6 clauses and findings from the draft archive, dated 1 October 2026. The plain English comes first; the small print is the company's own words.
You waive jury trial and class actions — you must arbitrate individually, and the arbitrator's remedies are limited. The only carve-outs are small-claims court and IP-infringement suits.
SECTION 23 BELOW CONTAINS PROVISIONS THAT, WITH LIMITED EXCEPTIONS: (a) REQUIRE THE USE OF ARBITRATION, RATHER THAN COURTS OR JURY TRIALS, TO RESOLVE DISPUTES; (b) REQUIRE YOU TO RESOLVE DISPUTES ON AN INDIVIDUAL BASIS AND EXPRESSLY WAIVE THE RIGHT TO BRING OR PARTICIPATE IN A CLASS ACTION IN CONNECTION WITH SUCH DISPUTES; AND (c) LIMIT THE REMEDIES THAT ARE AVAILABLE IN THE EVENT OF A DISPUTE.
Fox can rewrite the arbitration rules retroactively — even disputes about things that happened before the new rules apply under the new rules.
Fox may update its dispute resolution procedures (currently in Section 23) at any time to apply to all 'Disputes' not yet initiated by you or us as of the date the dispute resolution procedures are updated. Thus, you and we must initiate any dispute under the version of Fox's dispute resolution procedures that is current as of the date you or we initiate the Dispute, regardless of whether the Dispute is based on alleged conduct that occurred before the dispute resolution procedures were updated.
A free trial silently converts to a paid subscription at whatever the current price is — Fox says outright it won't remind you before charging.
AFTER YOUR FREE TRIAL ENDS, YOUR SUBSCRIPTION WILL AUTOMATICALLY CONVERT TO A REGULAR PRICE SUBSCRIPTION AT THE THEN-CURRENT PRICE, PLUS APPLICABLE TAXES, UNLESS YOU CANCEL BEFORE THE CONVERSION... You will not be notified that your Free Trial is about to end unless such notice is required by Applicable Law.
Fox admits it 'sells' or 'shares' your name, IP, email and device identifiers to ad-tech firms and advertisers for targeted ads — including across devices and channels — and ignores your browser's Do Not Track signal.
Identifiers, such as name, IP address, email address, user/display name, and online and device identifiers [disclosed to] Advertising technology companies; advertisers — For the purpose of targeted advertising. [Also] sharing certain information with advertising technology and related companies (e.g., identity partners), such as an advertising identifier for your device, IP address, or a 'hash' of an identifier... for our use in online and cross-channel advertising. At this time, we do not respond to the 'Do Not Track' signal.
