Where Nvidia does well

  • A 30-day arbitration opt-out exists for both the site terms and GFN — many peers offer none at all.
  • Nvidia honors Global Privacy Control signals: it 'detect[s] and respond[s] to Global Privacy Control signals by disabling all Performance, Personalization, and Advertising cookies' and auto-adjusts Privacy Center preferences.
  • Children's protections are above baseline: services are not targeted at under-13s, under-16 accounts are opted OUT of interest-based advertising by default, and minor users' data shared with GFN Alliance partners uses only a masked IP.
  • Some data types are explicitly never shared (content viewing history, email interaction data, birthdates), error/crash telemetry requires your consent, and the privacy policy keeps archived versions for comparison.
  • GFN offers non-auto-renewing Fixed-Term Day/Multi-Day Passes, free plans never bill, and membership price changes must be communicated by email before the next billing cycle.

You cannot sue Nvidia in court — disputes go to a private arbitrator picked under JAMS rules.

The fine print

6 clauses and findings from the draft archive, dated 1 October 2026. The plain English comes first; the small print is the company's own words. None of these has been checked yet.

  1. You cannot sue Nvidia in court — disputes go to a private arbitrator picked under JAMS rules. You also waive any right to a jury trial or class action. Notably, if 20+ people bring similar claims through the same lawyers, Nvidia funnels them into 'mass arbitration' where they are batched in groups of 100 with one arbitrator, one hearing, and one set of fees — a mechanism designed to make large-scale claims cheaper for the company to fight.

"For any Disputes that are not resolved informally or by the small claims court, you and NVIDIA each agree to resolve any such Dispute by binding arbitration before an arbitrator from Judicial Mediation and Arbitration Services ('JAMS')... To the extent that 20 or more demands for arbitration are filed against NVIDIA by individual claimants represented by either the same law firm or law firms acting in coordination, the JAMS Mass Arbitration Procedures and Guidelines will apply." Combined with: "All Disputes must be brought by a party in its individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding. You and NVIDIA agree to waive the right to a jury trial..."

GeForce NOW Terms of Use, §§14.2–14.3 — https://www.nvidia.com/en-au/geforce-now/terms-of-use/ (mirrored nearly verbatim in NVIDIA Terms of Service §§14.3–14.4

  2. An opt-out exists, but the bar is high: you have only 30 days from when you start using the service, you must send a physical letter to Santa Clara containing four exact items, and if you miss any item or the deadline the opt-out is invalid and you are stuck in arbitration. Realistically, almost no consumer will do this in time.

"You may opt-out of the foregoing jury trial, class action, arbitration, and collective or consolidated proceeding waiver provision by notifying NVIDIA in writing within 30 days of commencement of use of GFN... Such written notification must be sent by mail to NVIDIA Corporation, Attn: Legal, 2788 San Tomas Expressway, Santa Clara, California, 95051 and must include (1) your name, (2) your address, (3) the reference to GFN as the service to which the notice relates, and (4) a clear statement indicating that you do not wish to resolve disputes through arbitration and demonstrating compliance with the 30-day time limit to opt-out. Any opt-out notification received after the opt-out deadline or not including the required items noted in (1)-(4) in the preceding sentence will not be valid..."

GeForce NOW Terms of Use, §14.4 — https://www.nvidia.com/en-au/geforce-now/terms-of-use/ (site ToS §14.5 requires the same notice by BOTH email to legalnotices@nvidia.com and physical mail)

  3. Nvidia can rewrite the rules and reprice your membership whenever it wants, at its sole choice. For GFN and the website, the changes take effect the moment they are published and simply using the service counts as agreeing — no direct notice required. Membership price changes at least get an email before your next billing cycle.

GFN Terms of Use: "NVIDIA may make changes to these terms from time to time. NVIDIA will publish the new terms... The updated terms will be effective when published... You understand and agree that your express acceptance of the updated terms or use of GFN after the date of publication shall constitute your agreement to the updated terms of use." Site Terms of Service §16.1: "NVIDIA may revise these Terms at any time by updating this posting. You should visit this page from time to time to review the then-current Terms because they are binding on you, and any use of the Site constitutes acceptance..." Membership Terms: "NVIDIA reserves the right to adjust membership plan prices at any time at NVIDIA's choice. Price changes will take effect following email notice to you but no earlier than in your next billing cycle..."

  4. Paid GFN memberships auto-renew, payments are non-refundable, and if you miss a hard cutoff (11:59 PM US Central the day before renewal) you get charged anyway. Cancel your cloud storage plan and all your game saves are wiped at the end of the billing cycle with zero grace period and no way to recover them.

"A GFN paid reoccurring membership plan, will automatically renew for consecutive billing cycles unless you downgrade to a free membership plan... All payments for transactions are non-refundable and non-transferable except as expressly provided in these Membership Terms." And: "If you don't change your paid membership plan before 11:59pm US Central time on the day prior to your next billing cycle, membership fees will be charged, and billing will start and automatically renew..." And: "If you cancel your storage plan, all storage contents will be deleted at the end of the applicable billing cycle and cannot be recovered with no grace period."

  5. Nvidia openly admits its ad-data sharing 'may qualify as the sale of personal data.' It shares hashed versions of your name, email, phone, job title, zip, and social handles with Google for interest-based ads, passes your contact info to business partners and data-brokers like 6Sense and Leadspace, and on GFN hoovers up your device serial number, CPU/GPU specs, and which games you play — plus ad-viewing data and IP address on ad-supported plans, shared with advertising providers.

Privacy Policy: "NVIDIA does not use, sell, or share 'sensitive personal information' as defined by California law. However, our sharing of non-sensitive data with advertising providers may qualify as the sale of personal data or the sharing of personal data for purposes of targeted advertising." And: "we share hashed details about your identity with third-party ad providers such as Google... These hashed details may include your name, email, phone number, job title, organizational business affiliations, zip code, country, and social media handles." Also: "we share your request and contact information with business partners... with identity enrichment providers such as 6Sense or Leadspace." GFN Terms §11: NVIDIA processes "software version numbers, geographical region, internet speed, games played, session data and system information such as CPU, GPU, device serial number and system memory."

  6. Anything you post, upload, or submit as feedback to Nvidia — text, images, suggestions, ideas — becomes theirs to use forever, for any purpose including commercial ones, royalty-free. You also hand them a perpetual, irrevocable license to your feedback that they can sublicense to others. Send them a good product idea and you have no claim on it.

"Communications will be considered non-confidential and non-proprietary... NVIDIA and its designees will be free to copy, disclose, distribute, incorporate and otherwise use the Communications and all data, images, sounds, text, and other things embodied therein for any and all commercial or non-commercial purposes." (Site ToS §12.1; echoed for GFN feedback: "you hereby grant NVIDIA and its affiliates a perpetual, non-exclusive, worldwide, irrevocable license to use, reproduce, modify, license, sublicense (through multiple tiers of sublicensees), and distribute (through multiple tiers of distributors) it without the payment of any royalties or fees to you.")
