Where ExxonMobil does well

  • Renewals 4 of 20. Few problems found.
  • ExxonMobil's privacy statement includes an explicit no-sale commitment: 'ExxonMobil does not, and will not, sell personal information to third parties' (though it does allow third-party cookie collection for interest-based advertising).
  • The program is genuinely free with no auto-renew payments or cancellation fees — cancellation is straightforward via the website's My Account page or by phone.
  • The arbitration clause is not the harshest on record: it carves out small-claims court, lets claims of $10,000 or less be heard on documents or by phone, lets you choose an in-person hearing in your home federal district, and ExxonMobil pays arbitration fees beyond what court filing would cost.
  • Marketing texts require opt-in ('Your consent to receive text messages is not required to make a purchase'), and the privacy statement gives you a Data Privacy Office email and a California toll-free line to request removal or modification of your personal information.
  • The app and program are COPPA-compliant for under-13s: not directed at children and not knowingly collecting their data.

If you have any dispute with the rewards program, you can't sue in court, can't get a jury, and can't join or start a class action.

The fine print

10 clauses and findings from the draft archive, dated 1 October 2026. The plain English comes first; the small print is the company's own words. None of these has been checked yet.

  1. If you have any dispute with the rewards program, you can't sue in court, can't get a jury, and can't join or start a class action. One of them can force your claim into private, individual arbitration instead.

EXCEPT AS EXPRESSLY PROVIDED BELOW, YOU AND EXXON MOBIL REWARDS+ ARE AGREEING TO GIVE UP ANY RIGHTS TO LITIGATE CLAIMS IN A COURT OR BEFORE A JURY, OR TO PARTICIPATE IN A CLASS ACTION OR REPRESENTATIVE ACTION WITH RESPECT TO A CLAIM. ... IF EITHER YOU OR WE CHOOSE TO ARBITRATE, THEN ANY CLAIM BETWEEN YOU AND US WILL BE RESOLVED EXCLUSIVELY AND FINALLY BY BINDING ARBITRATION ON AN INDIVIDUAL BASIS.

Exxon Mobil Rewards+ Program Terms and Conditions (Effective Jan 13, 2022), Section 18

  2. Even if hundreds of customers were harmed the same way, each person must fight alone — no combining claims, no class representative, no private-attorney-general actions.

NEITHER YOU NOR US WILL BE ENTITLED TO JOIN OR CONSOLIDATE CLAIMS BY OR AGAINST OTHER CUSTOMERS IN COURT OR IN ARBITRATION OR OTHERWISE PARTICIPATE IN ANY CLAIM AS A CLASS REPRESENTATIVE, CLASS MEMBER OR IN A PRIVATE ATTORNEY GENERAL CAPACITY. The arbitrator may not consolidate more than one person's claims, and may not otherwise preside over any form of a representative or class proceeding.

Exxon Mobil Rewards+ Program Terms and Conditions (Effective Jan 13, 2022), Section 18(d)

  3. Your dispute rights depend on who you are: AARP members get real courts, while everyone else gets forced arbitration (Section 18). Two tiers of justice for the same gas-station app.

AARP members who are also members of the Exxon Mobil Rewards+ program agree that the sole and exclusive jurisdiction and venue for resolving all disputes between us shall be brought and decided in the federal or state courts located in Harris County, Texas.

Exxon Mobil Rewards+ Program Terms and Conditions (Effective Jan 13, 2022), Section 17 (AARP members only)

  4. ExxonMobil can change the rules whenever it wants — and the changes can retroactively devalue the points you already earned. Keep using the program and you've 'agreed' to the new rules.

We may modify these Terms in any manner, at any time, in our sole discretion. Such changes may affect Points already received, including the opportunity to use such Points or their redemption rate. ... Your continued use of Exxon Mobil Rewards+ after changes have been made to these Terms constitutes your agreement to be bound by the modified Terms.

Exxon Mobil Rewards+ Program Terms and Conditions (Effective Jan 13, 2022), Section 13

  5. Same deal for the app: rules can change at any time with zero notice, and it's your job to check. Continued use counts as acceptance.

ExxonMobil reserves the right, at our sole discretion, to change, modify, add, or delete portions of this Agreement at any time and without any further notice to you. It is your responsibility to regularly check for changes to this Agreement and to review such changes.

Exxon Mobil Rewards+ App Terms & Conditions (revised Jan 1, 2026), Section 1

  6. Your points aren't yours — they expire yearly, and ExxonMobil can close your account 'for any reason, or no reason at all' with no notice and wipe your entire balance instantly.

