Where Citigroup does well

  • Citi's arbitration clause has a real opt-out (45 days, mailed written notice) — worse peers like Coinbase offer none.
  • The privacy notice gives Californians and Vermonters extra nonaffiliate-sharing protections, the only opt-out of marketing-to-you/affiliate-creditworthiness sharing is a published phone number, and the arbitration clause does not apply to MLA-covered borrowers.

You give up court, jury trial, and class actions — any dispute goes to a private arbitrator, and the clause is 'interpreted in the broadest way the law will allow'.

The fine print

6 clauses and findings from the draft archive, dated 1 October 2026. The plain English comes first; the small print is the company's own words. None of these has been checked yet.

  1. You give up court, jury trial, and class actions — any dispute goes to a private arbitrator, and the clause is 'interpreted in the broadest way the law will allow'.

This section provides that disputes may be resolved by binding arbitration. Arbitration replaces the right to go to court, have a jury trial or initiate or participate in a class action.

  2. There IS an opt-out, but it's a paper letter with a wet signature within 45 days of opening, per-account — miss the window or open a second account and you're stuck in arbitration.

You may reject this arbitration provision by sending a written rejection notice to us at: PO Box 6195; Sioux Falls, SD 57117-6195. Your rejection notice must be mailed within 45 days of Account opening... include your name, address, Account number and personal signature. No one else may sign the rejection notice. Your rejection notice will not apply to the arbitration provision(s) governing any other account(s) that you have or had with us.

  3. Citi can unilaterally rewrite the deal — rates, fees, even add or remove whole clauses — whenever it wants, with notice only if the law requires it.

We may change this Agreement for any reason and at any time, subject to applicable law. This means that we can change rates and fees that apply to your Account. It also means we can add, replace or remove provisions of this Agreement.

  4. One bad 60-day stretch can land you a penalty rate on everything you already owe, and it can last forever unless you claw back with six on-time payments.

If you don't make your next six consecutive Minimum Payments Due on time, the penalty APR may continue to apply indefinitely to existing balances and new Transactions.

  5. Closing your account doesn't stop the data sharing — your info keeps flowing to affiliates and marketers after you leave. (Marketing/joint-marketing sharing also offers no opt-out; affiliates and nonaffiliates sharing is opt-out-by-phone only.)

When you are no longer our customer, we continue to share your information as described in this notice.

  6. For deposit accounts, you get 30 days in writing to flag a statement error or Citi disclaims liability, and only one year (two in Texas) from the first statement to sue or arbitrate over it.

Within thirty (30) days after we send or make available to you your account statement and accompanying items, you must notify us in writing of any errors, discrepancies, or unauthorized transactions... If you fail to do so, we will not be liable for debits or charges to your account... You also agree that any suit or demand for arbitration that you assert based on an account error, discrepancy, or unauthorized transaction must be brought within one (1) year (two (2) years in Texas) after the date of the first account statement on which the error, discrepancy, or unauthorized transaction appears.

How these were found

Privacy Notice read in full from official citi.com PDF (Rev. April 2026, CRE177, ©2026 Citibank, N.A.). Cardmember Agreement read from official Citi PDF (aemapi.citi.com; version unspecified, no revision date printed in extract). Deposit Client Manual details (error-notification deadline, amendment language, deposit arbitration opt-out address) verified via third-party mirrors (scribd/courtlistener/study-notes-pdfs) because citi.com's current Client Manual is not directly fetchable; exact current wording may have been revised. Arbitration opt-out for cards is narrow (45 days, postal mail, personal signature, per-account).

These notes come from the original draft and are not independent verification.
