Where Republic Services does well

  • Arbitration happens in the customer's own state of residence under AAA Consumer Arbitration Rules (residential terms), with a small-claims-court escape hatch.
  • The privacy policy is recent (May 2026), does NOT sell data for monetary consideration, honors Global Privacy Control opt-outs, and offers a 'Your Privacy Choices' opt-out page plus access/deletion/correction request rights.
  • Residential customers get a 3-day right to rescind the initial order with a refund (less services rendered) and can cancel at any time with no early-termination fee.
  • The fee disclosures are at least transparent that the ERF/FRF/ADMIN charges are 'not a tax, surcharge or fee mandated by or remitted to any governmental agency.'

You cannot sue Republic in court or join a class action — almost every dispute must go through binding arbitration.

The fine print

6 clauses and findings from the draft archive, dated 1 October 2026. The plain English comes first; the small print is the company's own words. None of these has been checked yet.

  1. You cannot sue Republic in court or join a class action — almost every dispute must go through binding arbitration. Notably, 'claims relating to non-payment' are carved out, meaning Republic can still take YOU to court to collect unpaid bills while you cannot take it to court for anything else.

"Except for claims relating to non-payment, any and all other disputes or claims between you and Republic Services, Inc. or the operating subsidiary providing your service ... will be submitted to mandatory, binding arbitration before the American Arbitration Association (AAA) in the state of your residence before one arbitrator ... no party will have the right to participate in a class action in court or in arbitration or join or consolidate a Claim with claims of any other person."

  2. The arbitration deal is one-sided: Republic reserves the right to haul you into court over any payment it says you owe, but your own claims must go to arbitration under the Commercial Arbitration Rules (the harsher commercial track, not consumer rules).

"The following claims constitute 'Excluded Claims' and are not subject to mandatory arbitration: ... (iii) Republic Services' claim against Customer for collection or payment of charges, damages, or any other amounts due or payable by Customer for the services."

    Service Terms for Temporary Services

  3. Republic can raise your prices or change contract terms on its own — simply printing the change on your next bill counts as 'notice,' and the act of paying the bill (or just continuing service) counts as your agreement. There is no signed consent step.

"The operating subsidiary providing your service reserves the right to change or increase your rates, charges and fees at its discretion with advanced notice to you, which notice will be in the form of a change on your invoice or these service terms. By paying an invoice or continuing services after a rate, charge, term or condition, or fee change, you are agreeing to such change."

  4. Republic piles on fee-on-fee surcharges — an 18% Environmental Recovery Fee, a fluctuating Fuel Recovery Fee, and a $5.95-per-invoice Administrative Fee — each explicitly described as NOT a government tax yet named like one, and each openly includes built-in profit margin ('an acceptable operating margin') on top of the underlying service price. The ADMIN fee can change at any time at Republic's discretion.

"The Environmental Recovery Fee ('ERF') is ... a set percentage of all invoice charges, except taxes. It is not a tax, surcharge or fee mandated by or remitted to any governmental or regulatory agency ... and it includes an amount designed to achieve an acceptable operating margin. The current ERF is 18%."

  5. There is no online cancel button — you must call to cancel, you have to give advance notice, and you still pay through the end of the month no matter when in the month you cancel.

"You may also cancel your services at any other time by calling the telephone number on the front of your invoice ... Please note that advanced notice is required to cancel services, so your cancellation will be effective as of the last day of the month in which you cancel. For example, if you cancel service on March 15, your operating subsidiary will process your cancellation to be effective on March 30."

  6. Republic lets ad networks and social-media companies harvest your browsing data for targeted ads — activity it admits may legally count as a 'sale' of your personal info. Merely continuing to browse the site counts as your consent, and it ignores browser Do-Not-Track signals.

"We may disclose your personal information by allowing online advertising services and social networks to collect personal information via automated technologies on our Online Services for targeted advertising purposes ... Depending on your state of residence, this activity may be considered a sale of personal information ... Our Online Services are not designed to respond to 'do not track' signals from browsers." How these were found

Documents read directly from republicservices.com via page fetch on Oct 1, 2026 (no mirrors needed; site did not block access). Privacy Policy showed 'Last Updated: May 2026'. Residential Service Terms and Service Terms for Temporary Services showed no version date on the page (the Temporary page's arbitration text matches the live text fetched). Terms of Use fetched live; its search-index metadata suggested an older revision but the live text was read directly. Scope note: the Residential terms apply to 'Invoice-to-Invoice Customers' (those without a signed service agreement); temporary-service terms apply to temporary container customers without signed agreements. Customers with signed contracts may have different terms. Scoring is editorial judgment; quotes and paraphrases are from the actual documents.
