Where Marathon Petroleum does well
- Renewals 4 of 20. Few problems found.
- The corporate marathonpetroleum.com Terms of Use contain NO forced arbitration — site disputes are governed by Ohio law in Hancock County, Ohio courts, which is more consumer-favorable than most tech companies' blanket arbitration clauses (arbitration is limited to the optional rewards program).
- The corporate Privacy Policy (June 16,
- explicitly states 'We do not sell your personal information in exchange for monetary compensation' — clearer than the rewards policy's 'sale' admissions.
- There are no auto-renewing subscriptions or cancellation traps: no payment is required to earn rewards, rewards don't expire as long as you transact once per 365 days, and even an activated-but-unused voucher's value is returned to your account balance.
- The rewards program honors the Global Privacy Control (GPC) signal for browser-based opt-outs of sale/targeted advertising, and provides a self-service OneTrust webform plus a phone line for access/deletion/correction requests.
- The terms explicitly state you are NOT required to consent to marketing texts as a condition of purchasing fuel, and text opt-out is a simple STOP reply.
If you join the free fuel-rewards program (even just by typing your phone number at the pump, which counts as consent to the terms), you give up your right to sue Marathon in court, to a jury trial, and to join a class action.
The fine print
6 clauses and findings from the draft archive, dated 1 October 2026. The plain English comes first; the small print is the company's own words. None of these has been checked yet.

If you join the free fuel-rewards program (even just by typing your phone number at the pump, which counts as consent to the terms), you give up your right to sue Marathon in court, to a jury trial, and to join a class action. Disputes go to private arbitration in Marathon's hometown of Findlay, Ohio, decided by three arbitrators — an unusually costly setup — with no punitive damages allowed and the proceedings kept secret.
'You agree that the Marathon ARCO Rewards Program Terms include an arbitration provision and limitation of liability provision that governs any disputes between you and Marathon. These provisions will: Eliminate your right to a trial by jury; Substantially affect your rights, including preventing you from bringing, joining, or participating in class or consolidated proceedings; and Limit the recoverable damages...' — Section VIII: 'Any dispute or claim arising out of or relating to the Marathon ARCO Rewards Program Terms or Marathon ARCO Rewards (whether based in contract, tort, statute, fraud, misrepresentation, common law, or any other legal theory) will be resolved by binding arbitration.' Arbitrations are held in Findlay, Ohio before THREE arbitrators, are confidential, and the arbitrators 'shall have no authority to award punitive, consequential, or liquidated damages of any kind.' Class Action Waiver and Jury Waiver: proceedings 'will be conducted only on an individual basis and not in a class, consolidated, or representative action.'

What you buy at the pump and in-store — tied to your name, location, and device — can be handed to ad networks, brands, and marketing partners for targeted ads. Marathon itself says this sharing 'may be considered a sale' of your personal information under California privacy law. You have an opt-out right, but the Global Privacy Control signal only covers browser-based tracking, not offline or app-based sharing.
'We also may share personal information we collect through our Marathon ARCO Rewards program and at our program partners' fuel stations (such as purchase information) with certain advertising services, brands and other marketing partners in order to provide you with more tailored offers. The personal information shared with these third parties may include name and contact information, commercial information, device data, online activity information, location information, and interests and preferences. The sharing of personal information described above may be considered a "sale" or processing of personal information for targeted advertising under applicable law.' / California statement: 'We may sell or share for cross-context behavioral advertising purposes... the following categories of personal information about you to online and offline advertising services: Identifiers; Commercial Information; Online Activity; and Inferences.'

Marathon can rewrite the rules whenever it wants without telling you, and just by continuing to use the site or the rewards program you 'accept' the new terms. It can even shut down the whole rewards program and wipe out rewards you've already earned — no notice required.
'Marathon may cancel, modify, waive, or terminate Marathon ARCO Rewards at any time and for any reason, with or without notice, even though these changes may affect your ability to use any Marathon ARCO Rewards that you have already earned. Your continued participation in Marathon ARCO Rewards constitutes your acceptance of any changes to the Marathon ARCO Rewards Program Terms.' / Corporate Terms of Use: 'Marathon reserves the right to change the Terms of Use at any time without prior notice by amending this webpage. All updates will be posted to this webpage. Any changes to these Terms of Use will become effective upon posting of revised terms.'

Close your account and your earned fuel rewards vanish. Marathon can also kill your account instantly, for any reason, with no notice — and take the rewards with it. Your rewards die with you and can't be passed on, yet Marathon itself can sell or hand off the whole program (and your account) to someone else without telling you.
'You may terminate your Marathon ARCO Rewards account at any time... You will lose any outstanding Marathon ARCO Rewards or vouchers.' / 'Marathon may terminate your right to use Marathon ARCO Rewards immediately, without notice to you, in Marathon's sole discretion.' / 'You may not sell, assign, or transfer any portion of your Marathon ARCO Rewards... Your Marathon ARCO Rewards fully expire on your death or legal incapacitation. Marathon may sell, assign, or transfer Marathon ARCO Rewards and the Marathon ARCO Rewards Program Terms in whole or in part, at any time, and without notice to you.'

Handing over your phone number at the gas pump signs you up for recurring marketing texts — and Marathon claims this consent overrides your registration on federal or state Do-Not-Call lists. Even after you opt out, they reserve the right to text you account-access links. Note: enrollment at the pump alone (just typing your number) counts as consent to the full program terms.
'By providing your mobile phone number at the fuel pump, the point of sale system, or the time of enrollment in Marathon ARCO Rewards, you are agreeing to receive recurring informational and occasional marketing SMS/MMS messages from Marathon at the number you provided. Further, by providing your phone number and participating in Marathon ARCO Rewards, you are consenting to receive SMS/MMS messages notwithstanding any prior registration of your phone number on any internal, state, or federal "Do Not Call List."' / 'Please be advised that, notwithstanding any prior opt out request you make, you may need to receive a link via SMS/MMS message to enable you access to your Marathon ARCO Rewards account.'

Anything you send through the corporate website — a contact-form message, feedback, an idea — is treated as non-confidential and grants Marathon a permanent, worldwide, royalty-free license to use, copy, and profit from it, forever, with no payment to you. They even warn you upfront: don't send anything you consider private.
'You give Marathon, its affiliates, service providers and their respective licensees, successors and assigns an unrestricted, perpetual, irrevocable, worldwide, royalty-free, fully-transferable, assignable and sublicenseable right and license to use, copy, reproduce, display, publicly perform, adapt, create derivative works from, modify, transmit, disclose, and distribute such information in any form or medium or otherwise exploit all such content embodied therein.
