Where Atmos Energy does well

  • Arbitration 2 of 20. Few problems found.
  • No forced arbitration or class-action waiver appears anywhere in the Legal Statement — genuinely better than most large consumer companies, and court access is preserved.
  • The privacy policy explicitly states Atmos Energy does not sell personal data and will not sell or share SMS opt-in information for marketing.
  • The SMS texting program is purely optional with granular per-type opt-outs (STOPNEW, STOPDUE, STOPPAY, etc.) and clear confirmations.
  • Autopay enrollment is cancellable at any time online or by phone (takes effect next billing cycle).
  • Atmos provides a Texas Privacy Act data-request path on its Contact page.

Atmos can rewrite the autopay agreement whenever it wants and you're bound by the changes until you quit — including raising the card-payment surcharge with no notice, and if you get a refund, the 2.85% convenience fee (paid to vendor Paymentus) is never returned.

The fine print

7 clauses and findings from the draft archive, dated 1 October 2026. The plain English comes first; the small print is the company's own words. None of these has been checked yet.

  1. Atmos can rewrite the autopay agreement whenever it wants and you're bound by the changes until you quit — including raising the card-payment surcharge with no notice, and if you get a refund, the 2.85% convenience fee (paid to vendor Paymentus) is never returned.

From time to time, and at any time, you understand that the terms of this Agreement may be changed and that you will be bound by the changes until you terminate your enrollment in this Agreement. Currently, the thirdparty fee is 2.85% of the amount paid per transaction. This percentage is subject to change without prior notification. Should a refund be processed relating to your credit card or digital wallet payment, the returned payment will include only the amount paid to the balance. The separate thirdparty fee will not be refunded.

Automatic Payment Plan Agreement (Non-Residential Customers)

  2. Choose autopay by card or digital wallet and you're automatically switched to paperless-only billing — and if the emailed bill never arrives (e.g., spam-blocked), you still owe the payment and any late fees.

Enrolling in the Atmos Energy Automatic Payment Plan Agreement card payment or digital wallet payment options will automatically enroll you in Atmos Energy's E-Bill program. As part of this program, your monthly billing statements and payment confirmations will only be electronically delivered to you via the email address you provide. ... You remain responsible for paying your monthly balance regardless of any such email delivery failure.

  3. They don't sell your data, but they reserve the right to hand customer information to affiliates and outside companies for reasons as vague as 'opportunities we think may be of interest' — a loophole for marketing-adjacent sharing.

Atmos Energy does not sell personal data. However, Atmos Energy may sometimes disclose or provide customer information to affiliated or non-affiliated third parties to respond to a customer request for service, provide appropriate service, better understand customer needs or provide opportunities we think may be of interest to our customers.

  4. Third-party ad trackers on their website share your browsing behavior for targeted advertising — despite being a regulated utility, not an ad business.

We also use third-party cookies and trackers that share information about your use of our site to third parties for analytics and, in some states, targeted advertising, to help us display and tailor advertisements.

Privacy Policy (updated June 28, 2024)

  5. If their payment system glitches, delays, or duplicates a charge from your bank account, they disclaim responsibility for the error.

Atmos Energy is not responsible for any failure or error that may occur in processing your payment, including but not limited to any interruption, omission, mistake, malfunction, or delay.

Automatic Payment Plan Agreement (Non-Residential Customers)

  6. They collect voice recordings of your calls, your browsing and search history, and even photos taken at your home that may capture your image — a wide surveillance footprint for a gas bill.

Communications, including emails with you or voice recordings from calls with you; ... Other information about your premises, such as installations and appliance data, and the location of utilities on your premises, which may involve taking photographs on your premises that incidentally include your image; ... Internet or other electronic network activity information, including, but not limited to, IP address, device ID, browsing history, search history ...

Privacy Policy (updated June 28, 2024)

  7. No forced arbitration — but any dispute must be fought in Texas courts under Texas law, wherever you live.

These Terms shall be governed in all respects in accordance with the laws of the State of Texas without regard to the conflict or choice of law rules thereof. Courts sitting in the State of Texas, federal and state, shall have exclusive jurisdiction over any dispute arising hereunder.

    Legal Statement (Terms of Use)

How these were found

Researched Oct 1, 2026 via browser_open on official atmosenergy.com domains (no mirrors needed; all pages fetched successfully). Privacy Policy is dated June 28, 2024; Legal Statement carries a 2017 copyright; Mobile Terms page is undated. The Automatic Payment Plan Agreement fetched was the non-residential version (PDF, undated) — the residential version may differ slightly. Utilities are heavily tariff-regulated, so billing/service terms are largely set by state commissions rather than Atmos; only the website/account terms assessed here are within Atmos's control. A guess of https://www.atmosenergy.com/terms-of-use/ returned 404; the Legal Statement is the operative site terms.
