Arbitration, with a local small-claims option

For U.S. residents, the agreement contains binding arbitration and a class-action waiver. It allows qualifying individual small-claims cases in the customer’s county of residence.

Context and exceptions. Section 15 also allows rejection of future arbitration changes, other than address changes, by signed postal notice within 30 days. That is not a general opt-out of the initial agreement.

Arbitration. Microsoft Services Agreement, §15

The fine print

5 clauses and findings from the draft archive, dated 1 October 2026. The plain English comes first; the small print is the company's own words.

  1. You can never sue Microsoft in court or join a class action. Only escape: reject future arbitration changes within 30 days by personally-signed US Mail.

You and we agree to binding individual arbitration before JAMS under the Federal Arbitration Act, and not to sue in court in front of a judge or jury… Class action lawsuits, class-wide arbitrations, private attorney-general actions, requests for public injunctions… aren't allowed.”

    Services Agreement §15

  2. Microsoft can rewrite the deal whenever it wants; your only options are accept or delete your entire Microsoft account.

We may change these Terms at any time, and we'll tell you when we do. Using the Services after the changes become effective means you agree to the new terms. If you don't agree to the new terms, you must stop using the Services, close your Microsoft account.”

    §7.a

  3. Microsoft says it doesn't “sell” your data, but feeds it to Facebook, Yahoo and friends for ad targeting.

We may provide collected data to internal and external partners, including Xandr, other subsidiaries and affiliates, Yahoo, Facebook, or Trade Desk to help make sure the ads you see in our products and theirs, or on other sites, are more relevant to you.”

  4. If Microsoft overbills you and you don't catch it in 90 days, they keep the money.

If we make an error on your bill, you must tell us within 90 days after the error first appears on your bill… If you do not tell us within that time, you release us from all liability and claims of loss resulting from the error and we won't be required to correct the error or provide a refund.”

    §9.e

  5. Report a bug with a fix idea? The idea is now Microsoft's, free forever.

If you give to Microsoft any idea, proposal, suggestion or feedback… you give to Microsoft, without charge, royalties or other obligation to you, the right to… commercialize your Feedback in any way and for any purpose.”

    §18
