AbbVie
Health Care
40
out of 100. Number 296 of 512, counting from the worst.
Where AbbVie does well
- Arbitration 4 of 20. Few problems found.
- Renewals 3 of 20. Few problems found.
- No forced arbitration clause was found anywhere in AbbVie's Online Terms of Use — disputes remain litigable in court (Illinois law governs).
- AbbVie repeatedly and explicitly states it does not sell personal data, including in the California-specific section, and California residents are granted rights to know, delete, and opt out with an explicit non-discrimination promise ('AbbVie will not discriminate against you by offering you different pricing or products' for exercising rights).
- On the patient-assistance form, the SMS and marketing consents are clearly labeled OPTIONAL, and opting out of texts is a simple 'STOP' reply — marketing consent is not a condition of receiving the medication subsidy.
- The cookie policy offers granular 'cookie settings' to opt out of non-required cookie categories plus DAA/NAI opt-out links, and the HIPAA authorization form at least spells out plainly that disclosed health data loses HIPAA protection.
Anything you upload or send to AbbVie's websites — photos, stories, comments — becomes free for AbbVie to copy, publish, modify, or build derivative works from, in any format it likes.
The fine print
6 clauses and findings from the draft archive, dated 1 October 2026. The plain English comes first; the small print is the company's own words. None of these has been checked yet.
-
Anything you upload or send to AbbVie's websites — photos, stories, comments — becomes free for AbbVie to copy, publish, modify, or build derivative works from, in any format it likes. You also waive moral rights (attribution, integrity) wherever the law allows.
You grant to AbbVie the right to use all content you upload or otherwise transmit to the AbbVie websites, subject to these Online Terms of Use and AbbVie's Privacy Policy in any manner AbbVie chooses, including, but not limited, to copying, displaying, performing or publishing it in any format whatsoever, modifying it, incorporating it into other material, or making a derivative work based on it. To the extent allowed by applicable law you waive any moral rights you may have to content you upload or otherwise transmit to the AbbVie websites (if any).
-
AbbVie can rewrite the terms at any time and 'notify' you only by bumping the date at the top of the page — no email, no pop-up. Just keep using the site and you are bound by the new version.
Without prejudice to your rights under applicable law, AbbVie reserves the right to amend these Online Terms of Use to reflect technological advancements, legal and regulatory changes and good business practices. If AbbVie changes these Online Terms of Use, an updated version of these Online Terms of Use will reflect those changes and we will notify you of such changes by updating the effective date at the top of these Online Terms of Use.
-
If you have a legal claim against AbbVie over its websites, you must file it within one year of the incident — a shorter deadline than the law would otherwise give you, and one you agree to simply by using the site.
You agree that regardless of any applicable law to the contrary, you cannot file a claim or cause of action arising out of or related to the AbbVie Web Sites or these Online Terms of Use more than one (1) year after such claim or cause of action arose.
-
AbbVie says it doesn't 'sell' your data, but it does hand your personal data to marketing and advertising partners so they can target you with ads based on tracking your activity across other websites — which many state privacy laws treat as 'sharing' anyway. Opt-out requires finding their Your Privacy Choices portal.
We do not sell your personal data, but may use and disclose your personal data with marketing and advertising partners to deliver you ads based on your interests inferred from your activity across other unaffiliated sites and services ('online targeted advertising') and for website analytics.
-
To get free or subsidized medicine, your doctor and pharmacy must send your full health records to AbbVie — and the moment AbbVie has them, HIPAA no longer applies. AbbVie can re-disclose that health data and use it to develop and improve its products. Withdrawing the authorization ends your enrollment in the program.
I understand that Protected Health Information disclosed to AbbVie under this Authorization will no longer be protected by HIPAA and may be subject to redisclosure by AbbVie... in order for AbbVie to (i) enroll me in, provide, operate and administer the AbbVie Financial Support Program ('Program'); (ii) provide me with information concerning the Program; and (iii) develop, evaluate, and improve products, services, materials, and programs related to my condition or treatment.
-
To qualify for free medication through the patient assistance program, you must let AbbVie pull your credit report — a credit check on a patient seeking help affording medicine, buried in the enrollment fine print.
FAIR CREDIT REPORTING ACT CONSENT (REQUIRED): I understand that I am providing written instructions to the Program under the Fair Credit Reporting Act authorizing the Program to obtain information about my credit profile from credit reporting agencies or other sources. I authorize the Program to obtain such information solely to determine PAP eligibility.
AbbVie Patient Access Support enrollment form (Skyrizi, S-APP1-26F-2, June 2026)
How these were found
Document dates/versions: Online Terms of Use at https://www.abbvie.com/terms-of-use.html (fetched live Oct 1, 2026; no effective date shown on the page); AbbVie Patient Access Support Skyrizi enrollment form, document code S-APP1-26F-2, June 2026 (©2026 AbbVie) — the richest consumer-facing document; corporate Privacy Notice viewed at https://abbv.ie/corpprivacy, which rendered only its OneTrust JavaScript shell to automated fetching, so privacy-notice substance was verified through two sources: (1) the full Privacy Notice text printed inside the Skyrizi PAP form, and (2) the verbatim mirror of AbbVie's global Privacy Policy at http://privacynotifications.ca/en/pp-privacy-policy.html (operated by AbbVie Corporation, 8401 Trans-Canada Hwy, St-Laurent, Quebec — AbbVie's own Canadian privacy-notifications domain, not a third-party archive). Access limitations: the corpprivacy page is OneTrust-JS-rendered and not readable by text fetch; no forced-arbitration clause was found, so arbitration was scored modestly on the 1-year claim limitation. AbbVie is a B2B pharma company with no consumer subscriptions, so auto-renew is inherently thin — scored low accordingly.
These notes come from the original draft and are not independent verification.
