Where Amgen does well

  • Renewals 0 of 20. Nothing found.
  • The Terms of Use include a real opt-out for the arbitration agreement: you can reject it by mailing a written notice within 30 days of first agreeing, and future changes to the arbitration clause can likewise be rejected in writing.
  • The Privacy Statement pledges: 'We will not sell or disclose any directly or indirectly identifiable information or health-related personal information that you provide on our site to an unrelated third party.'
  • Amgen's Privacy Pledge to Patients says patient-support program enrollment is voluntary and always provides patients with an easy option to cancel participation, and under-age data is deleted from active databases when discovered.
  • The patient-site cookie banner gives an explicit Decline option and a withdraw-anytime preferences page, and sensitive health-condition data is only collected and shared with consent.
  • Terms promise no retroactive changes to privacy rights unless legally required.

By simply using Amgen's websites or apps, you give up your right to sue Amgen in court or join a class action — every dispute must go through private individual arbitration, where discovery and other court rights may be limited.

The fine print

6 clauses and findings from the draft archive, dated 1 October 2026. The plain English comes first; the small print is the company's own words. None of these has been checked yet.

  1. By simply using Amgen's websites or apps, you give up your right to sue Amgen in court or join a class action — every dispute must go through private individual arbitration, where discovery and other court rights may be limited. You can opt out, but only by mailing a signed letter within 30 days of first using the site.

MANDATORY BINDING ARBITRATION OF DISPUTES: YOU AND AMGEN AGREE THAT ALL COVERED DISPUTES WILL BE RESOLVED BY BINDING INDIVIDUAL ARBITRATION IN THE MANNER SPECIFIED IN THIS SECTION 13 AND THAT YOU AND AMGEN WAIVE ANY RIGHT TO BRING SUCH CLAIMS BEFORE ANY COURT OF LAW. RIGHTS THAT YOU WOULD HAVE IF YOU WENT TO COURT, SUCH AS ACCESS TO DISCOVERY, MAY BE UNAVAILABLE OR LIMITED IN ARBITRATION. ... YOU AND AMGEN AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY ON AN INDIVIDUAL BASIS AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, AGGREGATE, MASS, COLLECTIVE, OR REPRESENTATIVE ACTION OR PROCEEDING, AND THAT EACH ARE WAIVING THE RIGHT TO A TRIAL BY JURY.

  2. Amgen shares every category of consumer health data it collects — your diagnoses, medications, genetic data, even precise location tied to seeking health care — with third parties that include joint-marketing partners, social-media ad platforms, and advertising networks.

  3. On Amgen's patient-support site, clicking 'Accept' lets Amgen collect data showing you are seeking treatment for a health condition and share that sensitive data with third-party vendors.

This may include collecting your sensitive data, such as information identifying you as seeking treatment for a health condition. We may also share this information with third party providers, a list of which may be viewed by clicking on 'Details'. By clicking 'Accept' you are consenting to both the collection and sharing of your sensitive data by Amgen.

  4. Patients enrolling in support programs sign over their protected health information for Amgen's own product development and evaluation, and Amgen pays patients' pharmacies to disclose that health information. Saying no to the health-data consent means no enrollment in the program.

I authorize Amgen and its data processors (collectively, 'Amgen') to collect, use, and disclose my protected health information for the following purposes: ... To improve, develop, and evaluate Amgen's products, services, materials and programs related to my condition or treatment. ... I understand that certain of my Health Care Providers (such as pharmacies and specialty pharmacies) may receive remuneration from Amgen in exchange for disclosing my protected health information to, and between themselves, as necessary for the purposes stated in this Authorization.

  5. Amgen can change the terms at any time by just updating the webpage — merely continuing to visit the site counts as agreeing to the new terms, with no email or explicit notice required. (One guardrail: changes can't retroactively shrink your privacy rights.)

We will notify you of changes, including material changes, to these Terms by updating the date of these Terms and posting the updated Terms on the Services website. ... Your continued use of the Services after the Effective Date constitutes your acceptance of any amendments or supplements to these Terms.

  6. Anything you post on Amgen's sites becomes Amgen's forever — they can reuse it commercially, in any media that ever gets invented, without paying you, and can sublicense it to others through multiple tiers. Separately, claims are time-barred after one year ('forever barred'), damages are capped at the lesser of your past 6 months of payments and $1,000, and you agree to pay Amgen's legal bills if a third party sues over your use of the site.

you grant Amgen and Amgen's designees a worldwide, non-exclusive, sub-licensable (through multiple tiers), transferable, royalty-free, perpetual, irrevocable right to use, reproduce, sublicense (through multiple tiers), distribute, create derivative works of, perform and import your User Contributions in any media now known or hereafter developed, for any purpose whatsoever, commercial or otherwise, without compensation to you. All User Contributions are deemed non-confidential and non-proprietary.

How these were found

Documents relied on, all read via browser_open or official-domain search snippets: Terms of Use effective Feb 20, 2024 (https://www.amgen.com/terms-of-use, full text read); Consumer Health Data Privacy Policy effective March 31, 2024 (https://wwwext.amgen.com/healthdataprivacypolicy, full text read); Privacy Statement as posted for India (https://www.amgen.com/india/privacy-statement, full text read — substantially identical to the US policy; the US page https://wwwext.amgen.com/privacy-statement rendered in Spanish locale, so India English text was used for the general policy clauses); Amgen SupportPlus patient enrollment forms (Imdelltra Bridge form 08/24, PAVBLU form 06/24, Insurance Verification form 11/25 PDFs on amgensupportplus.com) — enrollment-form clauses read from official-domain search snippets of the PDFs, not the PDFs themselves; amgensupportplus.com cookie-banner text likewise from official-domain search snippets. Amgen is a biopharma company with a mostly patient/HCP informational site surface: no e-commerce subscription or auto-renew product was found, so the auto-renew category scores 0. Only one company researched per assignment; no child agents used; no clauses, quotes, numbers, URLs, or scores invented.
