Where Norwegian Cruise Line Holdings does well

  • NCL states it does NOT sell or share sensitive personal information and does not knowingly sell/share minors' data without affirmative authorization.
  • It honors the Global Privacy Control signal and provides deletion/correction/opt-out rights, and on a verified deletion request it will delete and 'direct our service providers to delete' your data.
  • Injury/illness/death claims on cruises touching a US port are NOT forced into arbitration — they can be litigated (albeit only in federal court in Miami) — and there is a small-claims carve-out; the contract also concedes that the Cruise Industry Passenger Bill of Rights overrides it in conflicts.
  • Biometric safeguards: the disembarkation photo shared with US Customs and Border Protection is deleted 'immediately' after identity verification, facial-recognition data is 'not retained beyond the duration of your cruise,' and NCL states it does not collect, use, or sell personal data for training large language models.

You can never join or benefit from a class action against NCL, even if the law would otherwise allow it — and the waiver is deliberately glued to the arbitration clause so a court can't strike the waiver alone.

The fine print

6 clauses and findings from the draft archive, dated 1 October 2026. The plain English comes first; the small print is the company's own words. None of these has been checked yet.

  1. You can never join or benefit from a class action against NCL, even if the law would otherwise allow it — and the waiver is deliberately glued to the arbitration clause so a court can't strike the waiver alone.

GUEST WAIVES RIGHT TO CLASS ACTION RELIEF: THIS CONTRACT PROVIDES FOR THE EXCLUSIVE RESOLUTION OF DISPUTES THROUGH INDIVIDUAL LEGAL ACTION ON GUEST'S OWN BEHALF INSTEAD OF THROUGH ANY CLASS ACTION. EVEN IF THE APPLICABLE LAW PROVIDES OTHERWISE, GUEST AGREES THAT ANY ARBITRATION OR LAWSUIT AGAINST CARRIER WHATSOEVER SHALL BE LITIGATED BY GUEST INDIVIDUALLY AND NOT AS A MEMBER OF ANY CLASS OR AS PART OF A CLASS ACTION... GUEST AGREES THAT THIS SECTION SHALL NOT BE SEVERABLE UNDER ANY CIRCUMSTANCES FROM THE ARBITRATION CLAUSE.

Norwegian Cruise Line Guest Ticket Contract, §11(b)

  2. Any non-injury dispute (billing, privacy, discrimination, missed ports) must be arbitrated in Miami, Florida only — no jury, no discovery, and you pay half the arbitration costs. (The Bloomberg Law-reported 2026 Phillips case shows NCL actively enforcing this against trip-insurance claims.)

ANY AND ALL DISPUTES, CLAIMS, OR CONTROVERSIES WHATSOEVER, OTHER THAN FOR INJURY, ILLNESS OR DEATH OF A GUEST... SHALL BE REFERRED TO AND RESOLVED EXCLUSIVELY BY BINDING ARBITRATION... SOLELY IN MIAMI-DADE COUNTY, FLORIDA, U.S.A. TO THE EXCLUSION OF ANY OTHER FORUM. NEITHER PARTY WILL HAVE THE RIGHT TO A JURY TRIAL OR TO ENGAGE IN PRE-ARBITRATION DISCOVERY... THE COST OF THE ARBITRATION ITSELF SHALL BE SPLIT EQUALLY BETWEEN THE PARTIES.

Norwegian Cruise Line Guest Ticket Contract, §15(d)

  3. NCL can drop any port from your itinerary at any time, for any reason, and owes you nothing for it — the ports that sold you the cruise aren't guaranteed.

The Carrier has the sole discretion and liberty to direct the movements of the vessel, including the rights to... cancel any scheduled call at any port for any reason and at any time before, during or after sailing of the vessel; omit, advance or delay landing at any scheduled or advertised port... without incurring any liability to the Guest on account thereof for any loss, damage or delay whatsoever, whether consequential or otherwise, except as may be required by law.

Norwegian Cruise Line Guest Ticket Contract, §7(c)

  4. NCL can add a surcharge (up to $10/person/day) to a cruise you've already paid for in full, with no advance warning, if fuel prices rise.

Carrier reserves the right to charge a fuel supplement, without prior notice, should the closing price of West Texas Intermediate Fuel increase above $65.00 USD per barrel on the NYMEX... The amount of the fuel supplement will not exceed $10.00 USD per passenger per day... This charge may apply, at Carrier's sole discretion, to existing and new reservations and Carrier may collect the fuel supplement at the time of sailing, even if the Fare has been paid in full.

Norwegian Cruise Line Guest Ticket Contract, §3(a)

  5. NCL plainly admits it sells/shares your identifiers, purchase history, browsing history, and inferred profiles with ad agencies, ad tech, and financial institutions for advertising.

As defined by the CCPA and CPRA, we may have 'shared' or 'sold' the following personal information... Identifiers / Commercial information / Internet or other similar network activity / Inferences drawn from other personal information... Who we may have shared or sold it to: Advertising and marketing partners (e.g., travel agents and financial institutions), advertising and marketing providers (e.g., ad agencies and ad tech providers), operating systems and platforms providers, and members of our family of companies.

  6. Your face can be used in NCL's commercial advertising forever, for free — and boarding automatically signs up your children too. The contract also authorizes facial-recognition technology, which the privacy policy confirms can be run against ship CCTV footage.

The Guest consents to Carrier's use and display of the Guest's likeness in any video, photograph or other depiction for any purpose, commercial or otherwise, without compensation or liability of any kind. The Guest's consent extends to minors and other persons in the care and charge of the Guest.

How these were found

Guest Ticket Contract read in full as the official 04/2025 US English PDF (NCL Guest Ticket Contract 04/2025, file NCL_Guest_Ticket_Contract_US_EN_04_2025.pdf, hosted on NCL's Adobe AEM content domain); an ncl.com ticketcontract page summary stamped 02/2026 matched the same arbitration/class-action text but was not downloaded in full. Global Privacy Policy read in full as the January 23, 2026 English PDF from ncl.com. California Resident Privacy Notice read as the January 23, 2026 document on prod-aws.rssc.com, NCL's own legal-document host linked from the privacy policy. Cancellation penalty schedule (Chart B, 25%/50%/75%/100% tiers) taken from an ncl.com ticket-contract page snippet; the US contract itself defers cancellation charges to 'the Terms and Conditions of the cruise brochure' and states they are 'subject to change without notice.' All quotes below are verbatim from the documents read. The contract is the classic cruise-industry 'ticket contract' rather than a website ToS; auto-renew does not apply (no subscription product), so that category was scored on cancellation-trap behavior only.
