Where Equinix does well
- Renewals 4 of 20. Few problems found.
- Data retention 3 of 15. Few problems found.
- Explicit no-sale pledge: 'We do not sell your Personal Data to any third parties, whether for monetary or other valuable consideration, and have not done so in the prior 12 months.'
- Honors the browser Global Privacy Control (GPC) signal as an opt-out of personal-information 'sale' or 'sharing.'
- Biometric safeguards are relatively strict: hand/finger scan templates are encrypted, never sold/leased/traded, only disclosed by law or warrant, and are permanently destroyed on clear triggers (portal profile removal, access removal, one year after last biometric access, or on request).
- Its Binding Corporate Rules (Binding Corporate Rules) are approved by EU, Swiss, and UK data-protection regulators for global data transfers — a 'gold standard' privacy program.
- General data retention is tied to necessity with deletion at the end of the period, not open-ended.
If you give Equinix a hand or finger scan to enter a data center, you agree in advance to settle any dispute about it through private, confidential arbitration — no court, no jury, and no class or collective action.
The fine print
6 clauses and findings from the draft archive, dated 1 October 2026. The plain English comes first; the small print is the company's own words. None of these has been checked yet.

If you give Equinix a hand or finger scan to enter a data center, you agree in advance to settle any dispute about it through private, confidential arbitration — no court, no jury, and no class or collective action. This is the only forced-arbitration-plus-class-waiver clause found in Equinix's public documents; it applies narrowly to biometric data, not to customers' service contracts.
Any legal disputes, claims, controversies or disagreements arising out of or relating to this Policy or our procedures relating to Authorized Person's biometric data ("Claim") shall be resolved by binding arbitration instead of the courts. All Claims may be brought only in the Authorized Person's individual capacity, and not as plaintiff, claimant or class member in a class, collective or other representative or joint proceeding. Arbitration is the exclusive form for the resolution of such Claims, and both Authorized Persons and we mutually waive our respective right to a trial before a judge or jury in federal or state court.

Same trick on the main website: the terms can change at any time with no notice to you, and whatever version is live when you click is the one you're bound by. They literally tell you to check before every single visit.
Equinix may update these Terms from time to time. Each time you use the Web site you will be operating under the Terms as they exist as of the time of use. Please check these terms prior to each use of our Web site.

How these were found
Document versions read Oct 1, 2026: Equinix Terms of Use (https://www.equinix.com/about/legal/terms, no date shown on page); Equinix Privacy Statement (http://www.equinix.com/about/legal/privacy, search-indexed as updated ~21 days ago); Equinix Community Terms of Service (https://community.equinix.com/site/terms, dated August 1, 2024); Equinix Global Privacy Policy / Binding Corporate Rules PDF (© 2025). Equinix is a B2B data-center colocation REIT — its actual customer contracts (Master Services Agreements) are negotiated and not publicly posted, so this score reflects only public-facing documents. B2B negotiated contracts typically do not use consumer-style forced arbitration or auto-renew traps, which is why the score is modest. No OpenTermsArchive/mirror was needed; all documents loaded directly.