Points have no cash value. Points are not your property. Points are issued without separate payment or other consideration by you, and exist at the sole discretion of ExxonMobil as part of a rewards program. ... On December 31 of each year, any Points that are at least one (1) year old will expire. ... We reserve the right to terminate your Exxon Mobil Rewards+ account at any time, or to modify or restrict your ability to use Points, immediately and without notice. We may do so for any reason, or no reason at all, including, but not limited to: if you violate these Terms, if you do not earn or use Points for one (1) or more years... If we terminate your account, any Points in your Exxon Mobil Rewards+ account will immediately be voided and cannot be used.

Exxon Mobil Rewards+ Program Terms and Conditions (Effective Jan 13, 2022), Sections 5 and 12

  7. Enrolling means handing over your name, contact details and phone number, and letting ExxonMobil log every item you buy at the pump and in-store — and share that info with station sponsors, under a privacy policy it can also change unilaterally.

By becoming a Member of Exxon Mobil Rewards+, you choose to provide us with your Registration Information, and you agree to update it from time to time so that it remains accurate. ... you authorize us to use and share your Registration Information and Account Activity in accordance with the Exxon Mobil Rewards+ Online Privacy Policy, as amended from time to time, in our sole discretion. ... When you participate in Exxon Mobil Rewards+ and/or present an Exxon Mobil Rewards+ Identifier, you authorize us to collect information about your 'Account Activity,' which may include the items or services that you purchased, any promotions that you redeemed, or any other information related to your transaction.

Exxon Mobil Rewards+ Program Terms and Conditions (Effective Jan 13, 2022), Section 9 (Your Data)

  8. Just using the app counts as consent for ExxonMobil to record your exact GPS location, device fingerprint (MAC, IMEI, unique ID) and how you use the app. No separate opt-in — usage is consent.

While using the ExxonMobil App, ExxonMobil may locate or record information including, but not limited to, your geographic location and exact positioning, your MAC address, the operating system of your device, the type of device you use, your device's unique ID, the IP address of your device ... your International Mobile Equipment Identity, information about the way you use the ExxonMobil App, and any other information tied directly or indirectly to your device ('Device Information'). Your use of the ExxonMobil App constitutes your consent to allow ExxonMobil to record and use your Device Information.

Exxon Mobil Rewards+ App Terms & Conditions (revised Jan 1, 2026), Section 6

  9. Your device and location data goes to Google for the station map, and the only way to stop that is to delete the app entirely. There's no in-app opt-out for Google's tracking.

The ExxonMobil App will send Device Information and, in some instances, User Content, including information about your location, to Google (including cached data). Google may use the information we provide through the ExxonMobil App in various ways. ... If at any point in time you decide you do not wish to consent to any of the above Google terms, you must uninstall the ExxonMobil App immediately. There is no other way to revoke or opt out of the Google Maps functionality and its associated terms, restrictions, and data privacy implications.

Exxon Mobil Rewards+ App Terms & Conditions (revised Jan 1, 2026), Section 13

  10. No matter what goes wrong with the app — even a data breach of your stored payment info — the most ExxonMobil will owe you is five dollars.

IN NO EVENT SHALL EXXONMOBIL'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES (OTHER THAN AS MAY BE REQUIRED BY APPLICABLE LAW) EXCEED FIVE DOLLARS ($5.00). THE FOREGOING LIMITATIONS WILL APPLY EVEN IF THE ABOVE STATED REMEDY FAILS ITS ESSENTIAL PURPOSE.

How these were found

Documents read directly via browser_open on Oct 1, 2026 (no third-party mirrors needed): (1) Exxon Mobil Rewards+ Program Terms and Conditions (Effective Jan 13, 2022) plus the Exxon Mobil Rewards+ App Terms & Conditions (revised Jan 1, 2026), both on one page at exxonmobilfuels.com; (2) ExxonMobil General Terms of Use, corporate.exxonmobil.com, Last Updated June 1, 2023; (3) legacy ExxonMobil App terms of use v1.0 dated May 11, 2016 (apps-ios-terms page, superseded by the 2026 app terms on the rewards page); (4) ExxonMobil Privacy Policy landing page, corporate.exxonmobil.com, Last updated July 1, 2024 — the landing page shows only a summary with country links, so the full privacy-statement text was verified from search-result snippets of the identical English versions of the same global statement (privacy-policy_thailand-english, privacy-policy_hong-kong-english, privacy-policy_china-english), which were consistent with each other. Country versions may differ in detail; US specifics could vary. The Rewards+ Online Privacy Policy incorporated by reference into the program terms was not separately opened. Speedpass+ as a standalone product has been discontinued/renamed into the Exxon Mobil Rewards+ app (per Wikipedia, secondary source); all findings come from current documents.
