Where Expeditors International does well

  • Arbitration 0 of 20. Nothing found.
  • Renewals 0 of 20. Nothing found.
  • Data retention 3 of 15. Few problems found.
  • No forced arbitration or class-action waiver appears anywhere in the public documents — disputes go to Washington state courts, and the customer only 'irrevocably consents' to (non-exclusive) jurisdiction there.
  • The privacy statement explicitly says 'We do not sell or rent your personal data to third parties' and does not share it for cross-context behavioral advertising.
  • Users are granted access, correction, and deletion rights (depending on jurisdiction) with a pledge of no discrimination for exercising them, and the company is transparent about exactly which data categories it collects.
  • For a B2B freight forwarder, these are reasonably consumer-respecting positions.

If Expeditors loses or damages your shipment, you must notify them within 14 days and file a formal sworn proof of claim within 180 days — miss either deadline and Expeditors gets a 'complete defense,' meaning your claim is dead.

The fine print

6 clauses and findings from the draft archive, dated 1 October 2026. The plain English comes first; the small print is the company's own words. None of these has been checked yet.

  1. If Expeditors loses or damages your shipment, you must notify them within 14 days and file a formal sworn proof of claim within 180 days — miss either deadline and Expeditors gets a 'complete defense,' meaning your claim is dead. Even if you meet the deadlines, you must file any lawsuit within one year, far shorter than most statutes of limitation.

With respect to any act or omission by Expeditors, Customer must present to Expeditors at Expeditors office (1) a preliminary notice of claim within fourteen (14) days after the loss or incident giving rise to the claim and (2) a formal written sworn proof of claim within one hundred eighty (180) days from the date of loss or incident giving rise to the claim. Failure to satisfy these requirements is a complete defense to any suit or action by Customer... any suit to recover on a claim against Expeditors must be commenced within one (1) year after the date of delivery or release of the goods...

Terms and Conditions of Service (§8 Limitation of Actions)

  2. Even when Expeditors' own negligence is proven, recovery is capped at $50 per shipment (or $50 per customs entry), and a hard annual ceiling of $10,000 across all claims — tiny relative to typical freight cargo values. No recovery for lost profits or consequential losses, ever, even if Expeditors knew they were coming.

Expeditors' liability for any loss, damage, expense or delay resulting from the proven negligence or other fault of Expeditors is limited as follows... the lesser of fifty dollars (US) ($50) per shipment or the commercial invoice value of the shipment... CUSTOMER AGREES THAT THE MAXIMUM AGGREGATE OF EXPEDITORS' LIABILITY TO CUSTOMER... SHALL BE NO MORE THAN THE LESSER OF THE FOLLOWING: (i) TEN THOUSAND DOLLARS (US) ($10,000); (ii) ACTUAL, DIRECT DAMAGES; OR (iii) THE AGGREGATE SERVICE CHARGES PAID BY CUSTOMER TO EXPEDITORS DURING THE SAME PERIOD... EXPEDITORS SHALL IN NO EVENT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, PUNITIVE, STATUTORY OR SPECIAL DAMAGES...

Terms and Conditions of Service (§7 Limitation of Liability)

  3. Expeditors can rewrite the terms governing your existing business relationship unilaterally by posting new ones online; they take effect 15 days later with no individual notice. Separately, price quotes are 'for informational purposes only and are subject to change without notice,' and any credit line can be increased, decreased, suspended or revoked 'in its sole discretion... at any time for any reason and without advance notice.'

Expeditors may from time to time change these Terms and Conditions. The applicable Terms and Conditions can be found on Expeditors' website, www.expeditors.com, are effective fifteen (15) days after such publication, and may differ from the preprinted terms... the updated version controls.

Terms and Conditions of Service (§18 Miscellaneous, §4 Quotations Not Binding, §9 Payment and Credit Terms)

  4. The customer must pay for virtually any loss Expeditors suffers — including Expeditors' own legal bills and consequential losses — even when the customer did nothing wrong. The indemnity only stops if a final court judgment specifically finds Expeditors guilty of gross negligence or willful misconduct.

Customer shall indemnify Expeditors and hold Expeditors harmless from and against all charges, claims, damages, liabilities, judgments, costs, expenses, payments or losses of any kind (including for purchase price, freight, storage, demurrage, detention, duties, taxes, fines, penalties, incidental, indirect, consequential or exemplary damages, and Expeditors' litigation expenses and reasonable expenses, including attorneys' fees)... in each case, even if not due to any negligence or other fault of Customer.

Terms and Conditions of Service (§10 Indemnification)

  5. Expeditors says it doesn't sell your data (good), but reserves broad discretion to hand it over to third parties and government agencies whenever it 'in good faith' thinks it's appropriate to protect its own interests. It also flatly refuses to honor global privacy control (GPC) opt-out signals, arguing there's nothing to opt out of.

Yes, as part of normal business operations, we may disclose your personal data to third parties (affiliates of Expeditors or third-party providers)... We may also disclose information about you to prevent or investigate a possible crime... to protect our own rights or property or the rights, property or safety of our users or others... Please note that we do not honor opt-out preference signals to opt-out of sale or sharing since we do not sell or share your personal information.

Privacy Statement, DO YOU DISCLOSE MY DATA?

  6. If anything goes wrong on Expeditors' websites, your only remedy is to stop using the site — and their maximum exposure is $100. They can also change the site's terms 'at any time, for any reason without prior notice.'

Should you get dissatisfied with any web page or with any of these Terms of Use, your sole and exclusive remedy is to discontinue accessing the respective web page... you agree that the total liability of Expeditors for any claims under these Terms of Use, including for any implied warranties, is limited to USD100.00... Expeditors reserves the right to make changes in any way, at any time, for any reason without prior notice, to the contents and information on these websites.

    Terms of Use

How these were found

All documents were read directly from official Expeditors domains via browser_open on 2026-10-01; no third-party mirrors were used. Sources: Terms of Use and Privacy Statement at https://web.expeditors.com/legal/ (Terms marked 'Last updated: February 1, 2018'; Privacy Statement marked 'Effective Date: January 9, 2023' / 'Last Update: March 2, 2018'); General Terms and Conditions of Service PDF at https://www.expeditors.com/media/1079/terms-and-conditions-of-service-expeditors.pdf (Word metadata says 'v3 April 2016'); End User Agreement at https://info.expeditors.com/terms-of-use (undated, appears stale — still cites the EU-US Safe Harbor framework, invalidated in 2015). Expeditors is a B2B freight forwarder: most real customers negotiate customized contracts, so these public boilerplate terms may not reflect negotiated deals; regional variants exist (Thailand, New Zealand, KSA, Germany PDFs were found but not relied on). Score kept modest because there is no forced arbitration, no auto-renew or cancellation traps, and no data selling in the public documents.
