Where Capital One does well

  • Renewals 4 of 20. Few problems found.
  • Arbitration opt-out exists and is honored: reject in writing within 30 days and the account works normally, and you can still reject later modifications.
  • Small-claims court carve-out: either party can bring individual claims in small claims court without triggering arbitration.
  • Cost protection: if you cannot afford arbitration fees and tried to get a waiver from the AAA, Capital One advances the costs — and if you win, they waive reimbursement. Arbitration hearings are held in the federal district where you live, not on their turf.
  • Privacy: Capital One says it has not sold California residents' personal information in the past 12 months, does not knowingly sell or share under-16 data, honors the browser Global Privacy Control opt-out signal, and charges no foreign-currency conversion fee on the card agreement reviewed.

Binding arbitration is the default and either side can force it — killing your right to a jury trial or class action.

The fine print

6 clauses and findings from the draft archive, dated 1 October 2026. The plain English comes first; the small print is the company's own words. None of these has been checked yet.

  1. Binding arbitration is the default and either side can force it — killing your right to a jury trial or class action. You CAN opt out, but only in writing within 30 days of getting the card or a modification, by mailed letter with your name, address, phone, account number and personal signature, sent separately from any other correspondence, to a Salt Lake City PO Box. An opt-out that ships today is easy to miss.

'Unless you reject arbitration for this Account in the manner described below... either you or we may choose to resolve the Claim by binding arbitration, as described below, instead of in court... THIS MEANS IF EITHER YOU OR WE CHOOSE ARBITRATION, NEITHER PARTY WILL HAVE THE RIGHT TO LITIGATE SUCH CLAIM IN COURT OR TO HAVE A JURY TRIAL OR PARTICIPATE IN A CLASS OR REPRESENTATIVE ACTION.'

  2. The arbitration rules themselves are a moving target: Capital One can rewrite them at will, and if you reject a modification you're stuck with whichever version was in force — the clause survives even account closure, voluntary payoff, bankruptcy, and sale or transfer of your account to a debt buyer.

'We may add, delete or change any term of this arbitration agreement. We will give you advance written notice of any change to this arbitration agreement... If you later reject any modification to the arbitration agreement, you will be bound by the most recent version of the arbitration agreement to which you agreed.'

  3. Capital One can rewrite any term of your card agreement at any time with only the notice the law forces them to give, sell or transfer your account and debt without telling you in advance, and close your account for no reason at all. Cardholders have no reciprocal rights — you may not assign the agreement at all.

'At any time, we may add, delete or change any term of this Agreement, unless the law prohibits us from doing so. We will give you notice of any changes as required by law.' / 'We may sell, assign or transfer your Account and this Agreement without your permission and without prior notice to you.' / 'We may close or suspend your Account at any time and for any reason permitted by law, even if you are not in default.'

  4. Marketing companies are allowed to harvest your data through Capital One's own website and apps for cross-site, cross-app, cross-device ad targeting. Sharing with affiliates (including the newly-added Discover, DFS, Capital One Shopping, Velocity Black, Diners Club, PULSE, The Student Loan Corporation) and business partners (co-branded card partners, 'joint marketing' partners) is disclosed up front. The classic bank privacy notice also says joint-marketing sharing with other financial companies cannot be limited, affiliate marketing can only be limited by calling a phone menu, and 'when you are no longer our customer, we continue to share your information as described in this notice.'

'We may share information or allow companies to collect information through our Online Services in order to provide marketing services to us, including to target advertising to you based on personal information collected across different websites, mobile apps, and devices over time.' / 'Marketing partners. We may share information or allow companies to collect information through our Online Services in order to provide marketing services to us, including to target advertising to you based on personal information collected across different websites, mobile apps, and devices over time.'

  5. One of the first 'Agentic AI' liability clauses in consumer banking: if an AI agent you grant access to overspends, misclicks, or goes rogue on your card account, you own every resulting charge — even ones that explicitly violated your instructions.

'If you authorize or use any third party, automated service, or Agentic AI to take actions on your Account, including transactions or servicing requests, you are responsible for those actions.' / 'Except as otherwise prohibited by applicable law, if you authorize or allow any other person, service (automated or otherwise), or Agentic AI to use your Card or to assist in making transactions, you are responsible for the resulting transactions even if they do not follow your instructions.'

  6. Signing the agreement is blanket consent to robocalls, autodialed calls to your mobile, recorded conversations, and reporting your payment history to credit bureaus — including for authorized users' activity, not just your own.

'We may share information about your Account to credit bureaus and others. Late payments, missed payments, or other defaults on your Account may be reflected in your credit report.' / 'You agree that we may communicate with you by mail, telephone, email, fax, prerecorded message, automated voice, text message or other means allowed by law regarding your Account. You agree that we may contact you at any telephone number (including a mobile telephone number that you provide us), and use an automated telephone dialing system or similar device to do so. You agree that we may monitor or record any conversation or other communication with you.'

GLBA 'FACTS' sharing-table data (joint marketing / affiliate sharing rows and 'we continue to share after you leave') comes from third-party mirrors of genuine Capital One FACTS notices (cardreviews.org PDFs, 2014-2016 era) because the current FACTS notice was not directly fetchable — those rows may be dated.
