Where Deckers Brands does well

  • Renewals 0 of 20. Nothing found.
  • Honors an opt-out of sale/sharing for targeted ads via a Cookie Preferences tool and browser opt-out preference signals (though clearing cookies kills the opt-out), and pledges no discrimination for exercising state privacy rights.
  • Does not knowingly sell/share data of anyone under 16 and does not sell or share Sensitive Personal Information.
  • Retention policy has concrete caps: customer-acquisition data kept no more than 3 years from last contact, and cookie/tracker data no more than 24 months without renewed notice or consent; account deletion triggers data erasure (though loyalty points and rewards are forfeited).
  • Promises notice — by email or a highlighted site change — before material privacy policy changes affecting previously collected data, and says Terms changes come 'upon notice.' Arbitration has small-claims and government-agency carve-outs, Deckers will cover prohibitive arbitration costs if the arbitrator deems them prohibitive, and Canadian customers are exempt from arbitration entirely.
  • No subscription or auto-renew product was found, so there is no cancellation-trap risk in the documents.

Every US customer is forced into private, individual arbitration with no judge, no jury, and no class actions — just for using the website.

The fine print

6 clauses and findings from the draft archive, dated 1 October 2026. The plain English comes first; the small print is the company's own words. None of these has been checked yet.

  1. Every US customer is forced into private, individual arbitration with no judge, no jury, and no class actions — just for using the website. A 60-day 'informal' process (including a mandatory personal phone/video call with Deckers) is a condition precedent, enforceable by court injunction, and proceedings are kept confidential. The clause explicitly 'survives the termination of your relationship with Deckers.' No opt-out period was offered; only Canada is exempt.

You and Deckers agree that, except as set forth below, we will resolve any controversies, claims, counterclaims, or other disputes between you and Deckers ... through final and binding arbitration instead of through court proceedings ... You and we hereby waive any right to a jury trial of any Claim. ... Neither you nor Deckers may act as a class representative or private attorney general, nor participate as a member of a class of claimants, with respect to any Claim. You may not bring Claims in arbitration on a class or representative basis.

Global Terms and Conditions of Use

  2. If many customers file similar claims at once, Deckers can slow-walk them through staged 'batching' (20, then 40, then 100 at a time) and seek to split arbitration fees onto claimants' lawyers — a structure designed to defang coordinated consumer claims.

If twenty-five (25) or more similar claims are asserted against Deckers at or around the same time by the same or coordinated counsel or are otherwise coordinated (and your Claim is one such claim) (a 'Mass Arbitration'), you understand and agree that the resolution of your Claim might be delayed. ... Twenty (20) claims shall be selected to proceed to individual arbitration proceedings as part of a first batching process ... then forty (40) ... this staged process shall continue with no more than one hundred (100) claims proceeding at any time.

Global Terms and Conditions of Use

  3. Any photo, video, or review you post on their site — including other people's faces in your photos — becomes Deckers' to use forever, worldwide, for free, and they can sublicense it to others. The license never expires even if you leave.

You ... grant Deckers a non-exclusive, perpetual, transferable, sub-licensable, royalty-free, worldwide license to use any of the User Content you post, including the likeness of any person who appears in the User Content, or any concepts or ideas contained in your User Content.

Global Terms and Conditions of Use

  4. Deckers openly admits to selling/sharing your data for targeted ads — including protected-class characteristics (like race or gender inferred from your activity) and behavioral profiles built about you — through ad networks.

Through our participation in digital advertising networks and in connection with our Select Partners, we may sell or share/use for targeted advertising, the following categories of personal information: Identifiers; Characteristics of protected classifications under California and federal law; Internet/electronic activity; Commercial information; and Inferences drawn from the categories described above in order to create a profile about you.

    Global Privacy Policy

  5. Deckers can rent out or swap your contact info with outside 'Select Partners' so those companies can market to you directly. It also states: 'We purchase from and trade contact information, demographic information, commercial information, and internet and electronic activity with data co-ops and other third party data aggregators.'

From time to time we might establish a business relationship with other people or entities whom we believe trustworthy and whom we have asked to confirm that their privacy policies are consistent with ours. These are known as our Select Partners. In such cases we might rent, exchange, share and/or cross-reference information, including contact information about you that will enable those people or entities to contact you regarding products and services that may be of interest to you.

    Global Privacy Policy

  6. Deckers records your browsing sessions (session replay — essentially a video of your clicks, scrolls, and keystrokes on the site) and uses it for marketing, while ignoring your browser's Do Not Track signal entirely.

We use technologies that maintain records of your browsing session, chats, and other activities on the website. These technologies may include session replay that maintains a record of your browsing sessions interactions with the website ... We use this information for quality control, customer service, fraud prevention and security, and marketing purposes. ... Our systems do not honor browser do-not-track requests.

How these were found

Terms of Use read directly from https://www.deckers.com/terms-of-use (Date of last revision: January 17, 2025), full text fetched via browser_open, no mirror needed. Privacy Policy read directly from https://deckers.com/privacy-policy (Updated: April 22, 2025), full text fetched via browser_open, no mirror needed. Scoring reflects the global deckers.com documents as of Oct 1, 2026. The Terms' Privacy/Returns links point to ugg.com pages that render the same global policy; brand-site variants (hoka.com, teva.com) were not separately reviewed. No consumer subscription/auto-renew program terms were found in either document (Deckers sells footwear/apparel, not subscriptions). No arbitration opt-out window was found in the Terms. The employee-only 'Deckers Rewards' site (deckers.online-rewards.com) is not consumer-facing and was excluded.
