Where Pentair does well

  • Pentair offers an arbitration opt-out (30-day mailed written notice), which many apps do not. Arbitration cost terms are consumer-friendly: a consumer who initiates arbitration pays only about $250, Pentair bears all other costs, consumers get a right to an in-person hearing in their hometown area, and California claimants are protected from fee-shifting if they do not prevail. Pentair honors Global Privacy Control signals for opt-out of sale/sharing, offers a right to delete/correct personal data via privacy@pentair.com or 1(877)241-9958, and does not knowingly sell/share data of users under
  • No auto-renew or subscription-billing traps were found in any public Pentair document.

If you use the Pentair Home/Pool/Pro/ScreenLogic apps, you give up the right to sue Pentair in court or join a class action.

The fine print

6 clauses and findings from the draft archive, dated 1 October 2026. The plain English comes first; the small print is the company's own words. None of these has been checked yet.

  1. If you use the Pentair Home/Pool/Pro/ScreenLogic apps, you give up the right to sue Pentair in court or join a class action. All disputes go to private, individual arbitration (administered by JAMS, in-person hearings in Minneapolis, MN unless you are a consumer). The only way out is a mailed written opt-out notice within 30 days of first use.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAWS, ALL DISPUTES ARISING OUT OF OR RELATED TO THIS AGREEMENT, YOUR USE OF THE SERVICE AND ALL RELATED MATTERS, WHETHER BASED IN CONTRACT, TORT, STATUTE, FRAUD, MISREPRESENTATION OR ANY OTHER LEGAL THEORY, WILL BE RESOLVED THROUGH FINAL AND BINDING ARBITRATION BEFORE A NEUTRAL ARBITRATOR INSTEAD OF IN A COURT BY A JUDGE OR JURY AND YOU AGREE THAT PENTAIR AND YOU ARE EACH WAIVING THE RIGHT TO TRIAL BY A JURY... ANY ARBITRATION UNDER THIS AGREEMENT WILL TAKE PLACE ON AN INDIVIDUAL BASIS; CLASS ARBITRATIONS AND CLASS ACTIONS ARE NOT PERMITTED AND YOU ARE AGREEING TO GIVE UP THE ABILITY TO PARTICIPATE IN A CLASS ARBITRATION OR CLASS ACTION.

  2. Pentair openly admits it sells and shares personal data — identifiers, customer records, transaction/purchase history, browsing activity, geolocation, and inferred profiles — with third-party ad networks for targeted advertising. There is an opt-out mechanism, but selling data to ad networks is the default.

We disclose, sell and/or 'share' (for purposes of cross-context behavioral or targeted advertising) Personal Information with the following categories of third parties... 'Ad Networks.' We share Personal Information with third-party ad networks to permit them to send you marketing communications.

  3. Firmware and software updates install automatically on your Pentair equipment — no extra notice, no extra consent. Pentair can also remotely access and reprogram your connected pool/water devices for any purpose without telling you. If you refuse automatic updates, your only option is to stop using the service and delete your account.

These may be automatically installed without additional notices or consents. You hereby consent to automatic Updates or Upgrades... To the extent not prohibited by applicable Laws, Pentair may remotely access and program the IoT Devices... for any purpose... Pentair may perform such activities without notifying You.

App Terms and Conditions - United States & Canada, Section 8 (Maintenance and Support)

  4. Pentair can rewrite the agreement whenever it wants; just continuing to use the app or your connected devices counts as agreeing to the new terms. There is no negotiate-or-reject option that keeps your service working.

Pentair may change this Agreement from time to time by notifying You of such changes in accordance with Section 25. ... Your use of the Service or Pentair IoT Devices following any changes to this Agreement will constitute Your acceptance of such changes.

  5. No matter what goes wrong — lost data, a bricked device, service outage, bodily injury or property damage tied to the service — the maximum Pentair can ever owe you under these terms is $100.

IN NO EVENT SHALL PENTAIR'S MAXIMUM AGGREGATE LIABILITY HEREUNDER EXCEED ONE-HUNDRED U.S. DOLLARS ($100).

App Terms and Conditions - United States & Canada, Section 13 (Limitation of Liability)

  6. Anything you post in Pentair's app forums, chat, or commenting features — photos, reviews, suggestions — becomes Pentair's to use forever, for any purpose including advertising testimonials, with no payment to you and no way to take it back.

For each Submission, You hereby grant to Pentair a worldwide, royalty-free, fully paid-up, non-exclusive, perpetual, irrevocable, transferable and fully sublicensable (through multiple tiers) license... to reproduce, distribute, perform and display (publicly or otherwise), create derivative works of, adapt, modify and otherwise use, analyze and exploit such Submission... for any purpose (including promotional purposes, such as testimonials).

How these were found

App Terms and Conditions - United States & Canada, 'Last Updated: June 29, 2026', read directly from pentair.com (no mirror needed). Privacy Notice, 'Last Modified: April 8, 2025' with U.S. State Privacy Notice Addendum, read directly from pentair.com (no mirror needed). Pentair is predominantly B2B; its most detailed public terms cover its consumer IoT apps (Pentair Home, Pentair Pool, Pentair Pro, ScreenLogic), so findings skew to app/connected-device users rather than pure equipment buyers. Dealer/business program terms (Sections 5(f), demand-response addendum) were excluded from scoring as they target pros, not consumers.
