Where Iron Mountain does well

  • Arbitration 0 of 20. Nothing found.
  • Data sharing 3 of 20. Few problems found.
  • No forced arbitration or class-action waiver was found in any of the three documents reviewed — the Express terms choose the governing law of the customer's state instead, which is better than peer consumer terms.
  • The privacy notice states explicitly, 'We does not and will not sell your personal data,' and honors browser Global Privacy Control / Do Not Track signals automatically.
  • Material changes to the agreement require 30 days' notice, and if Iron Mountain terminates your account without cause it refunds prepaid fees and returns your deposits at its expense.
  • Support-call recordings require prior consent, and CCPA/HIPAA addenda are incorporated into the online terms.

Iron Mountain can rewrite the contract however and whenever it wants.

The fine print

6 clauses and findings from the draft archive, dated 1 October 2026. The plain English comes first; the small print is the company's own words. None of these has been checked yet.

  1. Iron Mountain can rewrite the contract however and whenever it wants. You get a 30-day heads-up, but if you keep using the service past that window you are deemed to have agreed — there is no prompt or click-to-accept for the new terms.

We reserve the right to modify this Agreement in any manner and at any time as we may determine in our sole and absolute discretion... Your continued use of the services more than thirty (30) days after we publish or send a notice about our changes to this Agreement means that you have consented to the updated terms.

Iron Mountain Express Online Terms and Conditions of Service, §1 'Changes To The Agreement'

  2. Plans auto-renew by default. If you miss the cutoff, you are billed for another full term, and even a timely cancellation does not take effect until the next renewal date — you keep paying until then.

Your plan shall continue and automatically renew for the same duration (for example, monthly plans automatically renew monthly and annual plans automatically renew annually) until you cancel... You must provide notice of cancellation before your plan renews to avoid automatic renewal.

Iron Mountain Express Online Terms and Conditions of Service, §3 'Term'

  3. Leaving costs money, full stop. A closure fee is charged no matter why you cancel (even if Iron Mountain itself terminated you), and it stacks on top of any early termination fee.

Iron Mountain charges fees to close your account and terminate the services... Account closure fees apply and will be assessed to close your account and terminate your services for any reason, except for cancellation during the Trial Period.

Iron Mountain Express Online Terms and Conditions of Service, §3.3.1 'Account Closure'

  4. Cancel mid-term and you owe the entire remaining value of the contract — the full monthly price for every month left — plus the separate closure fee for returning your own records.

[T]he Early Termination Fee [is] equal to your monthly plan price multiplied by the number of months remaining in the then-current term. The Early Termination Fee is in addition to the applicable account closure fees.

Iron Mountain Express Online Terms and Conditions of Service, §3.3.2 'Early Termination Fee'

  5. For a company whose entire business is safeguarding your records, the contract pre-assigns your paper files a value of one dollar per box, disclaims any insurance against their loss or damage, and caps total liability at what you paid in the last 12 months. Irreplaceable legal or medical records are worth $1 a carton on paper.

YOU DECLARE, FOR THE PURPOSES OF THIS AGREEMENT, THAT (A) WITH RESPECT TO HARD-COPY (PAPER) RECORDS, MICROFILM, AND MICROFICHE STORED OR PROCESSED PURSUANT TO THIS AGREEMENT, THE VALUE OF SUCH ITEMS IS $1.00 PER CARTON... DEPOSITS ARE NOT INSURED BY IRON MOUNTAIN AGAINST LOSS OR DAMAGE, HOWEVER CAUSED.

Iron Mountain Express Online Terms and Conditions of Service, §14 'LIMITATION OF LIABILITY'

  6. Retention is open-ended: data is kept for as long as Iron Mountain deems 'reasonably necessary,' with no fixed schedule published, and they may keep it longer if they foresee a possible legal dispute involving you — a judgment call only they get to make.

We will retain your Personal Data for as long as is reasonably necessary for the purposes for which it was collected... In specific circumstances We may retain your Personal Data for longer periods of time so that we have an accurate record of your dealings with us in the event of any complaints or challenges, or if We reasonably believe there is a prospect of litigation relating to your Personal Data or dealings.

How these were found

Documents read directly on Oct 1, 2026: Privacy Notice | Iron Mountain United States (https://www.ironmountain.com/utility/legal/privacy-policy, no revision date shown on page), Iron Mountain Express Online Terms and Conditions of Service (https://express.ironmountain.com/terms, no revision date shown), and Website Terms and Conditions of Use via the en-ch mirror (https://www.ironmountain.com/en-ch/utility/legal/website-terms) because the US version of the website-terms page returned HTTP 429 on fetch; the en-ch page carries the same User Terms text and matches snippets from the US page. Iron Mountain is overwhelmingly B2B — the Express terms cover its small-business online service and enterprise customers sign separate negotiated agreements, so there are few consumer-facing traps to score; findings below reflect the public documents as they exist, not an enterprise contract.
