Where Fiserv does well

  • Change-termination right: merchants can exit within 30 days if Fiserv raises fees or amends terms in a way that materially diminishes their rights or increases obligations — a real escape hatch against unilateral changes.
  • Fee increases require 30 days' advance written notice, not silent billing changes.
  • Privacy Notice promises opt-in consent before disclosing personal data to any company outside Fiserv for marketing purposes, and it honors the Global Privacy Control browser signal for ad-tech opt-outs.
  • Data-protection posture is above average for the sector: Binding Corporate Rules govern cross-border transfers, annual PCI DSS compliance is stated, and a 24-hour Data Privacy Hotline (+1 800-368-1000) is published for breach reports.
  • The jury-trial and class-action waivers in the website Terms of Use are mutual (both parties waive), unlike the one-sided versions many consumer companies use.

Merchants are locked in for an initial 3-year term.

The fine print

8 clauses and findings from the draft archive, dated 1 October 2026. The plain English comes first; the small print is the company's own words. None of these has been checked yet.

  1. Merchants are locked in for an initial 3-year term. Miss the 60-day advance notice window before that term ends and the contract auto-renews in 3-month chunks. Combined with the early termination fee below, leaving early is expensive.

This Agreement ... will continue until the third anniversary of the date Fiserv first assigns a MID to the Company (such period, the Initial Term) ... This Agreement will renew for successive 3 months periods (each a Renewal Term), unless either party gives the other 60 days' advance written notice of nonrenewal before the end of the Initial Term.

Merchant Agreement General Terms (Version 5, August 2022)

  2. If the contract is terminated early because of a merchant 'default event,' Fiserv charges 80% of your average monthly fees for every month left in the term — a penalty-style exit fee on a 3-year contract.

...an amount equal to 80% of the average monthly fees paid to Fiserv during the 12-month period preceding the termination ... multiplied by the number of months (including partial months) remaining in the Term (the Early Termination Fee).

Merchant Agreement General Terms (Version 5, August 2022), clause 10.4

  3. Termination is one-sided: Fiserv can walk away at any time for no reason, while the merchant is locked into a 3-year term with an 80% early-exit penalty. The merchant's only clean early exit is the narrow 'change termination' right if Fiserv raises fees or guts their rights.

At any time during the Term, Fiserv may terminate this Agreement by prior written notice stipulating the date upon which termination is to take effect, without having to assign any reason for such termination.

Merchant Agreement General Terms (Version 5, August 2022), clause 10.2

  4. Fiserv can raise your processing fees with 30 days' notice and can rewrite the contract itself just by posting changes on its website. A fair-point mitigation: the merchant may terminate within 30 days if a fee hike or amendment materially worsens their deal (clause 10.5).

Fiserv may adjust the fees and charges for the Services upon 30 days' advance written notice... Fiserv may, by written notice to the Company and/or by posting the amended terms on its website, amend this Agreement.

Merchant Agreement General Terms (Version 5, August 2022), clauses 4.3 and 12.7

  5. Fiserv openly states it sells merchant personal information to credit-reference and data-collection companies for business-credit purposes. Opt-out requires the customer to proactively find a web form; the default is sale.

For example, please use this form to request to opt out of the sale of merchant personal information subject to the CCPA to credit reference and other companies engaged in data collection and analysis, such as in the context of personal information that is sold for business credit purposes.

  6. Anything you submit to Fiserv's site — including text you type into their AI chatbot/agent features — becomes Fiserv's to use forever, including to train their products. You get no royalties, no attribution, and you waive your moral rights as an author.

You grant Fiserv and its affiliates a perpetual, irrevocable, non-exclusive, worldwide right and license to use, publish, reproduce, modify, adapt, edit, translate, create derivative works from, incorporate into other works, distribute, sublicense and otherwise exploit all such Content (including, without limitation, Input), in part or in whole, in any way and in any form, whether now known or otherwise developed hereafter, including to train or improve Fiserv's products and services.

  7. If you never paid Fiserv for using its website, your maximum recovery for any claim — even negligence — is $100. Even paying users are capped at just 3 months of payments.

IN NO EVENT WILL FISERV'S TOTAL CUMULATIVE LIABILITY TO YOU ARISING FROM ALL CLAIMS ... EXCEED THE GREATER OF THE AMOUNTS ACTUALLY PAID BY YOU ... FOR THE THREE MONTH PERIOD IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED DOLLARS $100.00 IF YOU HAVE NOT HAD ANY PAYMENT OBLIGATION TO FISERV UNDER THESE TERMS.

Fiserv Terms of Use (Last Update Posted: April 10, 2025), clause 16

  8. Privacy terms can change unilaterally with mere posting; continuing to use any Fiserv product counts as acceptance. There is no stated retention schedule — the notice says only 'We will retain your Personal Information as set forth above,' which refers to nothing actually stated above.

We reserve the right to modify this Privacy Notice at any time... Any modifications to this Privacy Notice will be effective upon our posting of the new terms and/or upon implementation of the new changes... In all cases, your continued use of our products or services after the posting of any modified Privacy Notice indicates your acceptance of the terms of the modified Privacy Notice.

How these were found

Fiserv is a B2B payments processor (banks, merchants, Clover POS) and publishes very little consumer-facing legal material. Findings come from three official documents actually read in full via the browser: the fiserv.com Terms of Use (Last Update Posted: April 10, 2025), the fiserv.com Privacy Notice (Last Updated: May 23, 2024), and the Merchant Agreement General Terms, Version 5 (August 2022), published by First Data Merchant Solutions (Hong Kong) Pte Ltd on merchants.fiserv.com. The Hong Kong merchant agreement was used because the US Clover / First Data merchant agreement is not posted in full on any official Fiserv domain; third-party ISO copies (e.g., a Clover Go contract on scribd.com and a Pay Factory sub-merchant agreement on payfactory.io) were located but deliberately not relied on since they are not Fiserv's own documents. No forced-arbitration clause was found in any Fiserv-authored public document; the HK agreement routes disputes to Hong Kong courts. Scores are kept modest because most of Fiserv's real customer contracts are private negotiated agreements that are not publicly accessible.
