The fine print
6 clauses and findings from the draft archive, dated 1 October 2026. The plain English comes first; the small print is the company's own words. None of these has been checked yet.

Simply visiting the corporate site means you give up your right to sue in court. All disputes go to private arbitration run by the American Arbitration Association, and class actions are banned entirely. There is no opt-out mechanism. (The only carve-out is for disputes about First Solar's own intellectual property.)
You and First Solar agree to arbitrate all disputes, except disputes relating to the enforcement of First Solar's intellectual property rights... YOU ARE GIVING UP THE RIGHT TO LITIGATE A DISPUTE IN COURT BEFORE A JUDGE OR JURY.
-
First Solar can rewrite the rules unilaterally, any time, just by posting a new version. The burden is on you to keep checking for changes; continued browsing equals acceptance. Only 'material' changes get any notice, and only 'in accordance with applicable laws.'
First Solar may, in its sole discretion, modify, add or remove any portion of these Terms of Use at any time and in any manner, by posting revised Terms of Use on this Site... It is your responsibility to check periodically for any changes we make to these Terms of Use... Your continued use of this Site after any changes to these Terms of Use means you accept the changes.

The company says it doesn't 'sell' your data in the colloquial sense, but it lets ad networks and business partners grab your info straight from your browser, and those third parties may then resell it to even more third parties. On top of that, the company 'is not currently able to respond to DNT (do-not-track) signals.'
We do not 'sell' California Personal Information as most people would typically understand that term. However, we do share certain California Personal Information with trusted business partners, as well as allow certain third party advertising networks and other third party businesses to collect your California Personal Information directly from your browser or device through cookies and related technologies for advertising, attribution, analytics and research purposes. These third parties may use such California Personal Information for their own purposes in accordance with their own privacy statements, which may include reselling this information to additional third parties.

First Solar admits it may build a profile on you from third-party sources before you ever contact them, visit on purpose, or sign up for anything — including info shared by social media platforms about people who click or 'like' their posts.
At times, we may collect Personal Information about you from other sources and third parties, even before our first direct interaction.
-
No matter what goes wrong — even a data breach or reliance on wrong info on the site — the company's total liability to you is capped at fifty dollars, and indirect or consequential damages are excluded entirely.
IN NO EVENT SHALL WE BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES... OUR LIABILITY TO YOU... SHALL NOT EXCEED $50.
-
First Solar can cut off your access to the site for any reason, or literally no reason, with zero warning and zero liability — and doing so doesn't affect any of the other rights it claims over you.
WE RESERVE THE RIGHT TO, IN OUR SOLE DISCRETION AND WITHOUT NOTICE OR LIABILITY, DENY ACCESS TO, AND USE OF, THIS SITE TO ANY PERSON FOR ANY REASON OR FOR NO REASON AT ALL, INCLUDING, WITHOUT LIMITATION, FOR BREACH OF ANY REPRESENTATION, WARRANTY OR COVENANT CONTAINED IN THESE TERMS OF USE, OR OF ANY APPLICABLE LAW OR REGULATION.
How these were found
Terms of Use 'Last Modified: May 16, 2018' — quite stale, but still the live version served by firstsolar.com. Privacy Statement 'Last Updated 25 July 2024' — current. Both documents were fetched directly from the official firstsolar.com domain via browser_open; no blocking, no mirrors needed. Supplemental portal terms referenced in the Terms (PlantPredict terms of use, PlantAdvise License End-User Agreement) were not examined — out of scope for the public website scoring. First Solar is a B2B solar-panel manufacturer with a thin corporate brochure website; there are no consumer products, accounts, subscriptions, or purchases on the public site, so several rubric categories simply have no surface area. Scores are editorial judgment applied only to what exists.
