Where Generac does well

  • Renewals 2 of 20. Few problems found.
  • No forced arbitration in the main Generac website/app Terms of Use — unlike many consumer-tech peers, the base terms send disputes to court (Milwaukee, WI) rather than private arbitration; arbitration and the class-action ban appear only in the optional grid-program terms and the MobileLink class-waiver.
  • The privacy notice explicitly states they do not sell or share personal information of individuals they know are under
  • Full California privacy rights are offered — right to know, delete, correct, opt out of sales/sharing, and limit sensitive data — with multiple request channels (email, toll-free 1-888-GENERAC) and authorized-agent support, plus a financial-incentive disclosure.
  • The MobileLink EULA promises email/app notification for material EULA changes rather than silent posting, and accounts can be deleted at any time via the app; cookie preferences and Google/Adobe analytics opt-outs are provided.

If you join a Generac grid-savings program and have a dispute, you must go through private arbitration (AAA rules, Milwaukee, Wisconsin) instead of court, and you give up your right to a jury trial.

The fine print

7 clauses and findings from the draft archive, dated 1 October 2026. The plain English comes first; the small print is the company's own words. None of these has been checked yet.

  1. If you join a Generac grid-savings program and have a dispute, you must go through private arbitration (AAA rules, Milwaukee, Wisconsin) instead of court, and you give up your right to a jury trial.

Notwithstanding anything to the contrary, any dispute that cannot be resolved informally within the forty-five (45) day period shall be settled by arbitration administered by the American Arbitration Association in accordance with its commercial arbitration rules... SUCH AGREEMENT TO ARBITRATE MEANS THAT BOTH PARTIES HEREBY WAIVE THEIR RIGHT TO A JURY TRIAL.

  2. Grid-program customers cannot join together in a class action or class arbitration — any claim must be brought alone, one by one.

Class arbitration is not permitted under any circumstance. You and Generac agree that, by entering into these T&Cs, THE PARTIES MAY BRING CLAIMS AGAINST THE OTHER ONLY IN THEIR RESPECTIVE INDIVIDUAL CAPACITY, and not as a plaintiff or class member in any purported class or representative proceeding.

  3. Mobile Link app users can't file class actions, and any lawsuit must be filed in Milwaukee County, Wisconsin — no matter where the customer lives. (Note: the MobileLink EULA does not force arbitration.)

You agree that you may only bring claims against Company related to your use of the App on an individual basis and not as a plaintiff or class member in any purported class or representative action or proceeding. All claims, legal proceedings, or litigation arising in connection with the App will be brought solely in the federal or state courts located in Milwaukee County, Wisconsin, United States, and you consent to the jurisdiction of and venue in such courts and waive any objection as to inconvenient forum.

    MobileLink End User License Agreement

  4. Your electricity-usage data from the site and connected services can be used to offer products and services from Generac, its business partners, your utility, and other third parties — and once aggregated, Generac can share or even license your usage data freely, without asking again.

You agree that Generac may use certain of Your information and the data collected about You, including without limitation Your electricity usage and usage of the Services, for the purpose of providing information, services, and products, such as conservation or energy reduction programs, services, or products, of Generac, business partners of Generac, your utility, or other third parties... so long as the resulting data is aggregated or anonymized (i.e. no longer identifying you as an individual), that Generac may share, provide, license, disclose, and otherwise freely use such aggregated or anonymized data.

Generac Terms & Conditions (Sites and Services)

  5. Generac admits under California law definitions that it 'sells' and 'shares' your personal info with ad networks and analytics companies for marketing. Your precise GPS location goes to analytics providers, and your device location plus what ads you saw goes to marketing partners for personalized ads.

We may 'sell' or 'share' as described in the table below to third-party advertising networks and analytics providers for purposes of marketing and advertising and to improve and measure our ad campaigns... We use and disclose sensitive personal information, namely, precise geolocation information collected from our app users, to obtain insights and for analytics purposes. As part of this, we may disclose sensitive personal information to analytics providers... We may also share your device's physical location, combined with information about what advertisements you viewed and other information we collect, with our marketing partners to enable them to provide you with more personalized content and to study the effectiveness of advertising campaigns.

  6. Generac can rewrite its terms whenever it wants just by posting an update. Simply continuing to use the site or app counts as accepting the new terms, and your only option if you object is to stop using it entirely.

Generac may, at any time, revise these Terms of Use for the Sites or Services by updating this posting. By using the Sites or Services, you agree to be bound by any such revisions and should periodically visit this page to review the current Terms of Use to which you are bound... If You object to any such changes, Your sole recourse will be to cease access to the Sites or Services.

Generac Terms & Conditions (Sites and Services)

  7. If you reply to a Generac social-media request with a hashtag, submit a review, photo, or video, you hand Generac and its partners a forever, worldwide, irrevocable license to use your content — including your face, name, and voice — in ads forever, to alter or edit it however they like, without asking you first.

User hereby grants to Generac and its executives, employees, affiliates, related companies, agents, licensees, sublicensees, brand partners, production partners, social media platforms, contractors, successors, legal representatives, assigns, third-party service providers and their respective brand partners, marketing or public relations agencies and other affiliates (the 'Licensed Parties') a worldwide, perpetual, irrevocable, royalty-free, fully-paid, non-exclusive, transferable, sublicensable right and license to use, publish, broadcast, transmit, distribute and re-post (i) User Content and (ii) User's username, name, voice, image, likeness or other identifying information... The Licensed Parties may use, display, reproduce, distribute, transmit, create derivative works from, combine with other materials, alter and/or edit User Content in any manner in their sole discretion, with no obligation to you whatsoever. No use of the User Content or User's Name and/or Likeness related to the User Content need be submitted to User for any approval.

How these were found

All documents were read directly from Generac's own domains on 2026-10-01 (no third-party mirrors needed). Main Terms & Conditions PDF (generac.s3.amazonaws.com) is stamped 'LAST UPDATED: September 2019' and is noticeably stale — it may predate the current footer terms. Privacy Notice last revised July 9, 2025 (California section Jan 16, 2025). MobileLink EULA and Terms of Service hosted on official cdn.mbl.link domain. Texas grid-program page read in full; the DTE-program search snippet from generac.com also showed data-sharing with third parties 'to permit them to send you marketing communications' but that page was not read in full. Additional aggressive clauses beyond the six findings: $100 aggregate liability cap in both the main Terms and the Mobile Link Terms of Service, a broad indemnification of Generac by the user, a waiver of California Civil Code 1542 (unknown claims), unilateral termination of site/app access 'at any time, for any reason, in our sole discretion', and grid-program terms letting Generac remotely manage/start your generator during grid events while requiring a paid Mobile Link subscription to participate.
