Where Procter & Gamble does well

  • Renewals 2 of 20. Few problems found.
  • The current U.S. terms dropped the old clause letting P&G force any dispute into binding arbitration at its sole discretion; formal disputes now go to real state/federal courts (Hamilton County, Ohio), and a jury/class-action waiver remains but arbitration compulsion is gone.
  • P&G explicitly does NOT sell/share biometric information, location data, audiovisual information, financial account data, or government-issued IDs.
  • Sensitive inferences are deleted within a maximum of 24 hours after collection, and consent is required for processing sensitive personal data beyond internal business purposes, with a right to revoke.
  • The policy provides a Data Preference Center with opt-out rights for Sale/Sharing and targeted advertising, authorized-agent requests, appeal of denials, and publishes annual consumer-request metrics — more transparent than many CPG peers.

Simply using P&G's websites means you give up your right to sue alongside other consumers in a class action or to get a jury trial.

The fine print

6 clauses and findings from the draft archive, dated 1 October 2026. The plain English comes first; the small print is the company's own words. None of these has been checked yet.

  1. Simply using P&G's websites means you give up your right to sue alongside other consumers in a class action or to get a jury trial. Every dispute must be brought by you alone, for you alone.

YOU AGREE THAT BY ENTERING INTO THESE TERMS YOU ARE WAIVING THE RIGHT TO TRIAL BY JURY OR TO PARTICIPATE IN A CLASS ACTION AND THAT YOU MAY BRING CLAIMS AGAINST P&G (INCLUDING ANY P&G BRAND) ONLY IN YOUR INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. ANY LITIGATION OR OTHER ACTION OR PROCEEDING WILL TAKE PLACE ON AN INDIVIDUAL BASIS; CLASS ACTIONS ARE NOT PERMITTED.

  2. Before you can even start a lawsuit, you must mail a personally signed letter with full contact details to a Columbus, Ohio address and wait up to 60 days for 'good faith' negotiations — and any claim expires after just one year, far shorter than most state statutes of limitations.

This informal dispute resolution process is a condition precedent and prerequisite to commencing legal action against P&G (including any P&G brand). This informal dispute resolution process requires that you send a written description of the Dispute, including the nature and basis of the claim and the nature and basis of the specific relief sought (with a calculation for it), to the other party that also includes contact information (name, address, email, phone number, and, if applicable, account number, purchase order numbers, and transaction confirmation codes)... You must personally sign the Notice (along with an attorney if you are represented) that is mailed to us. ... Any cause of action or claim you may have directly or indirectly arising out of or relating to the Terms, a P&G Website, or your purchase or use of a product, good, or service from P&G must be commenced within one (1) year after the claim or cause of action arises.

  3. P&G can rewrite its terms whenever it wants with no direct notice to you — no email, no banner. The only 'notice' is an updated page you have to discover yourself, and merely visiting the site again counts as agreeing to the new terms.

From time to time, P&G may change these Terms. When we do, changes will be published on this page and the 'Last Updated' line above will be updated. By continuing to use our Sites, you agree to these updated Terms. ... We reserve the right to amend this U.S. State Privacy Notice at our discretion and at any time.

  4. P&G's own U.S. privacy notice admits that your identifiers, contact details, personal records, demographics and psychographics, health-related information, purchase/commercial data, internet and app usage data, and inferred profiles count as 'sold or shared' to outside digital businesses and retail partners — i.e., fed into the advertising ecosystem.

  5. Health-adjacent purchase data used to predict which P&G products you'd buy can be sold/shared to third parties wherever local law doesn't forbid it. And your deletion request can be refused when P&G decides keeping the data serves its own 'internal business purposes'.

Personal Data Concerning a Consumer's Health... related to demographic or purchase data that may help us determine which products you may be interested in. ... Sale/Sharing: Third-Party Digital Businesses and Retail Partners (in jurisdictions where the law permits). ... In addition, you have the right to request that we delete certain personal information we have collected from you. Please understand that P&G cannot delete personal data in those situations where our retention is required for our own internal business purposes or otherwise permitted by relevant U.S. Privacy Laws.

  6. A product review you write becomes P&G's forever: they can repost it on third-party sites, edit it, and use it in ads with no further payment or permission. And if a P&G site order harms you, their liability is capped at what you paid on the site — potentially just the price of a detergent bottle.

By submitting a R&R and agreeing to these Terms when you make your submission, you grant P&G, to the extent allowed under applicable law, a non-exclusive, worldwide, unlimited, perpetual, irrevocable, royalty-free, fully sublicensable and transferable right and license to use, monitor, review, reproduce, modify, adapt, publish (including to third-party websites as so-called 'syndicated' R&R), translate, create derivative works from, distribute, transmit, display, and perform your R&R in whole or in part, in any media, format or technology, online or offline, without any further notice or payment to or permission needed from you. ... If the foregoing limitation of liability is held to be unenforceable, the Providers' maximum liability to you shall not exceed the amount paid by you for the products or services you have ordered through the Site.

How these were found

All documents read directly from official P&G domains via browser fetch on 2026-10-01; no mirrors needed (privacypolicy.pg.com, termsandconditions.pg.com both reachable). The terms page footer reads 'Copyright 2024 P&G' and the fetched pages show no explicit 'Last Updated' line, so document vintage is uncertain — treat terms as the version currently live on 2026-10-01 (search cache of the current page is <1 hour old). An older cached version (639-day-old crawl) contained a discretionary binding-arbitration clause that the current version has replaced with the court-based formal dispute process; users who accepted the older terms may have been bound by the old arbitration clause for past claims. Promotional/loyalty Additional Terms (e.g., P&G Good Everyday, Pampers Club) were not reviewed — only the base site terms. Some quoted phrasing is condensed from rendered tables; the Pampers Club August 2025 devaluation report is press (thesun.co.uk), not an official document, and is not counted as a finding. pxg.com ('Your Privacy Choices') is a different company (parsons firearms) and was excluded.
