Where ResMed does well

  • Renewals 2 of 20. Few problems found.
  • ResMed's regional privacy notices state plainly: 'We do not sell or rent your personal data' (resmed.asia / resmed.la privacy notices).
  • In the official myAir signup flow, sharing therapy data with your healthcare provider is a separate opt-in consent checkbox (marked 'recommended' but optional) — not bundled into the mandatory Terms/Privacy consent — and marketing consent is another separate checkbox.
  • For therapy management, ResMed describes itself as a data processor acting for your care provider, and it honors access/correction/portability rights where law requires.
  • EU therapy data is hosted in France/Germany by an HDS-certified health-data hosting provider with penetration testing, and transfers outside the EEA are covered by Standard Contractual Clauses.

If you use ResMed's Dawn AI sleep coach (inside myAir), you give up your right to sue in court or join a class action; any dispute goes to private arbitration — and ResMed alone picks the arbitrator.

The fine print

6 clauses and findings from the draft archive, dated 1 October 2026. The plain English comes first; the small print is the company's own words. None of these has been checked yet.

  1. If you use ResMed's Dawn AI sleep coach (inside myAir), you give up your right to sue in court or join a class action; any dispute goes to private arbitration — and ResMed alone picks the arbitrator.

Resmed and you agree that all disputes arising under these Terms of Use shall be brought by you in your individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding, and shall be resolved by confidential binding arbitration as selected by Resmed in its sole discretion.

    Dawn Terms of Use

  2. Your sleep-therapy health data can be reused for research studies by ResMed, outside researchers, and ResMed's partners — with your explicit consent required only 'when necessary,' otherwise justified by their own 'legitimate interest.'

For health research, evaluation, and studies: your health data may also be reused under the responsibility of ResMed, researchers or ResMed's partners for retrospective studies of public interest in the field of health and aimed at improving scientific knowledge and advancement in care delivery. This process ... is in compliance with ResMed's, researchers', or ResMed's partners' legitimate interest ... and when necessary, your explicit consent.

  3. Ask to delete your therapy data and ResMed can simply refuse — data kept for 'legal obligations' (device improvement, postmarket follow-up, materiovigilance) is exempt from deletion.

You may request us to delete your Personal Data (however, when ResMed only processes it to comply with its quality and regulatory obligations, under applicable laws, which is the case for processing purpose 1. ResMed will not be able to delete your Personal data upon request).

  4. Your health data is kept for 10–15 years — including up to 15 years after a device is pulled from the market — far longer than most patients would expect.

To improve the usability, performance and safety of medical devices, customer health data shall be retained for ten (10) years from receipt by ResMed. For postmarketing clinical followup of medical devices, the personal data of customers must be kept for a period of ten (10) years after the end of the marketing of the medical device. For materiovigilance, the personal data of customers must be kept for fifteen (15) years from the date of withdrawal from the market of the drug, medical device or product.

  5. ResMed can change the terms whenever it wants, and just by keeping the app on your phone after a notice is posted, you've legally 'agreed' to the new terms.

Resmed may modify, update, or replace these Terms of Use from time to time. Resmed will endeavor to post a notice of any change, update, or replacement to these Terms of Use for a period of thirty (30) days following any such modification or replacement... Your continued use of the Service after Resmed provides notice of modification or replacement constitutes your acceptance of the modified or successor terms.

    Dawn Terms of Use

  6. Anything you type into the Dawn sleep coach — including descriptions of your health problems — becomes ResMed's to use, sell, or sublicense forever, royalty-free.

You agree that Resmed will have, and you grant to Resmed, a worldwide, royalty-free, perpetual, irrevocable, sublicense-able, non-exclusive right and license to translate, reproduce, sell, publish, distribute, modify, adapt, display, perform, promote, link to or use, in any form or media, any User Content that you submit to this Service or Resmed.

    Dawn Terms of Use

How these were found

Document versions/dates relied on: (1) Dawn Terms of Use at resmed.com/en-us/dawn-terms-of-use/ (official ResMed US site; page crawl Sep 2026, latest-referenced version; Dawn is the AI sleep coach built into the myAir app and its terms incorporate the myAir Terms of Use by reference). (2) AirSense 11 Privacy Notice PDF at document.resmed.com (official ResMed document library; multi-language EU notice, covers sleep/therapy health data; no version date stamped in the text I read). (3) AirMini App Privacy Notice at resmed.com/en-us/airmini-app-privacy-policy/ (official US site). (4) ProjectFit Terms of Use PDF at document.resmed.com (official ResMed research-app terms). (5) ResMed Privacy Notice excerpts from resmed.asia/resmed.la (official regional sites). (6) myAir registration consent flow as documented in ResMed's official registration instructions PDF mirrored at hmespecialists.com. LIMITATIONS: I could not retrieve the standalone US 'myAir Terms of Use' or 'myAir Privacy Notice' as public web pages — they appear to live inside the myAir app signup flow only; the Dawn Terms (which govern a myAir-integrated service and explicitly incorporate the myAir Terms of Use) and the AirMini notice are the closest official US equivalents I could read. resmed-myair.com is a third-party cybersquatter (contact gavin@resmed-myair.com, AdSense template privacy policy) — I excluded it entirely.
