Where KKR & Co. does well

  • Arbitration 1 of 20. Few problems found.
  • Renewals 0 of 20. Nothing found.
  • No forced arbitration clause and no class-action waiver — rare for a financial-services firm.
  • The Non-EU notice says 'we will not sell this information or disclose it to third parties.' The California notice grants access, deletion, and correction rights (phone 888-712-0118 plus a request form) and says 'KKR does not sell or share for cross-context behavioral advertising purposes personal information about California consumers.' The Do Not Track section states KKR does not track customers across third-party sites for targeted advertising.
  • The terms also carry unusually candid investment disclaimers ('This Site does not provide specific investing advice') and disclose that portfolio companies and funds named on the site are shown for illustrative purposes only.

KKR can change the rules whenever it wants with zero notice — new terms take effect the moment they're posted, and you're told it's your job to re-read the terms every single time you visit the site.

The fine print

6 clauses and findings from the draft archive, dated 1 October 2026. The plain English comes first; the small print is the company's own words. None of these has been checked yet.

  1. KKR can change the rules whenever it wants with zero notice — new terms take effect the moment they're posted, and you're told it's your job to re-read the terms every single time you visit the site.

By visiting the Site, you agree to the Terms of Use and Privacy Policy, which may be updated at any time. We will post updates to the Terms of Use here and any such changes will be effective upon posting. You should consult the Terms of Use each time you visit the Site.

  2. Anything you submit through the site — forms, messages, ideas — automatically becomes non-confidential, and KKR can reuse, modify, or republish it for any purpose without paying you.

Any communication or content that you send to the Site is and will be deemed to be non-confidential as between you and us, and KKR will be free to use, modify, reproduce and distribute it for any purpose without compensation to you.

  3. After a page of specific disclosures, this catch-all sentence reserves the right to use your personal data in literally any way the law allows — one of the broadest data-use reservations in any privacy policy.

KKR, however, reserves the right to use any personally identifiable information in any manner permitted by law.

    Privacy Notice (Non-EU)

  4. Your data flows freely across KKR's affiliate network for marketing, research, and 'business development' (i.e., sales outreach), and if KKR is acquired, your information goes with it as a deal asset.

We may also store your personally identifiable information and share it with our affiliates. We may use or disclose this information for marketing, research and other business purposes, and we may associate your personally identifiable information with other information we collect about you, such as details about your usage patterns and interests... We may also use your contact details and metadata relating to your communications with KKR representatives for business development purposes... user information may be one of the transferred assets.

    Privacy Notice (Non-EU)

  5. KKR embeds tracking pixels in its emails to monitor opens and clicks, and runs session-monitoring scripts on its site that log how you scroll, click, and move your mouse — all in personally identifiable form.

We may also use these technical methods in HTML e-mails that we send our Site users and individuals who subscribe to our newsletters to determine whether such recipients have opened those e-mails and/or clicked on links in those e-mails... we may use software tools such as JavaScript to measure and collect session information, including page response times, download errors, length of visits to certain pages, page interaction information (such as scrolling, clicks, and mouse overs).

    Privacy Notice (Non-EU)

  6. If you ever dispute anything about the site, you must sue in New York City courts only — and you give up your right to a jury trial before any dispute even exists.

The laws of the State of New York govern these Terms of Use. Any dispute relating to these Terms of Use or your use of the Site shall be resolved solely in the state or federal courts located in New York City. You agree to waive trial by jury in any such action.

How these were found

Documents read directly from kkr.com via browser_open on Oct 1, 2026 with no access blocks (no mirrors needed). Privacy Notice (Non-EU) states 'Last updated: October 2023'; Privacy Notice (CA) states 'Last updated: January 17, 2024'; the Terms of Use page shows no update date. KKR is a B2B private-equity firm — its public site has no consumer accounts, purchases, or subscriptions, so there is no auto-renew mechanism to score (autorenew = 0 reflects absence, not virtue). Scoring reflects only what exists in the public-facing legal documents; investor-only documents (Investor Center privacy notices, fund subscription agreements) were not reviewed. Retention language ('reasonably necessary') appears only in the CA notice, which also notes the policy doesn't apply to data covered by the Gramm-Leach-Bliley Act.

These notes come from the original draft and are not independent verification.
