The fine print

5 clauses and findings from the draft archive, dated 1 October 2026. The plain English comes first; the small print is the company's own words. None of these has been checked yet.

  1. Scrape too much — or help anyone else do it — and X can bill you $15k per million posts without proving actual harm.

You will be jointly and severally liable to us for liquidated damages… for requesting, viewing, or accessing more than 1,000,000 posts… in any 24-hour period – $15,000 USD per 1,000,000 posts”, including if you “induce or knowingly facilitate others to do so.”

    ToS

  2. Every post — even AI prompts and outputs — feeds X's models for free. Your payment is being allowed to use X.

You grant us a worldwide, non-exclusive, royalty-free license… for any purpose… including… training of our machine learning and artificial intelligence models, whether generative or another type… with no compensation paid to you.”

  3. X can strip Premium features mid-billing-cycle and keep your money.

There are no refunds or credits for any partial subscription periods, including in a situation where certain features, benefits and/or services are modified or discontinued.”

    Purchaser Terms

  4. Partner data sharing is on by default — partners can train their own AI on you unless you dig up the opt-out.

If you do not opt out, in some instances the recipients of the information may use it for their own independent purposes… including, for example, to train their artificial intelligence models, whether generative or otherwise.”

    Privacy Policy §3.2

  5. Miss a two-year window and you lose the right to bring any claim.

Claims against X expire 2 years after the relevant events.
