Where FedEx does well

  • Renewals 0 of 20. Nothing found.
  • No forced binding arbitration anywhere in the fedex.com Terms of Use — unlike many consumer companies, FedEx leaves your right to sue in court intact (class actions are waived for Ground/Custom Critical shipments, but individual suits remain available).
  • Privacy: FedEx states 'We do not "sell" or "share" your Personal Information, including the Personal Data of children under the age of 16, as those terms are defined under California law and have not done so in the previous twelve months' (Global Privacy Notice Ver 2.0), with regional rights to access, delete, and correct personal data.
  • FedEx Custom Critical agrees to pay all filing and administrative fees for consumer arbitrations under $10,000 under AAA consumer rules.
  • And FedEx advertises an on-time money-back guarantee on eligible services — a promise its peers often don't make at all.

Every FedEx Ground shipment carries a contract term barring you from joining or bringing a class action against FedEx Ground — individual lawsuits only.

The fine print

6 clauses and findings from the draft archive, dated 1 October 2026. The plain English comes first; the small print is the company's own words. None of these has been checked yet.

  1. Every FedEx Ground shipment carries a contract term barring you from joining or bringing a class action against FedEx Ground — individual lawsuits only. A federal court enforced this waiver. Custom Critical shipments have the same ban, with large claims (>$100,000) routed to binding arbitration instead.

You agree that you will not sue FedEx Ground as a class plaintiff or class representative, join as a class member, or participate as an adverse party in any way in a class action lawsuit against FedEx Ground. Nothing in this paragraph, however, limits your rights to bring a lawsuit as an individual plaintiff.

FedEx Service Guide, FedEx Ground Tariff (class action waiver section), as quoted in the S.D.N.Y. opinion & order (Judge Forrest, June 25, 2015) — (court-enforced). A parallel waiver for Custom Critical: FedEx Custom Critical Service Guide — http://customcritical.fedex.com/us/serviceinfo/documents/pdf/fdff201c.pdf

  2. Unless you declare a higher value and pay extra, FedEx's liability for a lost or damaged package tops out at $100. And even if FedEx knows a late delivery will cost you money — e.g. lost profits — consequential damages are waived entirely.

FEDEX EXPRESS WILL NOT BE LIABLE FOR ANY DAMAGES IN EXCESS OF THE DECLARED VALUE OR US$100 OR THE AMOUNT SET BY THE MONTREAL OR WARSAW CONVENTIONS (AS AMENDED), WHICHEVER IS GREATER, FOR CARRIAGE OF A SHIPMENT ARISING FROM TRANSPORTATION SUBJECT TO THE TERMS AND CONDITIONS CONTAINED IN THE FEDEX SERVICE GUIDE, WHETHER OR NOT FEDEX EXPRESS KNEW OR SHOULD HAVE KNOWN THAT SUCH DAMAGES MIGHT BE INCURRED. In no event shall FedEx Express, including, without limitation, agents, contractors, employees and affiliates, be liable for any special, incidental or consequential damages, including, without limitation, loss of profits or income, whether or not FedEx Express had knowledge that such damages might be incurred.

  3. Very tight clocks: you have 60 days (U.S.) or just 21 days (international) to file damage claims from the ship date, and 9 months for lost packages. Miss the window and FedEx owes you nothing, regardless of fault.

Claims for damaged or missing contents must be filed no later than 60 calendar days from the shipment date for U.S. packages and 21 calendar days from the shipment date for international packages. Claims for undelivered or lost shipments must be filed within 9 months of the shipment date.

  4. Your right to sue over any shipment evaporates entirely if you don't file suit within two calendar years of handing FedEx the package — a hard statute of limitations written into the shipping contract.

The right to damages against us shall be extinguished unless an action is brought within two (2) calendar years after the package was tendered to FedEx Express for shipment.

  5. Sign up for Delivery Manager and FedEx may hand your personal data to outside companies so they can pitch you products and services — and once they have it, those companies' own (possibly weaker) privacy policies apply, not FedEx's.

With unaffiliated third parties and business partners who may offer products and services to you. These third parties and business partners have their own privacy notices that govern the collection and use of your Personal Data.

  6. The advertised money-back guarantee on paid Delivery Manager options can be suspended or revoked by FedEx at any time, silently and without notice. And if FedEx ignores or botches your delivery instructions, the only thing you can ever get back is the fee you paid — no other damages, ever.

We offer a money-back guarantee for FedEx Delivery Manager delivery options that are offered for a fee. This guarantee can be suspended, modified or revoked at our sole discretion without prior notice to you. At our option, we will, upon request, refund your FedEx Delivery Manager charges in the event of a delivery failure as described below. ... In no event shall FedEx, including, without limitation, agents, contractors, employees and affiliates, be liable for any damages, including but not limited to special, incidental or consequential damages, including, without limitation, loss of profits or income, whether or not FedEx had knowledge that such damages might be incurred, from honoring, or our failure to honor, any request for delivery instructions, preferences, delivery suspension, routing instruction or other delivery request from the Recipient. Notwithstanding, a refund of the FedEx Delivery Manager fee as outlined below is the exclusive remedy in the event of FedEx's failure to honor the Recipient's request for FedEx Delivery Manager options.

How these were found

fedex.com and wwwtest.fedex.com block automated fetching (Akamai 'System Down' permission page), so direct reads were impossible. Findings were traced through search-engine crawls of official fedex.com documents (verbatim snippets) plus verbatim mirrors noted per clause: Service Guide 2024 mirrored at refundretriever.com (crawled ~55 days ago), FedEx Express Transportation Service Agreement mirrored at images.examples.com (FedEx doc, crawled ~92 days ago), court opinion quoting the FedEx Ground Tariff at justia.com, FedEx Custom Critical Service Guide PDF at customcritical.fedex.com (crawled ~180 days ago), and OpenTermsArchive contrib-snapshots which tracks fedex.com/en-fr/terms-of-use.html (snapshot 2026-09-04). Document versions relied on: FedEx Express Terms and Conditions (2021 international PDF, SG_TermsCond_Intl_2021.pdf); Standard Conditions of Carriage (NZ, July 2025); FedEx Global Privacy Notice Ver 2.0 (crawled ~182-274 days ago); FedEx Delivery Manager Privacy Notice (crawled ~14 days ago); fedex.com Terms of Use Delivery Manager section via en-cw/en-gf/en-br country versions (crawled 20-58 days ago). No forced-arbitration clause was found anywhere in fedex.com Terms of Use; the arbitration-category score reflects the class-action waivers in the Ground Tariff and Custom Critical guide.
