Where NRG Energy does well

  • No early termination fees on the plans reviewed: the PA fixed plan states "Cancellation/Early Termination Fees: None" and the IL plan says you may terminate "AT ANY TIME WITH NO TERMINATION FEES AND NO PENALTIES."
  • NRG gives two separate written notices (45-60 days and 30 days) before a fixed contract expires or terms change in PA - more notice than most auto-renew contracts.
  • The contract is unusually candid about price risk: "Savings are not guaranteed nor implied with this contract and our price may be higher than the supply rate charged by the utility or other suppliers."
  • Dispute rights with regulators are preserved: you may still file complaints with the state PUC/Illinois Commerce Commission, and small-claims court is carved out of arbitration.
  • The privacy policy states "We do not sell or rent your information" and mobile numbers are not shared with third parties or affiliates for marketing; data-sharing and telemarketing opt-outs are offered via privacy@nrg.com and Do-Not-Call lists.

Signing up for NRG's power supply means you give up your right to sue them in court and to a jury trial - all disputes go to private AAA arbitration, and you can never join or start a class action, even for state or federal claims.

The fine print

6 clauses and findings from the draft archive, dated 1 October 2026. The plain English comes first; the small print is the company's own words. None of these has been checked yet.

  1. Signing up for NRG's power supply means you give up your right to sue them in court and to a jury trial - all disputes go to private AAA arbitration, and you can never join or start a class action, even for state or federal claims. There is no opt-out offered, and the clause survives contract termination.

TO THE FULLEST EXTENT PERMITTED BY PENNSYLVANIA LAW, ANY DISPUTE, CONTROVERSY OR CLAIM ARISING OUT OF, RELATING TO OR IN CONNECTION WITH THIS CONTRACT, SHALL BE FINALLY RESOLVED BY ARBITRATION BEFORE THE AMERICAN ARBITRATION ASSOCIATION ("AAA")... BY ENTERING INTO THIS CONTRACT, YOU ARE GIVING UP YOUR RIGHTS TO SEEK REMEDIES IN COURT, OTHER THAN IN SMALL CLAIMS COURT, AND THE RIGHT TO A JURY TRIAL. THE PARTIES AGREE THAT ALL CLAIMS INCLUDING STATUTORY, STATE OR FEDERAL CLAIMS, MAY BE MADE SOLELY ON AN INDIVIDUAL BASIS, AND THAT THIS CONTRACT DOES NOT PERMIT CLASS ACTIONS, EITHER IN ARBITRATION OR THROUGH A COURT PROCEEDING.

  2. Do nothing and you are silently rolled into a brand-new contract at whatever price and term NRG picks for you (a $0.128/kWh 12-month fixed plan becomes a new term at a new price). Inertia, not a signature, is what locks you in - and cancellation can take up to 10 calendar days to process through the utility.

If you do not cancel the contract or switch to another provider before the expiration of your contract, your service will continue at the price and contract duration indicated in the second notice.

  3. After the 3-month teaser rate (10.7c/kWh), NRG can set your monthly price at its own discretion - including based on its own profit margins and how loyal customers are. Your price can change every month with no cap except a 30%-per-month increase limit, so the teaser rate has almost no bearing on what you actually pay.

We will determine the variable supply price at our discretion based on many different factors, which may include prices charged by competitors, industry charges we are responsible for, our costs to procure and sell energy, Current customer retention rates, applicable state and local taxes, changes in weather, legal and regulatory issues, profit margins, and other relevant business conditions. ... The variable supply price can change each month.

  4. Your account data - including energy usage, payment history, and even whether you have a medical emergency or disability (data the utility must legally share with them) - can be handed to affiliates and marketing partners. If you object, your only recourse stated in the contract is to cancel your electricity plan entirely.

We reserve the right to share your information with our affiliates and marketing partners, to the extent permitted by law and/or as authorized when you provide your consent. ... If you do not wish for us to use or share information about your account in the manner described above, you may cancel this contract by calling us at our contact information listed herein.

  5. NRG can rewrite its privacy policy whenever it wants without telling you - just updating a date stamp - and by continuing to keep the lights on with them you are treated as having agreed to the new terms. The parallel Terms of Use likewise say NRG may revise terms "at its sole discretion."

We reserve the right to make changes to this Policy from time to time without prior notice. If we modify this Policy, we will update the "Last modified" date at the top of this Policy. ... Your continued use of this Website or our products and services after we make changes is understood as your acknowledgment of those changes.

  6. NRG keeps your personal data for as long as it finds it "useful" - an open-ended standard - and the only guaranteed way to get your data deleted is to cancel your electricity service altogether. Even then, legal-retention obligations may let them keep it longer.

We do not commit to any obligation to retain your data for any particular length of time and anticipate retaining your Personal Information for as long as it is required by law or regulation or is useful, as permitted under applicable law. ... Please understand that we may not be able to delete your Personal Information except by also deleting your account, which may require cancellation of products or services that we provide to you.

All documents are on NRG Home's official domains (picknrg.com, energypluscompany.com) - no mirrors used. Note: NRG's retail supply contracts differ by state and plan; PA and IL plans were reviewed as representative samples. The parent-company NRG Energy, Inc. Terms of Use on nrg.com could not be fetched (page blocked automated access), so scoring rests on the consumer-facing retail-energy documents, which is where most customers encounter NRG. Search-result snippets from official domains were used only for discovery, not as clause sources.
