Where Everpure does well
- Arbitration 0 of 20. Nothing found.
- No forced arbitration or class-action waiver anywhere: the website Terms (Section 12C) and the End User Agreement (Section 6.6) both send disputes to the state and federal courts of Santa Clara County, California.
- The Privacy Notice says third-party AI/ML tools used for support and marketing 'do not use Everpure or your data to train their algorithms.' New Evergreen//One customers get a 30-day 'money back' guarantee on their first subscription (Section 7).
- The End User Agreement states Everpure 'does not host or have read or write access to the End User data stored on the Products' (Section 1.4) — a storage vendor promising it can't read your data is genuinely good.
- Returned hardware gets a secure erase at no charge, and departing customers can export their data within 30 days with no extra fee.
Evergreen//One subscriptions auto-renew for 36 months at Everpure's then-current prices — up to 20% higher, with your original promo discounts stripped out.

Evergreen//One subscriptions auto-renew for 36 months at Everpure's then-current prices — up to 20% higher, with your original promo discounts stripped out. You must give written notice at least 60 days before expiry to escape, and if you lapse and keep using the service you pay a 5% penalty fee on the annual contract value.
Subscriptions automatically renew, at Everpure's then-current rates but not to exceed a 20% increase over the previous term's rate, for 36 months with a valid Purchase Order, and End User will be invoiced accordingly, unless End User provides Everpure and/or its authorized reseller written notice of its intent not to renew the subscription at least sixty (60) days prior to the expiration of the then-current Service Term. The renewal price will not include any one-time promotional discounts or deals made available at the time of the initial purchase. ... End User will be subject to a reinstatement fee equal to five percent (5%) of the annual contract value.

Some subscription renewals cannot be cancelled at all once ordered. The ones you can cancel still require 60 days' written notice AND you must pay every remaining committed fee through the end of the service term — effectively an early-termination fee equal to the full balance of the contract.
renewal orders of the following may not be terminated: (i) Everpure Data intelligence products; (ii) Evergreen //Forever, (iii) Evergreen //Foundation; or (iv) //R Product support ... Evergreen //One, //Flex, Everpure Protect Service ... may be terminated if End User (i) provides Everpure 60 days' prior written notice (which shall be the maximum notice period required to transition to an alternative vendor) and (ii) pays in full all Reserve Commitments outstanding from the date of termination through the end of the Service Term
