimburses your filing fee and directly pays AAA case-management and arbitrator fees.
  • Plan agreements include a 3-day right to rescind with a cancellation form (dish.com/service-agreements).
  • The Infinity Sales Group privacy policy honors Global Privacy Control opt-out signals, offers a Do Not Sell/Share page and phone line (1-833-933-2437), and does not knowingly sell or share data of children under 16.

You cannot sue DISH in court over any dispute — everything must go to private arbitration instead.

The fine print

6 clauses and findings from the draft archive, dated 1 October 2026. The plain English comes first; the small print is the company's own words. None of these has been checked yet.

  1. You cannot sue DISH in court over any dispute — everything must go to private arbitration instead. RCA §12(G) adds a class-action waiver: 'NEITHER YOU NOR DISH SHALL BE ENTITLED TO JOIN OR CONSOLIDATE CLAIMS' as a class or in any representative capacity. Opt-out exists but is mail-only and buried (see fair points).

You and DISH agree that any and all disputes arising out of, relating to or concerning this Agreement (including, without limitation, the RCA), your DISH service and/or any other aspect of your relationship with DISH will be resolved through mandatory and binding arbitration pursuant to the terms and conditions set forth in the RCA.

Digital Home Advantage Plan Agreement (5.7.26)

  2. A 24-month lock-in with up to $480 in early-termination fees. Even if you move somewhere DISH can't serve you, you still owe the fee — and DISH can pull it from your card on file automatically. Your promotional 'price lock' is one-sided: your price is locked, your exit isn't.

If prior to the end of your term commitment: (A) your DISH service is disconnected for ANY REASON (for example, and without limitation, if you cancel your DISH service because you move to a location where you cannot receive your DISH service); or (B) you downgrade your programming below a Required Minimum Programming Package... you agree to pay, and DISH will automatically charge, an early termination fee to your DISH account or your Qualifying Card... at DISH's option. Prorated by multiplying $20 by the number of months remaining in your term commitment.

  3. DISH can rewrite the contract whenever it wants, without telling you in advance, and DISH itself is the final judge of what any ambiguous wording means. You agreed in advance that they grade their own homework.

DISH may, however, change this Agreement without notice at any time and from time to time... In the event of any ambiguity between this Agreement and your applicable Promotion Agreement(s), then DISH shall have the sole and exclusive authority to interpret and/or make a final determination concerning any issue arising from such ambiguity.

Residential Customer Agreement (DISH Network L.L.C.) — (RCA; change-without-notice and sole-interpretation clauses verified from the RCA text via support.dish.com snippets)

  4. Prices and fees can change at any time, even mid-contract, with no notice. Channels can disappear from your package mid-contract and you get no refund — you still owe the full term. The '2-year price guarantee' marketing covers DISH's side, not yours.

DISH has the right, without notice at any time and from time to time unless otherwise prohibited by law, (including, without limitation, during any term commitment to which you have agreed), to add, delete, rearrange, alter, change and/or eliminate: (A) any and all prices, fees and/or charges... Agreements with programming suppliers may expire during the term of your Agreement with DISH. If that occurs, some programming in your DISH services may not be available for some or all of the remaining term of your agreement with DISH, and you will not be entitled to any refund, credit, or other compensation.

  5. The company selling you DISH on dish.com's own domain openly sells your personal data — including Social Security numbers, driver's license numbers, call recordings, geolocation, and inferred characteristics like 'psychological trends' and 'predispositions' — to outside marketing clients. Separately, DISH Network L.L.C.'s own privacy notice admits it sold identifiers, commercial info, internet activity, and inferences to data brokers, ad networks, telecom companies, and social networks in the prior 12 months.

We may also sell or share (for targeted or cross-context behavioral advertising), and have sold or shared in the past twelve months, Personal Information with third parties who are not our Service Providers ('Third Parties')... To enable our clients to market and provide their goods and services. Categories of Personal Information Sold or Shared: Identifiers; Commercial Information; Audio, Electronic, Visual, Thermal, Olfactory, or Similar Information; Characteristics of Protected Classifications; Internet or Other Electronic Network Activity Information; Geolocation (approximate); Personal Information Described in Cal. Civ. Code § 1798.80(e); Sensitive Personal Information.

  6. Cancel your service and they keep everything — your SSN, payment details, call recordings — for roughly a decade after you leave. Deletion requests exist on paper, but the default is a 10-year data afterlife.

Generally, we retain Personal Information for approximately ten (10) years after our relationship with you has ended, but the term for which we retain your Personal Information may be longer or shorter.

How these were found

EchoStar Corporation (echostar.com) has no consumer-facing terms; all consumer terms live on dish.com under DISH Network L.L.C. (EchoStar subsidiary, merger completed 2024). Documents relied on: (1) Digital Home Advantage Plan Agreement dated 5.7.26, official dish.com PDF, read in full via search-result text; (2) DISH Residential Customer Agreement (RCA) — change-without-notice, sole-interpretation, and class-action-waiver clauses verified via search snippets from support.dish.com RCA PDF and the RCA text mirrored in the DISH receiver user guide (usermanual.wiki); the RCA PDF on dish.com/legal was not directly fetchable, so §12(G)/(H) wording is confirmed from the user-guide mirror only; (3) Privacy Policy - DISH Network at https://dish.com/isg/privacy-policy/ (Last Updated 2/03/2026), read directly via browser — note this official dish.com page is authored by Infinity Sales Group, LLC, an authorized DISH sales agent, not DISH Network L.L.C. itself, which is itself an eyebrow-raiser; (4) DISH Network L.L.C. Privacy Notice Oct 2022 (my.dish.com PDF) for the data-broker sale admission. Arbitration opt-out form exists on dish.com/service-agreements but was not individually opened. Booster/slingtv.com terms were not reviewed — DISH satellite is the primary consumer contract.
