Where Essex Property Trust does well

  • Unlike companies that deny selling data, Essex provides a dedicated Consumer Rights Request Portal, a phone line ((833) 591-5938), and a separate cookie-management opt-out for Do Not Sell/Share requests — and it honors Global Privacy Control (GPC) signals for cookie-based tracking, which is a genuinely privacy-respecting default.
  • The arbitration clause is less draconian than it could be: it follows JAMS consumer-arbitration fairness standards, allows small-claims court, Essex may pay the JAMS fees if required for enforceability, and a written opt-out path exists at all.
  • Text-program consent is not required to buy or rent anything, and opting out is a simple 'STOP' text rather than a phone call or account deletion.
  • Essex states it does not knowingly sell/share the personal information of consumers under 16, and limits sensitive-PI processing to purposes exempt from consumer choice under CCPA.

You are forced into binding arbitration in San Mateo County (Essex's home turf), give up class-action and jury-trial rights, and must mail a written opt-out within just 5 business days of first using the site — a much shorter window than the 30 days many companies allow, so most people will miss it.

The fine print

6 clauses and findings from the draft archive, dated 1 October 2026. The plain English comes first; the small print is the company's own words. None of these has been checked yet.

  1. You are forced into binding arbitration in San Mateo County (Essex's home turf), give up class-action and jury-trial rights, and must mail a written opt-out within just 5 business days of first using the site — a much shorter window than the 30 days many companies allow, so most people will miss it.

Unless you give us notice of opt-out within five (5) business days of your first use of the Service, addressed to: 1100 Park Place, Suite 200, Attn: Legal, San Mateo, California, all actions or proceedings arising in connection with, touching upon or relating to any Dispute... shall be submitted to JAMS (www.jamsadr.com) for final and binding arbitration... to be held in San Mateo County, California, before a single arbitrator... both you and the Essex Parties waive the right to bring any Dispute as a class, consolidated, representative, collective, or private attorney general action... THE PARTIES HEREBY WAIVE THEIR RIGHT TO JURY TRIAL WITH RESPECT TO ALL CLAIMS AND ISSUES ARISING UNDER... THESE TERMS.

  2. The text-message subscription auto-renews monthly, and the 'up to 10 texts/month' cap quietly applies only to promotional texts — non-promotional texts are unlimited. Opting out is scoped narrowly: stopping one subscription or one email address/phone number does not stop others, and Essex reserves the right to keep sending non-promotional messages anyway.

Your subscription auto-renews each month until you unsubscribe... If you do agree, you consent to receiving up to ten (10) promotional Program texts per month, plus additional non-promotional texts. You understand and accept that short-form descriptions of Program message caps (e.g., 'up to 10 msg/mo') refer to only caps on promotional messages and not to non-promotional messages... This will not affect subsequent subscriptions and if your opt-out is limited to certain types of emails the opt-out will be so limited... Even if you opt out of receiving promotional communications, Essex may, subject to applicable law, continue to send you non-promotional communications.

  3. Essex openly admits it sells or shares personal info (identifiers and browsing data go to 'Third-Party Digital Businesses', and it reserves the right to hand your data to third parties for their own use). Merely giving them your phone number — even for a tour — counts as consent to be called, even if your number is on the federal Do Not Call registry.

We may Sell or Share your PI, as these terms apply under the CCPA. However, we provide you an opt out of Sale/Sharing... we reserve the right to make your PI available to Third-Parties for their own use... If you provide your telephone number, you agree that doing so is request to be contacted and we may contact that number even if it is registered on a corporate, state, or national Do Not Call Registry.

  4. Essex can rewrite the rules at any time simply by posting them — no email notice promised, no affirmative consent needed; just continuing to use the site binds you. It can also cut off your account or the whole service whenever it wants, for any reason, with no notice and no liability.

From time to time, we may change these Terms, or applicable Additional Terms, effective prospectively. If we change these Terms, we will give you notice by posting the revised Terms on the Web Site. Those changes will go into effect on the Effective Date shown in the revised Terms. By continuing to use the Web Site or Services, you are agreeing to the revised Terms... We may change or discontinue the Web Site or Services at any time, with or without notice to you... suspend or terminate your access to it, in whole or in part... at any time, without notice, for any reason and without any obligation to you or any third-party.

    Terms of Service §§14, 16

  5. There are no fixed retention periods — Essex keeps your data as long as it decides it has a 'legitimate purpose'. Even if you exercise your deletion rights, Essex warns that deletion may be incomplete, and it broadly reserves the right to keep your data for records, security, legal defense, and internal business purposes.

We will retain your PII for as long as it is needed to fulfill the purpose for which it was collected or as required by the law. We are under no obligation to store such information indefinitely and disclaim any liability arising out of, or related to, the destruction of such information... Because there are numerous types of PI in each category of PI, and various uses for each PI type, our retention periods for each category of PI vary. We retain specific PI pieces based on how long we have a legitimate purpose for the retention... making a deletion request does not ensure complete or comprehensive removal or deletion of PI or content you may have posted.

  6. Anything you post or submit — including on their social media pages — can be used, sublicensed, sold and resold by Essex forever, for any purpose, with no payment to you. And if anything goes wrong, Essex caps its total liability at $5,000 no matter the harm.

You agree to grant Essex a non-exclusive, unrestricted, worldwide, and perpetual right and license to use, copy, record, distribute, reproduce, disclose, sell, re-sell, sublicense, display, perform, transmit, publish, broadcast, translate, make derivative works of, and otherwise use and exploit in any manner all or any portion of your user generated content... for any purpose whatsoever... TO THE EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF ESSEX AND ITS AFFILIATES FOR ANY CLAIMS UNDER THESE TERMS, INCLUDING FOR ANY IMPLIED WARRANTIES, IS LIMITED TO $5,000.

How these were found

Documents read via direct browser_open of the official essexapartmenthomes.com pages on Oct 1, 2026 — no mirrors used. Terms of Service states 'Revised: May 2021' (over 5 years old; may not reflect a newer version if one exists elsewhere). Privacy Policy and California Consumer Privacy Notice both state 'Last Updated Date: December 26, 2024'. Text Program Terms and Conditions page shows no revision date. Actual resident lease agreements are not published on the public site and were not reviewed — findings cover only the public website Terms, Privacy Policy, CA Privacy Notice, and Text Program terms. Page text was extracted automatically and minor whitespace artifacts may remain in quotes, but wording is faithful.
