Where FedEx Freight does well

  • Renewals 0 of 20. Nothing found.
  • Data retention 0 of 15. Nothing found.
  • The FXF 100 tariff's Item 155 Data Privacy states 'FedEx does not sell any personal information to another business or third party.' No forced individual-arbitration clause in the core FXF 100 LTL tariff — the class-action waiver found applies only to the Custom Critical expedited arm's tariff.
  • The claims process is unusually transparent for a carrier: a nine-month filing window, online filing and tracking, an average review time of ~six business days, and a direct disputes email (file.freightclaim@fedexfreight.com), per the official claims FAQ at https://www.fedexfreight.com/en-ca/manage-account/claims.
  • Liability caps are printed directly on the bill-of-lading shipping contracts themselves ($25/lb new, $0.50/lb used, per-occurrence maximums), not hidden in fine print.

You give up joining or participating in any class-action lawsuit against the expedited arm — and most damage claims die unless you sue within one year of delivery.

The fine print

6 clauses and findings from the draft archive, dated 1 October 2026. The plain English comes first; the small print is the company's own words. None of these has been checked yet.

  1. You give up joining or participating in any class-action lawsuit against the expedited arm — and most damage claims die unless you sue within one year of delivery.

...no shipper, consignee, consignor, payor, third party, or any other individual or entity with an ownership interest in a shipment or portion thereof, will sue FedEx Custom Critical or any of its utilized service providers as a class plaintiff or class representative, join a class as a member, or participate as an adverse party in any way in a class action lawsuit...

  2. They can rewrite the rulebook — rates, services, features, all terms — whenever they want with zero notice; the PDF on their own site is 'the most current version and is controlling,' so you'd never know what changed.

FedEx Freight reserves the right to modify, amend, change or supplement any of these rules at any time, without notice, including, without limitations, the rates, services, features of service, and other terms and conditions.

  3. Sign the enrollment form and you've agreed to let them hand your shipping information and data to the association and/or its agents — not just to FedEx Freight.

you specifically acknowledge and agree to the release of your shipping information and data to Association and/or its agent

  4. Forget to clearly mark Priority vs Economy on the bill of lading and they default you to the more expensive Priority service — and bill you for it.

If the Bill of Lading is not marked clearly as to which service Customer wishes to use, the shipment will move via FedEx Freight Priority service and will be charged the applicable FedEx Freight Priority pricing.

FXF 100 Series Rules Tariff (Item 188),

  5. On the Canada shipping contract, simply not checking a coverage box counts as waiving extra coverage — while default liability for used/reconditioned goods is just $0.50/lb capped at $10,000 (new goods: $25/lb capped at $100,000).

Not selecting an additional coverage option is considered to be a waiver of same.

Canada Quick Pass Bill of Lading,

  6. If you use someone else's FedEx account discount without authorization, they can retroactively charge you full list rates on all of those shipments — with no warning.

Any individual or entity that uses the FedEx account or shipping discounts of another FedEx account holder without authorization will be charged FedEx® Standard List Rates for all such shipments without prior notice.

How these were found

The current English FXF 100 Series Rules Tariff could not be read directly (images.fedex.com blocked automated access; the live HTML page 404s). Findings citing tariff items use a full-text English mirror of FXF 100-T (effective Jan 4, 2021, on readkong.com) plus a current French edition marked 'Révisé le 2026-06-01' (post-June 2026 spinoff). Item numbering is stable across editions, but wording may differ from the current English original. The 'Brand-FXF Spin Off Enrollment Form & T&C' (post-spinoff enrollment terms) is hosted on a third-party enrollment vendor site (enrollandsave.visionary.com) under FedEx Freight branding, not on fedexfreight.com itself. The class-action-waiver/1-year-suit-limit clause comes from the FDCC 101 tariff of the FedEx Custom Critical expedited arm (legacy customcritical.fedex.com URL branding), not from the core FXF 100 LTL tariff — the FXF 100 tariff contains no forced individual-arbitration clause. The US-to-Mexico bill of lading still references the 'fedex.com Rules Tariff' — legacy pre-spinoff language. fedex.com's privacy notice and website terms belong to the former parent FedEx Corp (FDX), not the independent FedEx Freight (FDXF), and were deliberately not used. Footer links to FedEx Freight's own Terms of Use / Privacy & Security / Privacy Notice exist but did not resolve to readable pages. FedEx Freight's customers are freight shippers (B2B). Liability caps and short claim windows are industry-standard under the Carmack Amendment — not the same thing as consumer 'sneaky terms' — but several clauses here go beyond the norm.
