Where Citizens Financial Group does well

  • Arbitration is not a total lock-in: customers have a 45-day opt-out (many banks offer none), individual small-claims court filings are carved out of arbitration, and the Military Lending Act exempts covered borrowers.
  • Overdraft practice is gentler than the $35 fee suggests: Citizens Peace of Mind reverses overdraft fees if you bring the account positive by 10:00 PM ET the next business day, the $5 Overdraft Pass waives fees on items of $5 or less, and Citizens Fee Relief waives the first overdraft fee each year on Quest/Private Client accounts.
  • On privacy, the policy says it does not 'sell' personal information in the traditional sense, offers opt-outs for marketing mail/phone/email via 1-800-922-9999, honors Global Privacy Control signals, and says it does not knowingly sell or share data of anyone under 16.

If Citizens elects arbitration, you lose your day in court, your jury, full discovery, and the right to join or lead a class action — disputes go to a private arbitrator whose award is 'generally final and binding.'

The fine print

6 clauses and findings from the draft archive, dated 1 October 2026. The plain English comes first; the small print is the company's own words. None of these has been checked yet.

  1. If Citizens elects arbitration, you lose your day in court, your jury, full discovery, and the right to join or lead a class action — disputes go to a private arbitrator whose award is 'generally final and binding.'

If you do not opt out, either you or we may elect to have any dispute between us resolved by binding arbitration. If elected, neither you nor we will have the right to: (1) have a court or a jury decide the dispute; (2) engage in information-gathering (discovery) to the same extent as in court; (3) participate in a class action in court or in a class arbitration; or (4) join or consolidate a claim with claims of any other persons... TRIAL WAIVER: YOU AGREE THAT YOU AND WE WAIVE THE RIGHT TO A JURY TRIAL AND TRIAL BEFORE A JUDGE IN A PUBLIC COURT... CLASS ACTION AND CLASS ARBITRATION WAIVER: NEITHER YOU NOR WE SHALL BE ENTITLED TO JOIN OR CONSOLIDATE DISPUTES... OR TO INCLUDE IN ANY COURT ACTION OR ARBITRATION ANY DISPUTE AS A REPRESENTATIVE OR MEMBER OF A CLASS

  2. You can escape arbitration, but only if you mail a written opt-out to a Providence PO Box within 45 days of opening the account — email or phone don't count — and the bank's own business records are declared 'final and conclusive evidence' of whether you did it in time.

To opt out of this Arbitration Agreement, you must send us written notice of your decision within 45 days of the date of the Line of Credit Agreement... must be mailed to Arbitration Opt-Out, PO Box 6067, Providence, RI 02940-6067. This is the sole method by which you can opt out of this Arbitration Agreement... You agree that our business records will be final and conclusive evidence with respect to whether you opted out of this arbitration agreement in a timely and proper fashion.

Citizens Pay Line of Credit Agreement (Surface Disclosure) — (the Citizens Credit Card Agreement on p1.aprimocdn.net uses an identical 45-day mail-only opt-out, addressed to Credit Card Services – Arbitration, P.O. Box 7092, Bridgeport, CT 06601)

  3. Before you can even start an arbitration, you must mail a claim notice by certified mail (return receipt) to a different PO Box, tell them the dollar amount you'd accept to settle, and give them at least 30 days to resolve it — adding cost, delay, and a trip to the post office as a gate to your dispute.

Prior to initiating an arbitration, you may give us a written Claim Notice describing the basis of your claim and the amount you would accept in resolution of the Claim, and a reasonable opportunity, not less than thirty (30) days, to resolve the claim. Such a Claim Notice must be sent to us by certified mail, return receipt requested, at Citizens Pay, PO Box 42124, Providence, RI 02940-2124. This is the sole and only method by which you can submit a Claim Notice.

  4. Citizens feeds your name, contact info, browsing history, and site interactions to ad networks, marketing companies, and social media firms for behavioral ad targeting — a 'sale'/'share' under California law, just wrapped in the line that they don't 'sell' data 'in the traditional sense.' And note the carve-out in the same policy: if you hold a personal financial product with them, CCPA rights don't apply to the data on that account at all (it's covered by bank-privacy law instead).

We may share the following categories of Personal Information with third parties... since we disclose Personal Information to them which they may use for cross context behavioral advertising... we shared for cross context behavioral advertising and may continue to share... Identifiers, such as name and contact information. Internet or network activity information, such as browsing history and interactions with our website. The categories of third parties... include online Advertising Networks, Marketing Companies, and Social Media Companies. Please note that we do not 'sell' Personal Information in the traditional sense.

  5. Citizens can change APRs, fees, and any account benefit 'from time to time'; you'll only be told if you can reject the change if the law requires it — and for online/mobile services, using the service after a change counts as consent, while rejecting a change can get your access terminated.

We may change the terms of this Agreement, including but not limited to Annual Percentage Rate (APR) and fees, from time to time. We may also add new terms, delete terms, or change any benefit, service, or feature on your Account... If required by applicable law, we will provide notice of the change to you before the effective date of the change. We will tell you in the notice if you have the right to reject the change. [And:] This Agreement may be amended from time to time... You will be prompted to accept or reject any material change to this Agreement the next time you use the Service... We may terminate your right to use the Service if you reject such change. Your acceptance of the revised Agreement or the continued use of the Service will constitute your consent to be bound by the revised Agreement.

  6. Agreeing to the mobile-deposit service gives Citizens permission to pull its fees out of ANY of your accounts — even if that creates an overdraft — and grants it a lien over all your accounts and deposits that survives even after you cancel the service.

You authorize the Bank to deduct any such fee from any of your Bank accounts, even if such deduction causes an overdraft in the account... You grant us a security interest in all of your accounts or other deposits (whether general or special) at the Bank, and in all funds in such accounts or other deposits, to secure your obligations to the Bank under this Agreement... This security interest will survive termination of this Agreement.

Personal Deposit Account Fees and Features Guide quoted via a verbatim third-party mirror of CFG's own CDN file (dev.clauneck.workers.dev mirror of p1.aprimocdn.net/citizensbank/.../personal_fees_Original file.pdf), flagged as mirror. The full Personal Deposit Account Agreement itself was not publicly fetchable: citizensbank.com/accountsafeguards/privacy.aspx returned HTTP 403, and no current PDAA PDF was indexed on CFG's domains. Federal court documents quoting CFG's PDAA arbitration section (Fawcett ex rel. Situated v. Citizens Bank, N.A.; Booth v. Citizens Bank, N.A., 1:2022cv05276) corroborate the 45-day mail-only opt-out but were used only as corroboration, not as clauses. Excluded look-alikes that are NOT Citizens Financial Group: citizensbank.net, citizensbankia.com, citizensbank24.com, cbbank.com, and CIT Bank (cit.com) — none of their documents were used.
